McCotter Post Office Box 2384 New Bern, North Carolina 28560 Dear Mr. McCotter: RECEIVED J U L 2 7 1987 WATER QUALITY SECTION OPERATIONS BRANCH Through coordination with Mr. Jim Mercer of the North Carolina Division of Coastal Management, we have learned of your-plans to install a wastewater discharge (outfall) line into the Trent River along the western property line of your property, Trent River Motel, Craven County, North Carolina. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits.. Authorization was provided for outfall structures where the effluent from that outfall has been permitted under the National Pollutant Discharge Elimination System (NPDES) program. For this nationwide permit to be valid, you must comply with the following conditions: a. Any discharge of dredged or fill material will not occur in the proximity of a public water supply. b. Any discharge of dredged or fill material will not occur in areas of concentrated shellfish production. c. The activity will not jeopardize a threatened or endangered species as identified under the Endangered Species Act, or destroy or adversely modify the critical habitat of such species. d. The activity will not significantly disrupt the movement of those species of aquatic life indigenous to the waterbody. -2- e. Any discharge of dredged or fill material will consist of suitable material free from toxic pollutants. f. Any structure or fill will be properly maintained. g. The following management practices will be followed to the maximum extent: (1) Discharges of dredged or fill material into waters of the United States will be avoided or minimized through the use of other practical alternatives. (2) Discharges in spawning areas during spawning seasons will be avoided. (3) Discharges will not restrict of impede the movement of aquatic species indigenous to the waters or the passage of normal or expected high flows or cause the relocation of the waters. (4) If the discharge creates an impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow will be minimized. (5) Discharge in wetland areas will be avoided. (6) Heavy equipment working in wetlands will be placed on mats. (7) Discharges into breeding areas for migratory waterfowl will be avoided. (8) A11 temporary fills will be removed in their entirety. The District Engineer has determined that the individual and cumulative adverse effects of your work on the environment will be minimal. Your work is authorized by nationwide permit provided it is accomplished in strict accordance with the preceding conditions. Mr. John Thomas, engineer for Mr. McCotter, submitted a plan (copy attached) on January 3, 1986. The proposed plan calls for the retention of a 2-year- 1 hr. intensity (2.0 inches) rainfall event on site. The plan shows all impervious areas at 100; runoff and all pervious areas at 50% runoff. The design for the retention basin appears to be reasonable. After reviewing the stormwater management plan, I have no objections to the issuance of the CAMA permit. As previously outlined in an outfall pipe permit application dated September 5,"i985, site amenities include a proposed 120 room hotel, with restaurant facilities` for accommodating up to 250 persons and a lounge. Future development as revealed on sheet 4 of 10 of the enclosed drawings may well lend itself to a marina complex with all associated features such as boat launching, docking and storage as well. as multi-family living units. Recapitulating your request we have uniquely adapted, a' stormwater, basin . retention {. area into the, master land use plan. Ahe basin area as requested is of sufficient size to ter runoff from a hypothetical 2 inch water cover of the, entire ,"accommodate stormwa project site of approximately 18 t' acres. As you may well recognize as indicated on sheet 4 of 10 all runoff has theoretically been assumed to meander into the retention area. We feel the design is one utilizing sound stormwater management as desirous of a project of this nature. The area in which the basin will be constructed is at an existing elevation of 4.0 feet. (All elevations are referenced A.M.S.L.) Based on the derived data, a basin shall be designed to accommodate 92.530 cubic feet of stormwater with a basin depth of •3.O feet. Should a generally square `basin be acceptable, one could expect to realize dimension of`-175 feet 'X A75 feet. However in order to provide an aesthetically pleasing design a basin area of varying dimensions will be incorporated. To facilitate an irregular shaped area the invert of the 30" RCP paralleling the eastern edge of the parking lot under the drive entrance will be used as the basin level control. A trapezoidal channel with a minimum cross-sectional area of 48 square feet will be integrated into the basin retention area. This is being done in order to reduce the size of the main retention area. December 30, 1985 Page 3 At this time, we would prefer not to amend the NPDES permit. The criteria used for setting up the design parameters for the permit are still valid in keeping with the basic "conceptual" plan for the site. As shown on the enclosed drawings, marina facilities and multifamily units are shown only in concept. The unit count, if and when constructed may vary slightly from our original estimates or concepts. The hotel and restaurant facility will not require the full capacity of the permitted flow and the owner wishes to phase the construction of the waste water treatment facility as the site development demands. If the marina facilities and the multifamily complex do become a reality at some point in time, the design and construction of the same will be in accordance with the rules and regulations of the government agencies having authority and the proper permits or permit modifications will be applied for. The proposed project will not require a 401 certification. 