The following modifications to the subject permit are as follows: the addition of a two phase 1.0 million gallon (MG) membrane bio-reactor (MBR) wastewater treatment plant, as well as the construction of two high -rate infiltration basins with a gravity groundwater dewatering collection system; the abandonment of existing wastewater irrigation Fields 1 through 9 in order to construct the aforementioned treatment plant and high -rate infiltration facilities, which upon final build out will allow a permitted flow of 1,596,424 gallons per day (GPD) with 1,000,000 GPD being infiltrated in the two new high -rate infiltration basins and 596,424 GPD being irrigated on the remaining wastewater irrigation Fields 10 through 34. This permit shall be effective from the date of issuance until November 30, 2013, shall void Permit No. WQ0005849 issued October 15, 2009, and shall be subject to the conditions and limitations as specified therein,. Please pay particular attention to the monitoring requirements listed in Attachments A, B and C for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information shall result in future compliance problems. Galiarda June 8, 2010 Page 2 of 4 Please note the following permit conditions have been removed since the last permit issuance (Note all cited conditions are from the permit dated October 15, 2009): ➢ Condition 1.7. — This condition was removed because the previously approved modifications to the wastewater treatment plant and high -rate infiltration facilities designed by Burgin Engineering, Inc. have been replaced in favor of the permit modifications herein. Accordingly, the existing 3-cell facultative lagoons shall remain in operation. Please note the following permit conditions and attachments have been modified since the last permit issuance: ➢ Condition III.6. — This condition has been modified to state that the irrigation equipment shall be tested and calibrated at least once per permit cycle. The previous permit required this be done at least once per year. ➢ Condition III.18. — This condition has been modified to state that the tablet chlorination disinfection system for the passive lagoon treatment facility shall use Division approved chlorine tablets. ➢ Attachment A — This attachment has been modified by removing the existing PPI 002 for the treatment and disposal facility designed by Burgin Engineering, Inc., and has had an additional three PPIs added to reflect the proposed modifications. The new PPI 002 reflects the monitoring requirements for the passive lagoon treatment system post construction of Phase I; therefore the flow limit has been reduced to 596,424 GPD for the wastewater irrigation system receiving effluent from the passive lagoon treatment system. The new PPI 003 is for 500,000 GPD from the Phase I construction of the MBR wastewater treatment and high -rate infiltration facilities. Finally, the new PPI 004 is for 1,000,000 GPD from the cumulative Phase I and Phase U construction. ➢ Attachment B — This attachment has been modified to show the new proposed infiltration basins and Fields 1 through 9, which shall be abandoned upon commencing Phase I construction. ➢ Attachment C — This attachment has been modified to include the proposed high -rate infiltration monitoring wells MW-6 and MW-7, as well as have existing monitoring well MW-4 removed from the sampling schedule. Please note monitoring well MW-4 shall not be abandoned at this time. Please note the following permit conditions are new since the last permit issuance: ➢ Condition I.3. — This condition requires that Wilmington Regional Office approve the location of the proposed monitoring wells prior to operation of the high -rate infiltration system and that the Wilmington Regional Office shall be notified at least 48 hours prior to constructing said groundwater monitoring wells. ➢ Condition 1.11. — This condition requires Permittee keep spare mechanical mixers on site for all treatment units not providing dual mixers. ➢ Condition 1.12. — This condition requires that the Permittee perform a survey check of the infiltration basin center berm if determined necessary by the Division. The results of these surveys shall be provided to the Wilmington Regional Office. Mr. Maurice W. Galiarda June S, 2010 Page 3 of 4 ➢ Condition 1V.9. — This condition is included to voice the requirements of General Statute 143-215.1 C., which requires the Permittee to provide to its users and the Division of Water Quality an annual report summarizing the performance of the wastewater treatment and irrigation facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. The report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. ➢ Condition 1V.10. — This condition requires that the Permittee keep a record of all residuals removed from the facility. ➢ Condition IV.11. — This condition requires that the Permittee keep a maintenance log for the existing passive lagoon treatment system and the proposed MBR wastewater treatment system. ➢ Condition IV.13. — This condition requires that the Permittee submit the appropriate GW-1 monitoring well forms upon the initial sampling event of the proposed wells. ➢ Condition VI.8. — This condition notes that this permit is subject to revocation or unilateral