Dear Mr. Frey:
In accordance with your application received in the Division Central Office on August 1, 2000, we are forwarding
herewith Permit No. WQ0005276, dated September 27, 2000, to Frall Developers, Inc. for the operation of the subject
wastewater pump and haul activities.
This permit shall be effective from the date of issuance until March 27, 2001 and shall void Permit No. WQ0005276
issued October 27, 1999, and shall be subject to the conditions and limitations as specified therein. Please pap particular
attention to the monitoring requirements and Sections I.1 to 1.3 in this permit.
Condition 1.3 states that "any failure to comply with the schedule contained in 1.1 and 1.2 will (result in an
enforcement recommendation that could result in civil penalties, regardless of the life of this permit."
Failure to establish an adequate system for collecting and maintaining the required operational information will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina, 27699-6714. Unless such demands are made,
this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and
other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

operation of a 260 GPD wastewater pump and haul facility to serve the United States Post Office in Linwood,
North Carolina, with no discharge of wastes to the surface waters, pursuant to the application received August 1,
2000, and in conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until March 27, 2001 and shall void Permit No.
WQ0005276 issued October 27, 1999, and shall be subject to the following specified conditions and limitations:
This permit shall become voidable unless the subject pump and haul activities are carried out in a manner that
has been approved by this Division.
1.1 This pump and haul permit is issued based on the following schedule to construct a permanent
wastewater collection system to connect to the City of Lexington sewer system. The construction
should be according to the following schedule:
New Pump Station and Collection System Permit Issued: May 5, 2000 (Permit WQ0018084)
Construction Beginning Date: August 3, 2000 (actual start on August 1)
Construction Ending Date: December 1, 2000
Post Office Connection to System: December 31, 2000
1.2 Monthly progress reports must be submitted to the Winston-Salem Regional Office, which outlines the
progress on the construction of the new pump station and collection system referenced above. Reports
should be submitted along with the other operational monitoring requirements stated under Item 14 by
the fifteenth (15"') day of the following month. The first submittal must include all progress reports
from the contractor submitted to date.
1.3 Any failure to comply with the schedule contained in 1.1 and 1.2 wilI result in an enforcement
recommendation that could result in civil penalties, regardless of the life of this permit.
2. This permit is effective only with respect to the nature and volume of wastes described in the application and
other supporting data.
The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
(Division) accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
5. No type of domestic wastewater other than that from the United States Post Office in Linwood, North Carolina
shall be included in the pump and haul activities.
6. This permit shall become voidable unless the agreement between Frall Developers, Inc., McMahan Septic
Service and the City of Lexington for the 'collection, transportation, and ultimate disposal of the domestic
wastewater is in full force and effect.
7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall cease operation of all pump and haul activities and take immediate corrective actions, including
those that may be required by this Division.
This pump and haul permit shall not be renewed.
9. The sewage and wastewater collected by this system shall be treated in the Lexington Wastewater Treatment
Facility prior to being discharged into the receiving stream.
10. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations.
11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation
of the subject facilities.
12. The Permittee or his designee shall inspect the pump and haul collection system to prevent malfunctions and
deterioration, operator errors and discharges which may cause or lead to the release of wastes to the
environment, a threat to human health, or a nuisance. The Perm:ittee shall maintain an inspection Iog or
summary including at least the date and time of inspection, observations made, and any maintenance, repairs,
or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for
as long as the pump and haul activities are being conducted and shall be made available to the Division or
other permitting authority, upon request.
13. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials,
enter and inspect any property, premises or place on or related to the pump and haul collection system at any
reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records
that must be maintained under the terms and conditions of this permit, and may obtain samples.
14. An accurate record of the pump and haul and pump station/collection system construction activities must be
maintained by the Permittee, indicating:
a. date wastewater is removed from the facility,
b. name of facility from which wastewater is removed,
c. name of facility receiving wastewater,
d. volume of wastewater removed, and
e. status of permanent disposal option as stated in Section 1.2.
These records shall be submitted monthly to the Winston-Salem Regional Office on or before the fifteenth
(15) day of the following month.
16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.

17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and -federal)
which have jurisdiction.
18. The Permittee shall provide for the installation and maintenance of an audible and visual high-water alarm on
all storage and pumping facilities associated with this pump and haul operation.
19. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the
project.
20. Noncompliance Notification:
The Permittee shall report by telephone to the Winston-Salem Regional Office, telephone number (336) 771-
4600, as soon as possible, but in no case more than 24 hours or on the next working day following the
occurrence or first knowledge of the occurrence of any of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate
wastewater collection and storage, or
b. Any failure of the pump and haul process which results in a discharge of raw waste and/or
wastewater reaching waters of the State.
Persons reporting such occurrences by telephone shall also file a. written report in letter form within five (5)
days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be
taken to ensure that the problem does not recur.
Permit issued this the 27`h day of September, 2000.