2. The application does not provide sufficient information on stormwater runoff aspects of the project to allow a complete evaluation of the potential effect on adjacent waters. The application reflects a substantially smaller development than was originally indicated by applicant when obtaining the NPDES permit for wastewater disposal at this project. Earlier indications were that the project would include a marina. Our regional office has discussed these points with the applicants engineer and notified the applicant that these concerns must be adequately addressed so that we may complete our evaluation of the project. It is recommended that further action on this permit not take place until the applicant has satisfactorily addressed these concerns. I have also discussed the proposed development with your engineer, Mr. John Thomas. According to the DF/CAMA application, you propose to develop the property by constructing a 250 seat restaurant and lounge, a 120 room hotel, and a 40,000 GPD wastewater treatment plant. You will recall that this Division issued NPDES permit No. N00056545 on February 7, 1984 for the operation of a 75,000 GPD wastewater treatment plant to serve a 200 unit motel, 200 seat restaurant, 100 condo units, a marina and a swimming pool. It will be necessary to clarify this discrepancy and possibly amend the NPDES permit. Another aspect of your project which needs to be addressed in more detail is the control of storm water runoff to the Trent River. The waters in the Trent River are classified "SB" and must be protected for their best usage, which includes fishing and swimming. In recent years, the Trent River has experienced algal blooms which are a definite response to nutrient inputs such as storm water runoff. You should also indicate any marina facilities that might be constructed in the future. Marinas can be a source of pollution if they are-not con- structed and operated in a reasonable manner. Our primary concern in this regard would be the protection of the fecal coliform standard in the adjacent waters. I would be happy to discuss these issues with you or your engineer at a con venient time. I am recommending to CAMA that your application be placed on hold until these concerns are adequately addressed. If you have any questions, please feel free to call me at 919/946-6481. Project summary The applicant proposes to develop a 120 room hotel with 250 seat restau rant. The facility will be serviced by a40,000 GPD wastewater treatment plant that will have a 200' lQnq outfall pipe into the Trent River - X 9. Narrative description The project site is located across the Trent River from downtown New Bern in James City, just east of the Atlantic & East Caro- lina Railway trestle in Craven County. In recent years this 15 acre tract of land has been used as a staging and storage area for rubber tires used in the State's artificial reef program. The applicant, Ray E. McCotter, plans to develop a 120 room hotel and restaurant complex on a five-acre section of this land located just west of the old Hwy. 70 swing bridge leading into New Bern. The hotel complex will be serviced by a 40,000 gal.per day waste- water treatment-plant. The outfall pipe from the plant will extend some 200' into the Trent River. Except for the alignment of the proposed outfall pipe, no land dis- turbing activities or development will take place within the CAMA 75' estuarine shoreline AEC. The footprint location of the hotel and parking lot areas is shown on ?!ork Plat Drawing sheet 5 of 10 to be some 50' landward of the CAMA AEC line. The proposed outfall pipe, measijring 4" in diameter, will be exca- vated into place some 36" below existing grade elevation. The pipe- line will traverse a-15' wide fringe of marsh dominated by salt reed grass, bullrush, and black needlerush. Elsewhere along the project shoreline the westlands' fringe increases to 30' wide and contains other species such as maples, ball cypress, switchgrass, and water willow. At one point near the middle of the shoreline a `pocket of swamp vegetation extends 125' into the highground pro- perty. The applicant has delineated the upper limits of all of these wetlands by illustrating an alignment of a would-be bulk- head as staked off by permit representatives in 1982. It is, how- every, clear that the appl-icant has no plans to either bulkhead or fill the shoreline. The applicant provides a topographic map of the project site on