modification within 60 days notice from the Division if the terms in 15A NCAC 02T .0110 are violated. ➢ Condition V1.9. — This condition notes that this facilities in this permit may not be expanded if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b). If any parts, requirements or limitations contained in this perrdit are unacceptable, the Permittee has the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail Service Center, Raleigh, NC 27699-6714. ,011 operation of a 1,596,424 gallon per day (GPD) wastewater treatment, high -rate infiltration and wastewater irrigation facility consisting of the construction and operation of a two-phase membrane biological reactor (MBR) treatment system disposing effluent via either the existing permitted spray irrigation fields or via two proposed high -rate infiltration basins each capable of disposing 500,000 GPD, for a Phase I and IT flow of 500,000 GPD and 1,000,000 GPD, respectively, and the continued operation of a three cell facultative lagoon treatment system initially permitted to irrigate 873,500 GPD of effluent on approximately 200 acres of spray irrigation fields, of which 62.44 acres (Fields 1 through 9) shall be abandoned to construct the proposed high -rate infiltration basins, resulting in a net spray irrigation area of 137.58 acres (Fields 10 through 34) capable of receiving 596,424 GPD, for a cumulative post Phase 11 construction build -out capacity of 1,596,424 GPD: continued operation of: a Parshall flume; an ultrasonic flow meter to be replaced with a 12-inch influent magnetic induction type flow meter totalizer; a manually cleaned bar screen; a three -cell facultative lagoon that is approximately 42.2 acres in area and contains approximately 57 million gallons of capacity; a fourth lagoon to store collected groundwater from the gravity fed dewatering system, approximately 9.5 acres in area and containing approximately 22.4 million gallons of storage; a tablet chlorinator; a 139,875 gallon chlorine contact chamber; an irrigation pump station containing duplex 1800 gallon per minute (GPM) pumps and automatic shut-off controls; an effluent flow meter; approximately 137.58 acres of irrigation area (Fields 10 through 34); and all associated piping, valves and appurtenances; the continued operation and subsequent abandonment of: an ultrasonic influent flow meter; approximately 62.44 acres of irrigation (Fields 1 through 9) which shall be abandoned in order to construct and subsequently operate the Phase I and Phase 11 wastewater treatment and high -rate infiltration facilities noted above; and all associated piping, valves and appurtenances; the transfer of following collection system components from permit number WQ0005849 to permit number WQCS00275 under Rule 15A NCAC 02T .0400: approximately 3,200 linear feet of 12-inch gravity sewer; approximately 3,000 linear feet of six-inch force main; approximately 26,730 linear feet of 10-inch force main; approximately 19,100 linear feet of 12-inch force main; a 2,600 GPM duplex pump station with high-water alarms and stand-by power; two 1050 GPM duplex pump stations each with high-water alarms and stand-by power; and all associated piping, valves and appurtenances; the WQ0005849 Version 2.4 Shell Version 100209 Page 1 of 14 Phase I construction and operation of: a flow splitter box with a 3-inch spaced manual bar screen; an influent magnetic induction type flow meter totalizer; a 254,320 gallon aerated flow equalization tank with two 1,200 GPM submersible pumps and two 10 horsepower (hp) floating mechanical aerators; dual 2 millimeter (mm) rotary drum fine screens with auto wash using treated effluent; a 52,229 gallon anaerobic tank with a 2 hp mechanical mixer (a spare 2 hp mechanical mixer shall be kept on site); an alum chemical feed system with two 20 gallon per hour (GPH) chemical feed pumps; a 49,745, gallon pre - anoxic tank with a 1.5 hp mechanical mixer (a spare 1.5 hp mechanical mixer shall be kept on site); two 121,583 gallon pre -aeration tanks with two 300 cubic foot per minute (CFM) blowers, fine bubble diffusers and two 4.6 hp mechanical mixers (a spare 4.6 hp mechanical mixer shall be kept on site); a pre - aeration recirculation wet well with two 2,778 GPM recirculation pumps serving the anaerobic and pre - anoxic tanks; a 70,3?4 gallon post anoxic tank with a 3.6 hp mechanical mixer (a space 3.6 hp mechanical mixer shall be kept on site) and served by a Micro C chemical feed system with two 1.8 GPH chemical feed pumps; two 14,888 gallon membrane bio-reactor (MBR) aeration basins with two membrane cassettes, a 386 GPM permeate pump, fine bubble diffusers, a telescoping valve and a turbidimeter serving the Phase I MBR aeration basin, and three 711 CFM blowers serving both the Phase I and Phase H MBR aeration basins; a recycled activated sludge (RAS) and waste activated sludge (WAS) wet well with two 2,082 GPM recycle/wasting pumps; a 330,616 gallon aerobic digester with 6-inch diameter decanting pipes, coarse bubble diffusers and served by two 1,000 CFM blowers; an ultraviolet (UV) disinfection unit containing one bank of 48 bulbs; a wash water lift station with two 300 GPM submersible pumps and a gravity feed line to the high -rate infiltration basins; an auxiliary