This permit shall be effective from the date of issuance until December 31, 2002; shall void Permit No. WQ0003698, issued October 6, 1993; and shall be subject to the conditions and limitations as specified therein. The City of Marion and the Division of Water Quality (Division) has agreed to approve the continued operation of the surface disposal unit for another two years. During this period of time, the City of Marion will be phasing -out use of the surface disposal unit and implementing a program for a more sustainable and beneficial alternative for residuals management. Some significant modifications have been made to the conditions of this permit; therefore, please take time to review this permit thoroughly. Of special interest are the following amended provisions: ♦ Condition I. 1.: This condition specifies the list of action items and associated schedule for completion to facilitate the phase-out of the surface disposal unit operation and implementation of the alternate residuals management program. A requirement for the submission of quarterly progress reports has also been stipulated. ♦ Condition I. 2.: This condition stipulates that the Permittee may dispose of residuals in Pit No. 10 and Pit No. 11 only. The Division will not entertain requests from the City of Marion to construct additional pits at this surface disposal site. ♦ Condition 1. 3.: This condition requires that proposed Pit No. 11 be constructed with a liner, as is required by 15A NCAC 2H .0219(f). A North Carolina-Iicensed Soil Scientist must certify that the installed liner meets this regulation. ♦ Condition I. 4.: This condition requires that the Asheville Regional Office be contacted in advance of operation of Pit No. 11, so that an in-place inspection of the installation may be completed. ♦ Condition I. 5.: This condition specifically forbids the placement of residuals into the surface disposal unit after the issuance of the Land Application of Residual Solids (LARS) permit or January 1, 2002, whichever comes first. 1617 Mail Service Center. All residual disposal activities are initiated from the Corpening Creek Wastewater Treatment Plant. ♦ Condition I1. 4.: This condition has been amended to reflect the adoption of new rules by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The referenced regulation is now 15A NCAC 8G .0202. ♦ Condition II. 8.: A provision has been added to this condition that requires that a collection system be installed if surface runoff from the surface disposal unit cannot be prevented. The collection system must be sized to accommodate a 24-hour, 25 -year storm event. Collected runoff may be disposed only in a manner approved by the Division. Condition III. 6.: This condition has been amended to require that data from the continuous methane gas monitoring be submitted with other required reporting items once per year. In addition, this amended condition reflects the new mailing address to be used when submitting all monitoring and reporting information. t Condition III. 7.: This condition has been amended to reduce the time period for submitting a written report about a noncompliance occurrence from 15 days to five days. In addition, note that the Asheville Regional Office's area code has changed from 704 to 828. ♦ Condition IV. 1. through Condition N. 6.: These conditions require the installation of a new groundwater monitoring well as well as provide detail about certification, mapping, and initial sampling. ♦ Condition VI. 7.: This condition has been amended to remind the Permittee that an application for permit renewal and modification must be submitted to the Division no later than January 1, 2002. This condition must be adhered to even if the surface disposal unit is not to receive any additional residuals after expiration of this permit, as the Division may choose to keep this permit active for the purpose of continuing groundwater monitoring only. Please note the specific items that must be included with the request for permit renewal and modification. Please pay particular attention to the monitoring and reporting requirements contained in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. The Division has noted that the City of Marion appears not to have adequate storage for residuals outside of treatment units (e.g., aeration basins, clarifiers, thickeners, etc.). Part of the review of the application package for the Land Application of Residuals Solids (LARS) permit to be prepared and submitted in accordance with Condition 1. 1. will be an analysis of the efficiency and effectiveness of the City of Marion's residuals management program to remove solids from the wastewater treatment system; treat the residuals in accordance with pathogen reduction, vector attraction reduction, and other requirements contained in 40 CFR Part 503; and Iand apply the residuals only when appropriate from an agronomic and meteorological point of view. Therefore, residuals treatment and storage are essential parts of the overall residuals management plan, and the LABS permit application package should address these items accordingly. Note that the Division may choose to implement a compliance schedule into the LARS permit for the permitting and construction of new residuals treatment and storage equipment. 