Excavation
(1) In order to protect juvenile shrimp and fin fish populations, no excavation
or filling will be permitted between the dates of April 1 and September
30 of any year without the prior approval of the N.C. Division of Coastal
Management.
(2) The diked, excavated material retention area will be constructed a sufficient
distance from the mean high water (MHW) elevation and any vegetated wetlands
to eliminate the possibility of dike erosion into or upon any marsh or
surrounding waters.
(3) All excavated materials will be confined landward of the mean high water
(MHW) elevation contour within adequate dikes or other retaining structures
to prevent spillover of solids into any vegetated wetlands or surrounding
waters.
(4) The terminal end of the pipeline from the dredge into the diked retention
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

to allow adequate settlement of suspended solids.
(5) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to ensure maximum settlement
of suspended solids.
(6) Flow from the diked retention area will be confined by pipe, trough, or
similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and resultant unnecessary siltation.
(7) Vegetated wetlands will not be excavated or filled.
(8) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).
NOTE: An Erosion and Sedimentation control plan will be required for this
project. This plan must be filed at least thirty (30) days prior to
beginning any land, disturbiri,act ivity. Submit this plan to the Dept.
of Natural Resources .and Community Development, Land Quality Section,
7225 Wrightsville Avenue, Wilmington, NC 28403.
Bulkheading
(9) The bulkhead will be positioned at or landward of the mean high water (MHW)
elevation contour. To prevent an unintentional violation of this authorization,
representatives of the N. C. Division of Coastal Management and the Corps
of Engineers will be available to stake the alignment prior to construction.
(10) All backfill materials will be obtained from an upland source and confined
landward of the permitted bulkhead.
Construction of Docks and Piers
(11) The authorized structures and associated activity will not cause an unaccept-
able interference with navigation.
(12) This permit does not authorize interference with any existing or proposed
Federal project.
Marina Operation
(13) Prior to the occupancy of any new slips,-the marina will install and maintain,
for the life of the project, a marine pumpout facility to service boats
with holding tanks.
(14) The marina will post and enforce a no sewage discharge policy.
(15) Livi-ng aboard vessels is not authorized at the marina.
(16) All floating structures, other than boats; used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be'in conformance with"local regulations
for onshore sewage treatment.

(11) In keeping with Coastal Resources Commission Rule NCAC 7H.0208(b)(c)(iii)
the docks and piers proposed for this project must not exceed 1/3 the width
of the Carolina Beach Yacht Basin. For the new structures south of the
man-made basin, the maximum length is approximately 133' as measured from
the edge of a marsh or the mean high water line, whichever gives the permittee
the greater latitude. For the docks and piers north of the man-made basin,
the maximum length is approximately 166'.
(12) The authorized structure and associated activity will not cause an unacceptable
interference with navigation.
(13) This permit does not authorize interference with any existing or proposed
Federal project.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require Water Quality
Certification, but does meet the requirements for
General Certification No. 1272 for bulkhead
construction.
b. It is recommended that the following be required
by conditions in the CAMA permit to minimize the
probability of sewage discharges:
1. That a locked-head policy be established and
enforced for the life of the marina.
2. That no live-aboards or transient dockage be
allowed.
3. That a permanent sewage pumpout facility be
installed and maintained.
4. That signs be prominently displayed on the
docks advising boat operators of the
prohibition against discharging any sewage
and of the location of the sewage pumpout
facility.

Application for Permit for Excavation and/or Fill
Basin Street Associates
New Hanover County
The applicant proposes to renovate an existing marina site.
This project includes bulkheading approximately 670 feet of
shoreline, with wet slips for 130 boats and dry stack facilities
for 376 boats. The marina configuration is open to the adjacent
waters therefore there should not be a problem with the flushing
characteristics. The project is located on SB waters closed to
shellfishing.
The project has been reviewed to determine impact on water
quality. The following comments are offered:
1. The project will require a 401 water quality certification,
and should meet the requirement for a general 401 for
bulkhead construction.
2. The numerical standards for water quality can be expected to
be violated unless the following conditions are incorporated
into the CAMA permit:
a. That a locked head policy be established and strictly
enforced.
b. That there be no live-aboards or transient dockage.
C. That a permanent pump-out facility be installed and
operational prior to marina use, and that the pump-out
facility be maintained throughout the life of the
marina.
d. That signs be posed on each dock prohibiting the
overboard discharge of sewage and informing the marina
users of the pump-out facilities and its operation.

3. Provided the CAMA Permit is issued prior to January 1, 1988,
the project will not be required to have a stormwater
management plan.
This office has no objections to the project provided the above
conditions are adhered to.