generator with an automatic transfer switch; two high -rate infiltration basin effluent flow meters; a refrigerated effluent sampler; a 3.90 acre high -rate infiltration basin (Basin. ##1) with a loading rate of 2.95 gallons per day per square foot (GPD/ft2); a 4.34 acre high -rate infiltration basin (Basin #2) with a loading rate of 2.64 GPD/ft'; a gravity groundwater dewatering collection piping network with a ultrasonic flow meter and drains to a groundwater collection pond that discharges to the headwaters of Mill Creek in the White Oak River Basin via a 500 foot rip rap and ABC stone level spreader; and all associated piping, valves and appurtenances; and the Phase II construction and operation ' of: two membrane cassettes, a 386 GPM permeate pump and a turbidimeter serving the now completed MBR aeration basin constructed in Phase I; an additional bank with 48 bulbs added to the LTV disinfection system constructed in Phase I; a groundwater pumping station wet well with a hydropneumatic tank, two submersible pumps and duplex control panel; and all associated piping, valves and appurtenances; to serve Pluris North Topsail WWTF, with no discharge of wastes to surface waters, pursuant to the application received February 24, 2010, and subsequent additional information received by the Division of Water Quality, and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until November 30, 2013, shall void Permit No. WQ0005849 issued October 15, 2009, and shall be subject to the following specified conditions and limitations: WQ0005849 Version 2.4 Shell Version 100209 Page 2 of 14 I. SCHEDULES In accordance with 15A NCAC 02T .0116, upon completion of construction and prior to operation of this permitted facility, a certification (attached) shall be submitted from a licensed North Carolina Professional Engineer certifying that the permitted facility modifications have been installed in accordance with this permit, Division approved plans and specifications, and other supporting documentation, including the location of all monitoring wells as applicable. If this project is to be completed in phases and partially certified, the Permittee„shall retain the responsibility to track further construction approved under the same permit, and shall provide a final; certificate of completion once the entire project has been, completed, Mail the Certification to the Division of Water Quality, Aquifer Protection Section, 1636 Mail Service Center, Raleigh, NC 27699-1636, 2. The Wilmington Regional Office, telephone number (910) 796-7215, shall be notified at least 48 hours in advance (excluding weekends and holidays) of operation of the installed facility modifications such that an in -place inspection can be made. Notification to the Aquifer Protection Section's regional supervisor shall be made from 8.00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The Wilmington Regional Office, telephone number (910) 796-7215, shall approve monitoring wells MW-6 and MW-7 prior to installation, and the monitoring wells shall be installed prior to beginning high -rate infiltration disposal operations. The regional office shall be notified at least 48 hours prior to the construction of any monitoring well; and such notification to the Aquifer Protection Section's regional supervisor shall be made from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The monitoring wells shall be constructed such that the water level in the well is never above or below the screened (open) portion of the well at any time during the year, and in accordance with 15A NCAC 02C .0108. The general location and name for each monitoring well is marked on Figure 1. 4. Within 60 days of completion of the monitoring wells, the Permittee shall submit two original copies of a site snap with a scale no greater than 1-inch equals 100 feet; however, special provisions may be granted upon prior approval for large properties. At a minimum, the map shall include the following information: a. The location and identity of each monitoring well. b. The location of major components of the waste disposal system. c. The location of property boundaries within 500 feet of the disposal areas. d. The latitude and longitude of the established horizontal control monument. e. The elevation of the top of the well casing (i.e., measuring point) relative to a common datum. f. The depth of water below the measuring point at the time the measuring point is established. g. The location of compliance and review boundaries. h. The date the map is prepared and/or revised. Control monuments shall be installed in such a manner and made of such materials that the monument will not be destroyed due to activities taking place on the property. The map and any supporting documentation shall be sent to the Division of Water Quality, Aquifer Protection Section, 1636 Mail Service Center, Raleigh, NC 27699-1636, 5. If not already installed, gauges to monitor waste levels in Lagoon #1, Lagoon #2 and Lagoon #3 shall be installed within 60 days of permit issuance. A gauge to monitor water levels in Lagoon #4 shall be installed prior to operation of the gravity fed groundwater lowering system.. Gauges to monitor waste levels in Infiltration Basins #1 and #2 shall be installed prior to operation thereof. Caution shall be taken not to damage the integrity of the liner (if present) when installing these gauges. WQ0005849 Version 2.4 Shell Version 100209 Page 3 of 14 No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal application. 