2 If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of North Carolina General Statutes. and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC, 27699-6714. Unless such demands are made, this permit shall be final and binding. Stevens cc: McDowell County Health Department Asheville Regional Office, Water Quality Section Asheville Regional Office, Groundwater Section Groundwater Section, Central Office Technical Assistance and Certification Unit Non -Discharge CompIiance/Enforcement Unit 3 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH SURFACE DISPOSAL UNIT PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO City of Marion McDowell County FOR THE continued operation of a surface disposal unit for the disposal of up to 280 dry tons per year wastewater residuals from the source listed in Condition H. 2. The surface disposal unit shall be operated such that there is no discharge of wastes to the surface waters pursuant to the application received on February 3, 2000 as well as the additional information received on May 22, 2000; September 5, 2000; and November 20, 2000 and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 31, 2002; shall void Permit No. WQ0003698, issued October 6,1995; and shall be subject to the following specified conditions and limitations: 1. PERFORMANCE STANDARDS The Permittee has agreed to begin phasing -out the operation of this surface disposal unit in favor of a sustainable, long-term residuals management alternative. In order to ensure that this phase-out proceeds as planned and in as timely a fashion as possible, the Permittee shall perform the following action items in accordance with the prescribed schedule: Date of Action Items Completion April 1, 2001 ♦ Submit completed application package to the Division of Water Quality (Division) for issuance of a Land Application of Residuals Solids (LARS) permit. January 1, 2002 + Secure issuance of LARS permit from the Division. ♦ Begin implementation of LARS program. ♦ Submit renewal/modification request for the surface disposal unit operation to the Division (i.e., see the re uirements of Condition VI. T) NO RESIDUALS MAY BE DISPOSED IN SURFACE DISPOSAL UNIT AFTER THIS DATE! September 1, 2002 ♦ Secure issuance of renewed/modified permit for the surface disposal unit operation from the Division. ♦ Begin implementation of surface disposal unit closure plan. Date of Action items Completion December 1, 2002 ♦ Complete closure of surface disposal unit. ♦ Begin implementation of post -closure management plan for surface disposal unit operation. To demonstrate compliance with the requirements of this condition, the Permittee shall submit quarterly reports to both the Asheville Regional Office and the Non -Discharge Permitting Unit that detail the Permittee's actions to date. These reports shall be submitted no later than the last day of every March, June, September, and December until all action items have been satisfactorily completed. Note that failure on the part of the Permittee to maintain compliance with the above action list and schedule may subject the Permittee to potential enforcement action as prescribed for in Condition VI. 4. One copy of the quarterly report shall be sent each to NCDENR-DWQ, Water Quality Section, Non - Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617 and NCDENR-DWQ, Asheville Regional Office -Water Quality Section, 59 Woodfin Place, Asheville, NC 28801, 2. The Permittee shall only use Pit No. 10 (i.e., the pit that is active as of the date of this permit's issuance) and proposed Pit No. 11 for the duration of this permit cycle. Additional pit construction at this surface disposal site, with or without written approval from the Division, shall be expressly forbidden. Pit No. 11 shall be constructed with a liner of natural material at least one foot in thickness and having a hydraulic conductivity of no greater that I x 10-6 centimeters per second when compacted. In lieu of using a liner of natural material, the Permittee may substitute a synthetic liner, provided that it has sufficient thickness to exhibit structural integrity and an effective hydraulic conductivity no greater than that of the natural material liner as required by 15A NCAC 2H .0219(f). Upon completion of construction and prior to operation of Pit No. 11, certifications shall be received from a North - Carolina -licensed Soil Scientist that certifies that the liner installed in the pit meets or exceeds these criteria. One copy of the quarterly report shall be sent each to NCDENR-DWQ, Water Quality Section, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617 and NCDENR- DWQ, Groundwater Section, Permits and Compliance Unit. 1636 Mail Service Center, Raleigh, 27699- 1636. 4. The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours in advance of operation of Pit No. 11, so that an in-place inspection of Pit No. I1 can be made. Such notification to the Regional Water Quality Supervisor shall be made during normal office hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays. 5. No residuals shall be disposed in the surface disposal unit after the LARS permit issued by the Division to the City of Marson has been issued or January 1, 2002, whichever comes first. This condition shall be adhered to regardless of the fact that this permit shall not expire until November 30, 2002. This extended expiration date is simply an administrative measure to maintain the active status of this permit until such time that the Division can issue a renewed and modified permit. This renewed and modified permit will confirm the inactive status of the surface disposal unit and contain conditions specific to closure and post -closure management of the surface disposal unit. 6. The surface disposal unit shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastes resulting from the operation of this program 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or ground water resulting from the operation of this surface disposal unit. 2 8. In the event that the surface disposal unit is not operated satisfactorily, including the creation of nuisance conditions, the Permittee shall cease disposing of the residuals to the surface disposal unit, contact the Asheville Regional Office, and take any immediate corrective actions as may be required by the Division. 