THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Loch Highlands Partnership
pursuant to an application filed on the 15th day of September, 1987 to
construct a dam and lake at Lochmere Highlands.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to Swift Creek in conjunction with the proposed dam and lake in Wake
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That appropriate sedimentation and erosion control
measures shall be employed to minimize turbidity
and siltation impacts.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

On July 29, 1987, you met with Mr. Jeff Richter of my staff
concerning two sites in Cary, Wake County, North Carolina.
The first site was a disposal site for material involved in
the construction of the American Airlines Reservation Center at
the end of Gregson Drive, in the MacGregor Park development,
adjacent to a tributary of Swift Creek, in Cary, Wake County,
North Carolina.
Mr. Richter determined that the flagged outline of the
proposed disposal area was not in wetlands; therefore, no Corps
authorization is required. You said that no fill or ground
disturbing activity will occur past the flagged area.
The second site was in the proposed Lochmere Highlands
development off Kildare Farms Road, on a tributary of Swift Creek
in Cary. You propose building roads and also constructing a dam
to create a pond. Mr. Richter determined that the creek itself is
a wetlands over which the Corps has jurisdiction, but the rest of
the proposed work will not impact wetlands. You will need to
apply for and receive a valid Department of the Army permit for
the placement of any fill material in the creek. Enclosed is an
application package for your use in initiating this permit
process.

Public Notice of Application for
Water Quality Certification
The North Carolina Division of Environmental Management
of the Department of Natural Resources and Community
Development has received an application from Loch Highlands
Partnership, P.O. Box 790, Cary, N.C. for a Water Quality
Certification pursuant to Section 401 of the Federal Clean
Water Act as amended. The activity for which the
certification is sought is the construction of an earthen
dam on a tributary to Swift Creek in the Lochmere Highlands
development south of Cary in Wake County.
The public is invited to comment on the impact of the
proposed project on water quality. A copy of the
application may be inspected at the Department's office in
Raleigh, Archdale Building, 512 N. Salisbury Street, Room
904E or the Raleigh Regional Office, 3800 Barrett Drive,
Raleigh, N.C., during normal work hours. Comments must be
submitted in writing no later than OctoberS,1-3, 1987. Any
comments should be addressed to the N.C. Division of
Environmental Management, Water Quality Section, P.O Box