7. In accordance with 15A NCAC 02H .0404(e), if the subject wastewater treatment or disposal facilities are in noncompliance with the terms and conditions of this permit, governing statutes or regulations, the subject facilities shall be connected to an operational publicly owned wastewater collection system within 180 days of its availability. Prior to the initiation of these connection activities, appropriate Division approval shall be received. 8. The Permittee shall advise the Wilmington Regional Office's Aquifer Protection Section in writing of any change in the assignments of the designative Pluris North Topsail WWTF manager and alternate manager within 14 days of the change. 9. The Pluris North Topsail WWTF manager shall always be provided with a copy of the most current version of this permit. 10. Upon completion of excavation, the high -rate infiltration basins shall be inspected by a licensed Geologist to verify that the geologic material present will be capable of receiving the wastewater at the permitted loading rates. The results of this inspection and the required verification shall be signed, sealed and submitted to the Aquifer Protection Section, Land Application. Unit, 1636 Mail Service Center, Raleigh, NC 27699-1636. The requested information must be received and acknowledged in writing by the Aquifer Protection Section prior to the operation of the subject facility. 11. In order to comply with the requirement` that all essential treatment units shall be provided in duplicate in accordance with 15A NCAC 02H .0404(g)(3), the Permittee shall maintain onsite: a spare 2 hp mixer for the anaerobic basin; a spare 1.5 hp mixer for the pre -anoxic basin; a spare 4.6 hp mixer for the pre -aeration basin.; and a 3.6 hp mixer for the post -anoxic basin. 12. If Division visual observations determine the center infiltration basin berm is sloughing, the Permittee shall conduct a survey check of the infiltration basin center berm, and shall take corrective measures necessary to maintain a minimum of a 31 foot berm crest elevation. Results of these surveys shall be provided to the Wilmington Regional Office's Aquifer Protection Section within one month of their completion and mailed to: Wilmington Regional Office Aquifer Protection Section 127 Cardinal Drive Extension Wilmington, North Carolina 28405-2845 II. PERFORMANCE STANDARDS 1. The subject non -discharge facilities shall be effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the infiltration or irrigation areas to adequately assimilate the effluent, the Perinittee shall take immediate corrective actions including Division required actions, such as the construction of additional or replacement wastewater treatment or disposal facilities. 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. All wells constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 02C .0 10 8 (Standards of Construction for Wells Other than Water Supply), and any other jurisdictional laws and regulations pertaining to well construction. 4. Effluent limitations shall not exceed those specified in Attachment A. 5. Application rates, whether hydraulic, nutrient or other pollutant, shall not exceed those specified in Attachment B. 6. A usable green area shall be maintained for effluent disposal. The green area shall have the capability of accommodating the facility's average daily flow without exceeding the green area loading rates. As defined in 15A NCAC 02H .0404(g)(7), a "green area" is an area suitable for waste disposal, either in its natural state or which has been modified by planting a vegetative cover of grasses or low growing shrubbery. 7. The compliance boundary for the disposal system shall be specified in accordance with 15A NCAC 02L .0107(b). This disposal system was individually permitted on or after December 30, 1983; therefore, the compliance boundary is established at either 250 feet from the effluent disposal area, or 50 feet within the property boundary, whichever is closest to the effluent disposal area. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A NCAC 02L .0106(d)(2) as well as enforcement actions in accordance with North Carolina General Statute 143-215.6A through 143-215.6C. 8. In accordance with 15A NCAC 02L .0108, the review boundary is established midway between the compliance boundary and the effluent disposal area. Any exceedance of groundwater standards at the review boundary shall require action in accordance with 15A NCAC 02L .0106. 9. The Permittee shall apply for a permit modification to establish a new compliance boundary prior to any sale or transfer of property affecting a compliance boundary. 10. In accordance with 15A NCAC 02L .0107(d), no wells, excluding Division approved monitoring wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L .0107(g). 11. Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the Cinslow County Register of Deeds an easement running with the land containing the following items: a. A notice of the permit and number or other description as allowed in 15A NCAC 02L .0107(f)(1); b. Prohibits construction and operation of water supply wells within the compliance boundary; and c. Reserves the right of the Permittee or the State to enter the property within the compliance boundary for purposes related to the permit. The Director may terminate the easement when its purpose has been fulfilled or is no longer needed. WQ0005849 Version 2.4 Shell Version 100209 Page 5 of 14 12. The facilities permitted herein shall be constructed according to the following setbacks: a. The setbacks for high -rate infiltration sites listed in Attachment B permitted after September 1, 2006 shall be as follows (all distances in feet): i. Any habitable residence or place of public assembly under separate ownership: 400 ii. Any habitable residence or place of public assembly owned by the Permittee: 200 iii. Any private or public water supply source: 100 iv. Non -SA surface waters: 50* v. SA surface waters: 100* vi. Groundwater lowering ditches: 50* vii. Surface water diversions: 50 viii. Any well with exception of monitoring wells: 100 ix. Any property line: 200 x. Top of slope of embankments or cuts of two feet or more in vertical height: 100 xi. Any water line from a disposal system: 10 xii. Subsurface groundwater lowering drainage systems: 50* xiii. Any swimming pool: 100 xiv. Public right of way: 50 xv. Nitrification field: 20 xvi. Any building foundation or basement: 15 xvii. Impounded public water supplies: 500 xviii. Public shallow groundwater supply: 500 * Setbacks to non -SA surface waters, groundwater lowering ditches and subsurface groundwater lowering drainage systems have been reduced to 50 feet, and setbacks to SA surface water have been reduced to 100 feet because the effluent is designed to meet a Total Nitrogen of 4 mg/l and a Total Phosphorus of 2 mg/1 per 15A NCAC 02T .0706(c). b. The setbacks for irrigation sites listed in Attachment B permitted prior to September 1, 2006 shall be as follows (all distances in feet): i. Any habitable residence or place of public assembly under separate ownership: 400 ii. Surface waters: 100 iii. Any well with exception of monitoring wells: 100 iv. Any property line: 150 v. Public right of way: 50 c. The setbacks for proposed treatment units (see permit description) permitted after September 1, 2006 shall be as follows (all distances in feet): i. Any habitable residence or place of public assembly under separate ownership: 100 ii. Any private or public water supply source: 100 iii. Surface waters: 50 iv. Any well with exception of monitoring wells: 100 v. Any property line: 50 d. The setbacks for existing storage and treatment units (see permit description) permitted prior to September 1, 2006 shall be as follows (all distances in feet): i. Any well with exception of monitoring wells: 100 ii. Any property line: 150 WQ0005849 Version 2.4 Shell Version 100209 Page 6 of 14 III. OPERATION AND MAINTENANCE REQUIREMENTS l . The facilities shall be properly maintained and operated at all times. The facilities shall be effectively maintained and operated as a non. -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. The Permittee shall maintain an Operation and Maintenance Plan pursuant to 15A NCAC 02T .0507 and .0707, which at a minimum shall include operational functions, maintenance schedules, safety measures and a spill response plan. 2. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the previously cited rules. A suitable year round vegetative cover shall be maintained at all times, such that crop health is optimized, allows for even distribution of effluent and allows inspection of the irrigation system. Note that such proper maintenance shall also include cover crop harvesting and removal, The crop management plan developed by W.R. Dunlop, Jr., LSS recommending tall fescue as a cover crop for the wetted area of the irrigation facilities shall be followed. Any variation from this plan shall require the recommendation of a North Carolina licensed soil scientist and agronomist, as well as the approval of the Wilmington Regional Office's Aquifer Protection Section, 4. Adequate measures shall be taken to prevent effluent ponding in or runoff from the irrigation sites listed in Attachment B. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause ponding or runoff. 6. All irrigation equipment shall be tested and calibrated at least once per permit cycle. Calibration records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. 7. Only effluent from the Pluris North Topsail WWTF shall be infiltrated or irrigated on the sites listed in Attachment B. 8. An automatically activated standby power source capable of powering all essential treatment units shall be on site and operational at all times. If a generator is employed as an alternate power supply, it shall be tested weekly by interrupting the primary power source. 9. No automobiles or machinery shall be allowed on the infiltration or irrigation sites except during equipment installation or while maintenance is being performed. 10. Public access to the infiltration, irrigation and wastewater treatment facilities shall be prohibited. 11. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan pursuant to 15A NCAC 02T .0508 and .0708. 