Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The proposed entrance canal alignment will be relocated southward so that only high ground will be excavated. Wetlands north of the existing high ground will not be excavated or filled. (2) The proposed basin alignment will be relocated eastward so as to include no more than an average of a 15 feet wide and a maximum, at any one point, of a 20 foot wide area of wetlands west of the existing canal. At its southern end, the basin will connect with the existing canal parallel to the access road from North Carolina Hiahwav 304. (3) Prior to excavation, the revised basin alignment, approved herein, will be appropriately marked by staking and the Division of Coastal Management and the Corps of Engineers will be notified in order that a site inspection may be carried out. (4) To compensate for wetland losses, a 4,000-square-foot area of existing high ground on Jones Island, adjacent to the AIWW, will be excavated to (See attached This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Jones Island Company Permit #223-87.- Page 2 ADDITIONAL CONDITIONS an elevation below the elevation of existing, adjacent wetlands, filled back to adjacent wetland elevation using organic material, allowed to naturally revegetate, and permanently retained as a vegetated wetland area. If natural revegetation of at least 60 percent of the wetland creation site has not occurred after one growing season, the area will be planted with native wetland trees and shrubs, intermixed on 20-foot centers. The wetland creation site will be selected by the applicant subject to the approval of the .U.S. Fish and Wildlife Service and the N. C. Wildlife Resources Commission in consultation with the Division of Coastal Management. (5) In order to protect juvenile shrimp and fin fish, no excavation will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the N.C. Division of Coastal Management. (6) An earthen plug will be left between the canal and the AIWW until excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed to elapse before the plug is removed. (7) All excavated materials will be confined landward of the normal water elevation contour and any irregularly-flooded vegetated wetlands. (8) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters of the State. (9) Excavation will not exceed 5 feet below the elevation of normal water. (10) The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (11) The authorized structure and associated activity will not cause an unacceptable interference with navigation. (12) This permit does not authorize interference with any existing or proposed Federal project. (13) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of -this permit. The permittee is not relieved of this requirement if he ahandons the permitted activity without having it transferred to a third party. (14) Prior to occupancy of any new slips authorized under this permit, the permittee will permanently equip the marina with a pumpout facility to service boats with holding tanks. NOTE: An Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Project summary: Applicants propose to excavate a boat basin, construct a boatramp and lace piers and pilings for 27 boats at property adjacent to the IWW, off Hwy. 304, 1.1 miles South of the Hobucken Bridge, Pamlico County. Jones Island Company Page 2 9. NARRATIVE DESCRIPTION: Jones Island, the applicant, are the developers of the old South Rod and Gun Club. Old South Rod and Gun Club is a hunt club and condominium development of the area known as Jones Island, a 5,000 acre marsh/woods land complex located on the East side of the Intercoastal Waterway, approximately 1.1 mile South of the Hobucken Bridge in Pamlico County. Over the years, our principal contacts for Jones Island Company have been John Williams and Steve Wright of Rocky Mount, N.C. Previous permit requests involving Jones Island have been by Governor's Island Partnership Permit #39-80 in 1980 for the barge slips construction and the landing areas on the mainland in the main island, and by C. T. Associates in 1985 for logging roads on the outlying islands. This present proposal is for a canal and basin on the mainland in order to form a land base for the owners in the hunting club. The property is located down a dirt road off Highway 304 approximately seven tenths (.07) of a mile North of the intersection of Highway 304 and SR 1224 near Hobucken in Pamlico County. The project site is located at the end of this dirt road on the Intercoastal Waterway approximately 1.1 mile South of the Hobucken Bridge. The property was originally created from the materials obtained from the existing barge slip. This material was spread to form the existing high ground. The high ground is presently used for equipment storage prior to transportation to the island. The only permanent structures being for storage of corn. The land surrounding this fill area is 404 type wetlands according to the U. S. Army Corps of Engineers. These wetlands are composed of mixed