Permit No. WQ0005381 EMC Corporation Wastewater Spray Irrigation Facility Wake County Dear Mr. Fitzgerald: In accordance with your renewal request received July 26, 2001, we are forwarding herewith Permit No. W00005381, dated March 11, 2002, to EMC Corporation for the continued operation of the subject wastewater treatment and spray irrigation facilities. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. Though the existing spray fields are currently dormant, this permit renewal is being issued so that the Permittee may proceed with the satisfactory closure of the lagoon and spray field, properly dispose of residual solids, abandon and salvage the wastewater collection, treatment and disposal facilities, and reclamation of the spray field site in concurrence with their connection to the Town of Apex's sanitary sewer system. Upon completion of the above, the Permittee shall make request to the Division of Water Quality to rescind this permit. Please read your permit carefull . Several permit conditions have been modified and/or excluded since the last issuance of the permit. Previous Permit Conditions 1.4, 11.2, 111.2 - 111.7, and VIA have been removed from the permit as requested. These conditions are no longer applicable upon EMC Corporation's connection to the Town of Apex's sewer system. Additionally, please note Permit Conditions IVA - IV.4 as they relate to the satisfactory closure of the lagoon and spray field, and proper disposal of the residuals. This permit shall be effective from the date of issuance until. February 28, 2007, shall void Permit No. WQ0005381 issued June 2, 2000, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. Thorpe, Ph.D. cc: Wake County Health Department Raleigh Regional Office, Water Quality Section Raleigh Regional Office, Groundwater Section Groundwater Section, Central Office Technical Assistance and Certification Unit Non -Discharge Compliance/Enforcement Unit Central Files NDPU Files Permit No. W00005381 March 11, 2002 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH SPRAY IRRIGATION SYSTEM PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO EMC Corporation Wake County FOR THE continued operation of a 7,500 -gallon per day spray irrigation treatment and disposal facility consisting of a 30,000 -gallon per day wastewater treatment facility, a 44,160 cubic foot storage lagoon, a pump station, three (3) acres of spray irrigation field with 41 sprinklers, approximately 300 linear feet of 6 -inch effluent sewer, and all associated valves, piping, and appurtenances to serve the EMC Corporation, with no discharge of wastes to the surface waters, pursuant to the request received July 26, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until February 28, 2007, shall void Permit No. WQ0005381 issued June 2, 2000, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS The spray irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 2. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 3. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. Permit No. W00005381 March 11, 2002 4. The following buffers shall be maintained: a) 400 feet between wetted area and any residence or places of public assembly und', separate ownership, b) 150 feet between wetted area and property lines, c) 100 feet between wetted area and wells, d) 100 feet between wetted area and drainageways or surface water bodies, e) 50 feet between wetted area and public right of ways, f) 100 feet between wastewater treatment units and wells, and g) 50 feet between wastewater treatment units and properly lines. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications, which are required by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities which are for the purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the spray irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification. 5. This permit shall become voidable if the soils fail to adequately assimilate the wastes and may be rescinded unless the sites are maintained and operated in a manner which will protect the assigned water quality standards of the surface waters and ground waters. 11. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. A suitable year round vegetative cover shall be maintained. I Wastewater shall not be applied in inclement weather or until 24 hours following a rainfall event of 112 -inch or greater in 24 hours. Any residuals disposal measures must first be approved by the Division of Water Quality. 4. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 5. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 6. The application rate shall not exceed a cumulative loading of 45.0 inches over any twelve (12) month period at an instantaneous application rate that does not cause runoff. 7. No type of wastewater or residual solids other than that from EMC Corporation shall be sprayed onto the irrigation area. 8. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 9. Public access to the land application sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. 10. Freeboard in the storage lagoons shall not be less than two feet at any time. 2 Permit No. W00005381 March 11. 2002 11. Adequate provisions shall be taken to prevent wind erosion and surface runoff from conveying pollutants from the spray irrigation area onto the adjacent property or into any surface waters. 12. Wastewater and residuals shall not be applied to any land applicationsite that is flooded, frozen or snow-covered. III. MONITORING AND REPORTING REQUIREMENTS Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 571-4700, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of a failure of a pumping station, sewer extension, or treatment facility resulting in a bypass to receiving waters. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Closure of the lagoon and spray field: a. Within sixty (60) days of permit issuance, the Permittee shall provide, in writing to the Raleigh Regional Office, the methods they intend to utilize for proper disposal of the residuals. This notification shall include an acceptable timetable for accomplishing residuals removalidisposal, the abandonment and salvage of the wastewater collection, treatment, and disposal facilities, and the reclamation of the spray field site. If upon proper analysis (see Sampling Criteria), the samples show TCL.P concentrations below TCI_P regulatory limits and below Groundwater 2L_ Standards, then the residuals may be left in place. If the residuals are to be left in place, then the lagoon shall be filled in, and the area shall be graded in such a manner that allows the old lagoon area to shed stormwater. A vegetative cover shall also be established over this area. C. All residuals shall be removed from the lagoon and properly disposed of if the lagoon is to remain open and not be filled. d. If the residuals are to be excavated and land application of the residuals is the desired method of disposal, the Permittee shall obtain a permit from the Division of Water Quality prior to beginning disposal operations. Permit No. W00005381 March 11, 2002 e. Once it is determined whether the residuals can remain in place or if they will be excavated from the lagoon, the following steps shall be followed: i. Remove all water from lagoon, J. Remove all inflow piping, etc. to the lagoon, iii. If the liner (clay or synthetic) is being left in place, it must be breached or ripped up to allow water to infiltrate past the liner. iv. Remove the earthen berms and grade the area to match the surrounding topography in order to prevent water from accumulating and ponding. V. Remove all piping and spray nozzles from the spray field. vi. Add and maintain a vegetative cover to prevent soil erosion. Any land -disturbing activity associated with the above procedures that affect more than one (1) acre of land must have an erosion and sedimentation control plan approved by the Land Quality Section of the Division of Land Resources. NC General Statute 113A- 57(4) requires this plan to be submitted at least thirty (30) days prior to beginning the land -disturbing activity. 2. Sampling Criteria: a. Remaining sludge shall be sampled in three locations (on each end and in the center). b. The following analytical procedures shall be performed on each sample: Toxicity Characteristic Leaching Procedure (TCLP) SW -846 EPA Method 1311 for volatiles, semi -volatiles, and metals, ii. Ignitability SW -846 EPA Method 1010 or 1020, iii. Reactivity EPA OSW, and iv. Corrosivity EPA Method 9045. C. Any laboratory selected to analyze the parameters must be DWQ certified for those parameters required. 3. Reporting 1 Documentation: Within sixty (60) days of completion of the closure of the lagoon, a Professional Engineer or Professional Geologist shall certify that the lagoon and spray fields are closed out according to the specification stated above. A written and sealed report shall be mailed to the following address: Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh, NC 27699-1636 4. Applicable Boundaries: a. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for the disposal system individually permitted after December 31, 1983 is established at either 25r feet from the waste disposal area, or 50 feet within the property boundary, whichever closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action according to 15A NCAC 2L.01 06(d)(2). 4 Permit No. WQ00053BI March 11, 2002 b. The REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require action in accordance with 15A NCAC 2L .0106(d)(1). c. Once closure procedures of the lagoon and spray field commence at the facility, the Compliance and Review Boundary shall become void and 2L Groundwater Standards apply at the previous active disposal areas (lagoon and spray field). 5. Additional Requirements: Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3.- Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 5. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. Permit No. W00005381 March 11, 2002 6. The annual administering and compliance fee must be paid by the Permittee Within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 7. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations, as it may deem appropriate.