12. Diversion or bypassing of untreated or partially treated wastewater from the treatment facilities is prohibited. 13. Freeboard in Lagoon #1, Lagoon #2, Lagoon #3, Lagoon #4, Infiltration Basin ##1 and Infiltration Basin. #2 shall not be less than two feet at any time. Gauges to monitor waste levels in Lagoon #1, Lagoon #2, Lagoon #3, Infiltration Basin #1 and Infiltration Basin #2, and a gauge to monitor water levels in Lagoon #4 shall be provided. These gauges shall have readily visible permanent markings indicating the following elevations: maximum liquid level at the top of the temporary liquid storage volume; minimum liquid level at the bottom of the temporary liquid storage volume; and the lowest point on top of the dam. 15. A protective vegetative cover shall be established and maintained on all earthen embankments (i.e., outside toe of embankment to maximum allowable temporary storage elevation on the inside of the embankment), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen embankment areas shall be kept mowed or otherwise controlled and accessible. 16. The infiltration basins shall be periodically dredged to remove deposited materials that may impede the infiltration process. Dredging records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. The Wilmington Regional Office's Aquifer Protection Section, telephone number (910) 796-7215, shall be notified prior to dredging. 17. At a minimum of every 10 years or as needed, the Permittee shall determine whether or not it is necessary to perform deep tillage soil maintenance on the irrigation fields to restore soil percolation capability. 18. The chlorine tablets used in the passive lagoon treatment disinfection facility shall be Division approved, and the kind and type specified in the plans and specifications. IV. MONITORING AND REPORTING REQUIREMENTS 1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sampling reporting schedule shall be followed. 2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for the required effluent, groundwater or surface water parameters. 3. Flow through the passive lagoon treatment facility and the membrane bioreactor facility shall be continuously monitored, and daily flow values shall be reported on Form NDMR, The Permittee shall install and maintain appropriate flow measurement devices to ensure the accuracy and reliability of flow measurement consistent with accepted engineering and scientific practices. Selected flow measurement devices shall be capable of measuring flows with a maximum deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year; and maintained to ensure the accuracy of measurements is consistent with the selected device's accepted capability. The Permittee shall maintain records of flow measurement device calibration on file for a period of at least five years. At a minimum, documentation shall include: a. Date of flow measurement device calibration, b. Name of person performing calibration, and c. Percent from true flow. 4. The Permittee shall monitor the passive lagoon treatment plant effluent, membrane bioreactor treatment plant effluent, groundwater lowering effluent and the surface water testing station at the frequencies and locations for the parameters specified in Attachment A. WQ0005849 Version 2.4 Shell Version 100209 Page 8 of 14 5. The Permittee shall maintain adequate records tracking the amount of effluent irrigated. At a minimum, these records shall include the following information for each irrigation site listed in Attachment B: a. Date of irrigation; b. Volume of effluent irrigated; c. Site irrigated; d. Length of time site is irrigated; e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings; f. Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically limited in Attachment B; g. Weather conditions; and h. Maintenance of cover crops. The Perzaaittee shall maintain adequate records tracking the amount of effluent infiltrated. At a minimum, these records shall include the following information for each infiltration site listed in Attachment B: a. Date of infiltration; b. Volume of effluent infiltrated; c. Site infiltrated; d. Loading rates to each infiltration site listed in Attachment B; and e. Weather conditions. 7. Freeboard (i.e., waste level to the lowest embankment elevation) in Lagoon #1, Lagoon #2, Lagoon #3, Lagoon #4, Infiltration Basin #1 and infiltration Basin 42 shall be recorded weekly. Weekly freeboard records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. Three copies of all monitoring data (as specified in Conditions IV.3. and IV.4.) on Form NDMR for each PP1, three copies of all operation and irrigation records (as specified in Conditions IV.5. and IV.7.) on Form NDAR-1, and three copies of all operation and infiltration records (as specified in Conditions IV.6. and IV.7.) on Form. NDAR-2 for every site in Attachment B shall be submitted on or before the last day of the following month. If no activities occurred during the monitoring month, monitoring reports are still required documenting the absence of the activity. Pursuant to § 143-215.1 C., the Permittee shall provide to its users and the Division of Water Quality an annual report summarizing the performance of the wastewater treatment, infiltration and irrigation facilities and the extent to which the facilities have violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. This report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. A record shall be maintained of all residuals removed from this facility. This record shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this record shall include: a. Name of the residuals hauler; b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals; c. Date the residuals were hauled; and d. Volume of residuals removed. 