8. Project Summary The applicants propose to renovate a dilapidated existing
marina and develop a modern marina complex.

9. PROJECT DESCRIPTION
The project is located on the west side of the yacht basin at Carolina Beach.
There is an existing fish house and pier at the southern end of the project.
In the middle of the project shoreline there is a man-made basin. Just north
of the basin there are several buildings including an old motel and a metal
repair shop. There is also a pier associated with the shop. North of these
buildings there is an undeveloped tract of land on which various marine related
debris is scattered. There are several wrecks (boats) strung along the
shoreline on this north section. Shoals have developed on the landward side of
these structures which have created a very irregular shoreline. There is a
failing bulkhead which begins in front of the motel/shop area and runs
southward around the man-made basin the the southwest corner of the basin. At
this point there is no shoreline protection and some erosion has occurred. At
the southeast corner of the basin there is a border of mixed marsh. On the
most waterward side Spartina alterniflora (smooth cordgrass) forms a band
approximately 50' wide at the point. This band extends down the shoreline
approximately 200' tapering down to 0' wide. Landward of the species there is
_ a 20.'--30' strip of.mixed high.marsh_which includes Borrichia_(sea ox-eye);
Limonium spp• (sea lavender); Iva spp.; Suaeda spp.; Juncus romerianus (black
needlerush) and Spartina patens. The dimensions of the existing basin are
.approximately 160' x 200'. Depths vary from +1' to -4' mean low water (mlw).
South of marsh there is a bulkhead in front of the existing fish house. The
waters in this area were classified as SB as of July 1, 1987 and are a
secondary nursery area. The widths of the yacht basin in this area range from
approximately 400' south of the man-made basin to approximately 500' north of
the basin.
The applicants propose to construct a multipurpose building to replace the
motel/shop, to construct new docks, to construct dry storage buildings and to
create a parking area for cars. They also propose to dredge the existing basin
and to build a bulkhead. The basin will be maintained to a width of 165' x a
length of 206' and to a depth of -6'mlw. Approximately 6,000 cubic yards of
material will be removed and Will be placed on the adjacent high ground. It
will subsequently be used to place behind the proposed bulkhead. The bulkhead
will be approximately 670' in length. It will be designed at or above the mean
high water (mhw) contour and the final alignment will be established by DCM and
Corps personnel. It will also be landward of all marsh south of the basin.
The two existing buildings now used as a fish house will be converted to a
marina sales office and a miscellaneous use building. Four dry stack storage
buildings will be built landward of these two buildings. They will range in
length from approximately 205' to 270' and will be 25' wide. A total of 376
boats will be stored in them. The two existing fixed piers/docks will be
renovated and parallel docking will be provided. Four additional floating
docks are proposed. These lengths of these units are designed based on the
Carolina Beach pier head line. This line crosses the property on a slant based
on the two existing piers. The docks will be interconnected on either side of
the basin by means of a fixed pier/dock. A total of approximately 130 slips
will be provided varying in length from approximately 30' to 501.

The motel/shop will be removed. In their place a 2-story club, lounge,
administration building will be constructed. This structure is the same
approximate square foot foot print as the 2 units it replaces.
Parking will be provided for approximately 209 vehicle. Opaque fences will be
provided along several property lines. A 10' public buffer zone for public use
on the north side.
Two common and drainage holding areas will be provided at either side of the
basin. The one at the north is approximately 240' x 45'. The one to the south
is approximately 160' x 20'. These areas will be landscaped.
A fork lift station will be installed at the southwest corner of the proposed
basin to launch boats from the dry stack storage sheds.
10. ANTICIPATED IMPACTS
This project was designed to meet stormwater requirements prior to the 7/1/87
change. The holding areas on the north exceed 70% pervious coverage. On the
south the holding area and the setback of the storage sheds exceed the 70%
pervious requirement. The proposed docks even though designed based on the
pier head line exceed one-third the distance of the yacht basin. In order to
comply those on the south of the basin should not exceed approximately 133' and
to the north of the basin should not exceed approximately 166'. Also the dock
identified as floating dock "C" was designed without considering the marsh
located at the point. Several slips must be deleted at this point.

Dear Mr. Parker:
Reference the application.of Basin Street Associates,
represented by Mr. George W. Nadeau, for a Department of the Army
permit to maintain a basin, construct docks and construct and
backfill bulkheads on Carolina Beach Yacht Basin to expand marina
facilities, Carolina Beach, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The bulkhead will be positioned at or landward of the mean
high water (MHW) elevation contour. To prevent an unintentional
violation of this authorization, representatives of the North
Carolina Division of Coastal Management And the Corps of Engineers
will be available to stake the alignment prior to construction.
b. All backfill materials will be obtained from an upland
source and confined landward of the permitted bulkhead.
c. In order to protect juvenile shrimp and fin fish
populations, no excavation or filling will be permitted between
the dates of April 1 and September 30 of any year without the
prior approval of the North Carolina Division of Coastal
Management.

d. The diked, excavated material retention area will be
constructed a sufficient distance from the mean high water (MHW)
elevation and any vegetated wetlands to eliminate the possibility
of dike erosion in to or upon any marsh or surrounding waters.
e. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour within adequate dikes or
other retaining structures to prevent spillover of solids into any
vegetated wetlands or surrounding waters.
f. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways
to prevent dike erosion and to allow adequate settlement of
suspended solids.
g. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.
h. Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the mean
low water (MLW) elevation contour to prevent gully erosion and
resultant unnecessary siltation.
i. Vegetated wetlands will not be excavated or filled.
j. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
k. The authorized structure and associated activity will not
cause an unacceptable interference with navigation.
1. This permit does not authorize interference with any
existing or proposed Federal project.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received July 16, 1987, for a
Department of the Army permit to maintain a basin, construct docks
and construct and backfill bulkheads on Carolina Beach Yacht
Basin to expand marina facilities, north of Carolina Beach, New
Hanover County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Harbor Act and Section 404 of the Clean Water Act, has been

Enclosed is the application of Basin Street Associates for a
Department of the Army permit and a State Water Quality
Certification to maintain a basin, construct piers and construct
and backfill bulkheads on Carolina Beach Yacht Basin to expand
marina facilities, Carolina Beach, New Hanover County, North
Carolina. Your receipt of this letter verifies your acceptance of
a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by September 23, 1987, the District
Engineer will deem that waiver has occurred.
