The Division must take action to resolve this permit renewal request. As a review of this renewal Project the following is a brief summation of events: July 2, 1991 - The Division Winston-Salem Regional Office reports strong concerns and potential problems with the current permitted method of driving over the disposal fields spilling the wastewater out of the rear of the truck via a pipe. Sept. 12, 1991 - Additional information is requested for the Division's Groundwater Section and is received October 10, 1991. Dec. 19, 1991 - The Division's Groundwater Section reports problems with the disposal site soils, a number of complaints about runoff from the disposal site by adjacent landowners, and recommends an alternative disposal method be found within a year. Oct. 16, 1992 - A strong request and warning letter is sent asking for the February 14, 1992, request for the alternative analysis. Nov. 23, 1992 - The requested alternative analysis is provided from the consulting engineers Marziano & Minier, P.A., which shows the current disposal method as the most cost effective and possible alternative. Nov. 30, 1992 - The Division's Groundwater Section makes a second staff report that still disagrees with the current method of wastewater disposal. And a December 3, 1992, letter is sent requesting additional information on the soils to make a more in depth evaluation to see if this method is doing harm to the site. March 23, 1993 - No requested information is received by the return date of February 1, 1993, but extra time is granted on February 12, 1993. During this time, a running series of phone calls explore several options, and a March 9, 1993, call from Mandano & Minier, P.A. indicates that the permittee is trying to get a subsurface disposal permit for the current disposal site from the County Health Department. April 2, 1993 - A final additional information request letter was sent, reviewing the past events and requesting the missing information or acceptable alternative proposals to resolve the concerns the Division is having for the disposal method being used. This letter requires the requested information within 30 days of receipt. Current environmental laws and regulations require the Division ensure that the treatment and disposal method being used is not adversely impacting the disposal field. Even though this treatment and disposal system was permitted and then renewed in the past, it does not appear this system can conform to current regulations. Additionally, there have been past violations and complaints concerning wastewater runoff and possible field damage. In a Ietter dated April 2, 1993, you were asked, by Mr. Steve Tedder, Chief of the Division of Environmental Management's Water Quality Section, to provide additional information (copy of letter attached). As of today, this information has not been received, therefore, the Division must return your application and support documents as incomplete in accordance with North Carolina General Statute 143- 215.1. Please be advised that the existing subject permit has expired. The Welcome Washerette wastewater treatment and disposal facilities no longer have a valid permit, upon return of this application for permit renewal. Please be advised that the operation of the subject wastewater treatment and disposal facilities without a valid permit is a violation of North Carolina General Statute 143-215.1 and may subject Welcome Car Wash & Washerette to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6. Civil penalties of up to $10,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute 143-215.1. The Division will reconsider permitting the Welcome Washerette wastewater disposal system once the essential information is made available. When you have obtained the requested information which is needed to make your application complete, you may submit a new application package and permit processing fee. However, please be advised the request for a permit for facilities to serve this site must include plans and specifications for construction of facilities that are approvable under current requirements and regulations. Attached for your information is a copy of the nondischarge regulations with which this operation must comply in order to be permitted..