11. A maintenance log shall be maintained at this facility. This log shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this log shall include: a. Date and results of power interruption testing on alternate power supply; b. Date of calibration of flow measurement device; c. Visual observations of the plant and plant site; and d. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections and cleanings, etc.). 12. Monitoring wells shall be sampled after construction and within 3 months prior to initiating non - discharge disposal operations. Monitoring wells shall be sampled thereafter at the frequencies and for the parameters specified in Attachment C. All mapping, well construction forms well abandonment forms and monitoring data shall refer_ to the permit number and the well nomenclature as provided in Attachment C and Fi e 1. 13. For initial sampling of monitoring wells, the Permittee shall submit a Compliance Monitoring Form (GW-59) and a Well Construction Record Form (GW-1) listing this permit number and the appropriate monitoring well identification number. initial Compliance Monitoring Forms (GW-59) without copies of the Well Construction Record Forms (GW-1) are deemed incomplete, and may be returned to the Permittee without being processed. 14. Two copies of the monitoring well sampling and analysis results shall be submitted on a Compliance Monitoring Form (GW-59), along with attached copies of laboratory analyses, on or before the last working day of the month following the sampling month. The Compliance Monitoring Form (GW- 59) shall include this permit number, the appropriate well identification number, and one GW-59a certification form shall be submitted with each set of sampling results. An annual representative soils analysis (i.e., Standard Soil Fertility Analysis) shall be conducted on each irrigation site listed in Attachment B. An annual plant tissue analysis shall be conducted on each irrigation site listed in Attachment B. These results shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. 17. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than 24 hours, or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the facility resulting in the treatment of significant amounts of wastes that is abnormal in quantity or characteristic, including the known passage of a hazardous substance, b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons, rendering the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a by-pass directly to receiving surface waters. d. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations. e. Ponding in or runoff from the irrigation sites. f. Effluent breakout from the infiltration basins. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to be taken to ensure the problem does not recur. V. INSPECTIONS 1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the wastewater treatment and disposal facilities. The Permittee or their designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater treatment and disposal facilities permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit, and may collect groundwater, surface water or leachate samples. VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. This permit shall become voidable if the permitted facilities are not constructed in accordance with the conditions of this permit, the Division approved plans and specifications, and other supporting documentation. 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application, Division approved plans and specifications, and other supporting documentation, No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T .0105(n). 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. 5. In the event the permitted facilities change ownership or the Permittee changes their name, a formal permit modification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate property ownership documentation and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the facilities permitted herein until a permit is issued to the new owner. 6. The Permitted shall retain a set of Division approved plans and specifications for the life of the facilities permitted herein. 7. The Permitted shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .01050). S. This permit is subject to revocation or unilateral modification upon 60 days notice from the Division Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. 9. Unless the Division Director grants a variance, expansion of the permitted facilities contained herein shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b), 10. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to pay the annual fee accordingly shall be cause for the Division to revoke this permit pursuant to 15A NCAC 02T .0105(e)(3).
