Dear Mr. Toman:
On February 15, 2005, the Division of Water Quality (Division) received a permit application
package from the Town of YanceyvilIe for a new residuals land application program. This package
requested that land owned by Mr. Wayne Hodges be removed from the list of approved land application
sites that may receive residuals under the conditions of this permit and transferred into the Town! of
Yanceyville's residuals land application program. Therefore, we are forwarding herewith- an
administratively amended Attachment B of Permit No. WQ0008195, dated March 11, 2005, to Agri -
South Biosolid Services, Inc. for the subject residuals land application program.
This Attachment B is being administratively amended to remove Site Nos. 1385-06, 1393-06,
1491-01, and 1491-02 from the list of land application sites that are approved to receive residuals under
this residuals land application program. All of the sites are owned by Mr. Hodges, are located in Caswell
County, contain 32.45 acres of application area, and are currently being considered by the Division for
approval under the Town of Yanceyville Residuals Land Application Program (i.e., Application No.
WQ0028547).
Please replace the existing Attachment B of Permit No. WQ0008195 that was previously
certified on March 12, 2003, with this modified Attachment R. This modified Attachment B shall be
effective from the date of certification; shall void Attachment B of Permit No. WQ0008195 that was
previously certified on March 12, 2003; and shall be subject to the conditions and limitations as specified
therein as well as those specified in the above -referenced permit. As always, remember to take the time
to review this modified Attachment B thoroughly, as some of the conditions contained therein may have
been changed since the last certification. Note that this modified Attachment B is hereby incorporated by
reference into Permit No. WQ0008195 issued on March 12, 2003.

If any parts, requirements, and/or limitations contained in this certification or modified
Attachment B are unacceptable, you have the right to request an adjudicatory hearing upon written
request within 60 days following receipt of the certification. This request shall be in the frorn of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings at 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such
demands are made, this Attachment B shall be final and binding.
Please note that Condition VI. 7. requires that the Permittee renew Permit No. WQ0008195
within six months of its expiration date. This permit expired on February 28, 2004, and the Division has
not yet received a permit application package for review. Therefore, it has been detennined that the
Permittee is non -compliant with Permit No. WQ0008195 because a permit renewal has not been
applied for in a timely fashion. To prevent further action, carefully review this violation and respond in
writing within 15 calendar days of receiving this letter. Your response should be sent to the NCDENR-
DWQ, Aquifer Protection Section, Land Application Unit, c/o LAU Residuals Program Coordinator,
1636 Mail Service Center, Raleigh, NC 27699-1636 and should address the cause of your non -compliant
status as well as what actions you plan to rectify this status and to prevent its recurrence.