Work Sheet No. 3 of 10. It shows the high ground sloping gently away from the shoreline to a general elevation of 5-7' above mean sea level. The project site is well drained by two inter-connected ditches that flank the east and west sides of the project dimensions. The applicant's consulting engineer, John Thomas, has advised this office that there are no immediate plans for developing the remain- ing highground property or the waterfront areas. It can only be anticipated that some sort of water related activities, such as a marina or boat storage facility,wil-l-ultimately, come to this pro- perty. It is important to note that the surface waters of the Trent River beginning at the mouth of the river are classified as SB by DEM. 10. Anticipated impacts Installation of the proposed 200' long outfall pipe has keyed the requirement for a CAMA Major Development permit. Excava- tion will directly displace about 45 sq.ft. of coastal wetlands vegetation. Once the 4" pipeline has been installed, the ditch will be backfilled and the marsh can be restored to the align- ment. In the Trent River the outfall pipe can be "jettied" into. the bottom, causing the least amount of bottom disturbance to this underwater area. It would appear that the applicant has designed the direction of flow for the stormwater runoff away from the estuarine shoreline. However, most all of the runoff water from.the project site will ultimately enter the Trent River through the series of existing drainage ditches that parallel SR 1004 and Hwy. 70. These ditches are well vegetated and should absorb and filter low flow levels of runoff. The operation and discharge of the 40,000 GPD wastewater treatment plant has been authorized by the DEM. It is noted with some importance that Township 7, which includes James City, is cur- rently serviced by a new municipal water and sewer system. The loading capacity of the Trent River in and near New Bern may be reduced if the proposed hotel and restaurant complex were to uti- lize the existing sewer services. CAMA Review The LUP for Craven County dated February 1982 classifies the high -ground property in and about the project site as "transition". The wetlands that fringe the project shoreline, as well as the surface waters of the Trent River, are classified as "conservation." It is the opinion of this office that the proposed hotel project is not inconsistent with any identifiable policies set forth in the Craven County LUP. r Submitted by 'James L. Piercer Date Oct. 16, 1985 Introduction and Project Description The proposed hotel project is to be located in Craven County, North Carolina in Township 41 7, near New Bern, North Carolina. The Trent River bounds the property on the northern side. The proposed hotel will have 120 rooms, with a restaurant to seat 250 people, and a lounge. This structure will be located away from the shoreline so as not to interfere with the marsh areas and other areas of environmental concern. Project summary The applicant. proposes to develop a X20 room hotel with 250 seat restate rant The facility will be serviced by a40.000 GPD wastewater treatment plant that will have a 200' long_outfall pipe into the Trent Fiver. 9. Narrative description The project site is located across the Trent River from downtown New Bern in James City, just east of the Atlantic & East Caro- lina Railway.trestle in Craven County. In recent years this 15 acre tract of land has been used as a staging and storage area for rubber tires used in the State's artificial reef program. The applicant, Ray E. McCotter, plans to develop a 120 room hotel and restaurant complex on a five-acre section of this land located just west of the old Hwy. 70 swing bridge leading into New Bern. The hotel complex will be serviced by-a 40,000 gal.per day waste- water treatment plant. The outfall pipe from the plant will extend some 200' into the Trent River. Except for the alignment of the proposed outfali pipe, no land dis- turbing activities or development will take place within the CAMA 75' estuarine shoreline AEC. The footprint location of the hotel. and parking lot areas is shown on Work Plat Drawing sheet 5 of 10 to be'some 50' landward of the CAMA AEC line. The proposed outfall pipe, meastiring 4" in diameter, will be exca- vated into place some 36" below existing grade elevation. The pipe- line will traverse a 15' wide fringe of marsh dominated by salt reed.grass, bullrush, and black needlerush. Elsewhere along the project shoreline the westlands' fringe increases to 30' wide and contains other species such-as maples, ball cypress, switchgrass, and water willow. At one point near the middle of the shoreline a pocket of swamp vegetation extends 125' into the highground pro- perty. The applicant has delineated the upper limits of all of these wetlands by illustrating an alignment of a would-be bulk- head as staked off by permit representatives in 1982. It is, how- every, clear that the applicant has no plans to either bulkhead or fill the shoreline. The applicant provides a topographic map of the project site Work Sheet No. 3 of 10. It shows the high ground sloping gently away from the shoreline