myrtle, maple, gum and other species indicative of these wetlands. The shoreline forms a low vertical bank which sometimes mixes these 404 type wetlands with various marsh species. The applicant is proposing to excavate a access canal out of these 404 type wetlands. This canal will have an access channel perpendicular to the Intercoastal Waterway which will be approximately 240 feet long by 40' wide by 5' deep. The channel turns to the South at a right angle and extends 3601to the existing access road, and at this area it is approximately 65' wide. A bulkhead will be constructed on both sides of the entrance channel for 100' on both sides, making a total bulkhead length of 2001. In the basin, a pier 290' long by 6' wide will be constructed along with finger piers and mooring pilings for 27 boats. A boat ramp 15' wide by 20' long is also proposed in the southern part of these slips. Spoil from the excavation of the canal is proposed to be spread over high ground and will consist of approximately 8,000 cubic yards. Jones Island Company Page 3 10. ANTICIPATED IMPACTS: Conducting this project as proposed will involve the excavation of approximately 31,400 sq. ft. of 404 type wetlands composed of maple,. myrtle, gum and other species typical of 404 type areas along with approximately 1600 sq. ft. of subtidal man-made brackish water bottom. The high ground disturbance associated with spoil disposal will involve 37,800 sq. ft. The total area to be disturbed is 70,800 sq. ft. Adjacent waters are classified .as SA according to the Division of Environmental Management and are currently closed to shellfishing according to the Division of Health Services. K Jones Island Company Page 2 9. NARRATIVE DESCRIPTION: Jones Island, the applicant, are the developers of the Old South Rod and Gun Club. Old South Rod and Gun Club is a hunt club and condominium development of the area known as Jones Island, a 5,000 acre marsh/woods land complex located on the East side of the Intercoastal Waterway, approximately 1.1 mile South of the Hobucken Bridge in Pamlico County. Over the years, our principal contacts for Jones Island Company have been John Williams and Steve Wright of Rocky Mount, N.C. Previous permit requests involving Jones Island have been by Governor's Island Partnership Permit #39-80 in 1980 for the barge slips construction and the landing areas on the mainland in the main island, and by C. T. Associates in 1985 for logging roads on the outlying islands. This present proposal is for a canal and basin on the mainland in order to form a land base for the owners in the hunting club. The property is located down a dirt road off Highway 304 approximately seven tenths (.07) of a mile North of the intersection of Highway 304 and SR 1224 near Hobucken in Pamlico County. The project site is located at the end of this dirt road on the Intercoastal Waterway approximately 1.1 mile South of the Hobucken Bridge. The property was originally created from the materials obtained from the existing barge slip. This material was spread to form the existing high ground. The high ground is presently used for equipment storage prior to transportation to the island. The only permanent structures being for storage of corn. The land surrounding this fill area is 404 type wetlands according to the U. S. Army Corps of Engineers. These wetlands are composed of mixed myrtle, maple, gum and other species indicative of these wetlands. The shoreline forms a low vertical bank which sometimes mixes these 404 type wetlands with various marsh species. The applicant is proposing to excavate a access canal out of these 404 type wetlands. This canal will have an access channel perpendicular to the Intercoastal Waterway which will be approximately 240 feet long by 40' wide by 5' deep. The channel turns to the South at a right angle and extends 3601to the existing access road, and at this area it is approximately 65' wide. A bulkhead will be constructed on both sides of the entrance channel for 100' on both sides, making a total bulkhead length of 2001. In the basin, a pier 290' long by 6' wide will be constructed along with finger piers and mooring pilings for 27 boats. A boat ramp 15' wide by 20' long is also proposed in the southern part of these slips. Spoil from the excavation of the canal is proposed to be spread over high ground and will consist of approximately 8,000 cubic yards. Jones Island Company Page 3 10. ANTICIPATED IMPACTS: Conducting this project as proposed will involve the excavation of approximately 31,400 sq. ft. of 404 type wetlands composed of maple, myrtle, gum and other species typical of 404 type areas along with approximately 1600 sq. ft. of subtidal man-made brackish water bottom. The high ground disturbance associated with spoil disposal will involve 37,800 sq. ft. The total area to be disturbed is 70,800 sq. ft. Adjacent waters are classified as SA according to the Division of Environmental Management and are currently closed to shellfishing according to the Division of Health Services.