to a general elevation of 5-7' above mean sea level. The project site is well drained by two inter-connected ditches that flank the east and west sides of the project dimensions. The applicant's consulting engineer, John Thomas, has advised this office that there are no immediate plans for developing the remain- ing highground property or the waterfront areas. It can only be anticipated that some sort of water related activities, such as a marina or boat storage facility,wil.l-ultimately come to this pro- perty. It is important to note that the surface waters of the Trent River beginning at the mouth of the river are classified as SB by DEM. r 10. Anti ci pated i'rripacts Installation of the proposed 200' long outfall pipe has keyed the requirement for a CAMA Major Development permit. Excava- tion will directly displace about 45 sq.ft. of coastal wetlands vegetation. Once the 4" pipeline has been installed, the ditch will be backfilled and the marsh can be restored to the align- ment. In the Trent River the outfall pipe can be "jettied" into the bottom, causing the least amount of bottom disturbance to this underwater area. It would appear that the applicant has designed the direction of flow for the stormwater runoff away from the estuarine shoreline. However, most all of the runoff water from the project site will ultimately enter the Trent River through the series of existing drainage ditches that parallel SR 1004 and Hwy. 70. These ditches are well vegetated and should absorb and filter low flow levels of runoff. The operation and discharge of the 40,000 GPD wastewater treatment plant has been authorized by the DEM. It is noted with some importance that Township 7, which includes James City, is cur- rently serviced by a new municipal water and sewer system. The loading capacity of the Trent River in and near New Bern may be reduced if the proposed hotel and restaurant complex were to uti- lize the existing sewer services. CAMA Review The LUP for Craven County dated February 1982 classifies the high ground property in and about the project site as "transition" The wetlands that fringe the project shoreline., as well as the surface waters of the Trent River, are classified as "conservation." As previously outlined in an outfall pipe permit application dated September 5, 1985, site amenities include a proposed 120 room hotel, with restaurant facilities for accommodating up to 250 persons and a lounge. Future development as revealed on sheet 4 of 10 of the enclosed drawings may well lend itself to a marina complex with all associated features such as boat launching, docking and storage as well as multi-family living units. Recapitulating your request we have uniquely adapted a stormwater basin retention area into the master land use plan. The basin area as requested is of sufficient size to accommodate stormwater runoff from a hypothetical 2 inch water cover of the entire project site of approximately 18 f acres. As you may well recognize as indicated on sheet 4 of 10 all runoff has theoretically been assumed to meander into the retention area. We feel the design is one utilizing sound stormwater management as desirous of a project of this nature. ' 555,172 s.f. x 0.1667 ft. = 92,529 cubic feet required Boring logs from the project site reveal the ground water table to be at elevation 1.0 feet A.M.S.L. The area in which the basin will be constructed is at an existing elevation of 4.0 feet. (All elevations are referenced A.M.S.L.) Based on the derived data, a basin shall be designed to accommodate 92.530 cubic feet of stormwater with a basin depth of 3.0 feet. Should a generally square basin be acceptable, one could expect to realize dimension of 175 feet x 175 feet. However in order to provide an aesthetically pleasing design a basin area of varying dimensions will be incorporated. To facilitate an irregular shaped area the invert of the 30" RCP paralleling the eastern edge of the parking lot under the drive entrance will be used as the basin level control. A trapezoidal channel with a minimum cross-sectional area of 48 square feet will be integrated into the basin retention area. This is being done in order to reduce the size of the main retention area. December 30, 1985 Page 3 At this time, we would prefer not to amend the NPDES permit. The criteria used for setting up the design parameters for the permit are still valid in keeping with the basic "conceptual" plan for the site. As shown on the enclosed drawings, marina facilities and multifamily units are shown only in concept. The unit count, if and when constructed may vary slightly from our original estimates or concepts. The hotel and restaurant facility will not require the full capacity of the permitted flow and the owner wishes to phase the construction of the waste water treatment facility as the site development demands. If the marina facilities and the multifamily complex do become a reality at some point in time, the design and construction of the same will be in accordance with the rules and regulations of the government agencies having authority and the proper permits or permit modifications will be applied for.