9. The following buffer zones shall be maintained: a. 400 feet between an active surface disposal unit and any habitable residence, b. 100 feet between an active surface disposal unit and any public or private water supply source, all streams classified as WS or B, waters classified as SA or SB and any Class I or Class E impounded reservoir used as a source of drinking water, c. 100 feet between an active surface disposal unit and any stream, lake, river, or natural drainage way, d. 50 feet between an active surface disposal unit and property lines (if the original permit was issued with the buffer distance to property line as 100 feet, updated maps must be submitted and new acreage delineated for the buffer to be reduced), e. 10 feet between an active surface disposal unit and any interceptor drains or surface water diversions (upslope), 25 feet between an active surface disposal unit and any interceptor drains or surface water diversions (downslope), g. 25 feet between an active surface disposal unit and any groundwater lowering and surface drainage ditches. Some of the buffers specified above may not have been included in previous permits for this surface disposal unit. These buffers are not intended to prohibit or prevent modifications that are required by the Division to improve performance of the existing surface disposal unit. These buffers do, howeve apply to modifications of the surface disposal unit. These buffers do also apply to any expansion or modification of the surface disposal unit and apply in instances in which the sale of property would cause any of the buffers now complied with, for the surface disposal unit, to be violated. The Pertnittee is advised that any modifications to the existing surface disposal unit will require a permit modification. 10. A copy of this pezmit shall be maintained at the surface disposal unit site when residuals are being disposed during the life of this permit. A spill prevention and control plan shall be maintained in all residuals transport and application vehicles. 11. Residuals placed in the subject surface disposal unit shall be covered with soil or other material at the end of each operating day. 11. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities and the surface disposal unit shall be properly maintained and operated at all times. 3 2. No residuals other than the following shall be approved for disposal in the surface disposal unit in accordance with this permit: Source County Permit Number Volume City of Marion McDowell NPDES Permit No. NC0031879 280 dry tons per year Corpening Creek Wastewater Treatment Plant City of Marion McDowell NPDES Permit No. NC0071200 Included above' Catawba River Wastewater Treatment Plant- a The residuals generated by the City of Marion's Catawba River Wastewater Treatment Plant shall be introduced to the headworks of the City's Corpening Creek Wastewater Treatment Plant. No deviation from this operational plan shall be allowed until a written request has first been submitted to and approved by the Division. 3. The pollutant concentrations in the residuals that will be disposed in a surface disposal unit shall not exceed the following Ceiling Concentrations (i.e., dry weight basis): Concentration Parameter (milligrams per kilogram Arsenic 46 Chromium 300 Nickel 320 4. Upon classification of the facility by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge (ORC) of the surface disposal unit. The operator shall hold a certificate of the type classification assigned to the surface disposal unit by the WPCSOCC. The Permittee shall also employ a certified back-up operator of the appropriate type to comply with the conditions of 15A NCAC 8G.0202. The active surface disposal unit shall not restrict the flow of a base flood. The active surface disposal unit shall not be located in an unstable area. 7. Appropriate measures shall be taken to control public access to the surface disposal unit during active use and for the 36 -month period following closure of the surface disposal unit_ Such controls may include fencing and the posting of signs indicating the activities being conducted at each site. 8. Adequate provisions shall be taken to prevent any surface runoff from occurring from any active surface disposal unit. If runoff cannot be prevented, a collection system shall be installed with the capacity to handle runoff from a 24-hour, 25 -year storm event. All collected runoff shall be disposed in a :Wanner approved by the Division. 12. Adequate provisions shall be taken to prevent wind erosion from conveying pollutants or residuals from the surface disposal unit onto the adjacent property or into any surface waters. 13. Residuals shall not be applied to any area that is flooded, frozen, or snow-covered. 14. Food crops, feed crops, and/or fiber crops shall not be grown on an active surface disposal unit, unless approval has been requested and received from the Division. 15. Animals shall not be grazed on an active surface disposal unit, unless approval has been requested and received froze. the Division. I11. 11IONITORING AND REPORTING REQUIREMENTS Any monitoring (i.e., including groundwater, surface water, residuals, soil, or plant tissue analyses) deemed necessary by the Division to insure protection of the environment shall be established and an acceptable sampling and reporting schedule shall be followed. 2. Proper records shall be maintained by the Permittee tracking all disposal activities. All records shall be kept by the Permittee for a minimum period of five years from the date of disposal. These records shall include, but shall not necessarily be limited to the following information: a. Source of residuals. b. Volume of residuals disposed in gallons per year, dry tons per year, or kilograms per year. 3. A residuals analysis shall be conducted annually from the date of permit issuance by the Permittee, and the results shall be maintained on file by the Permittee for a minimum of five years. If disposal events occur at a frequency less than annually, a residuals analysis shall be required for each disposal event. The residuals analysis shall include but is not necessarily limited to the following parameters: Arsenic Nickel pH Chromium Percent Total Solids 4. A Toxicity Characteristics Leaching Procedure (TCLP) analysis shall be conducted by the Permittee annually. The following criteria shall be me: a. In structures, the concentration of methane gas in the air shall not exceed 25 percent of the lower explosive limit (LEL). b. At the property line, the concentration of methane gas in the air shall not exceed the LEL for methane gas. 6. Three copies of all required monitoring and reporting requirements as specified in Condition III. 1., Condition III. 2., Condition III. 3., Condition M. 4., and Condition III. 5. shall be submitted annually on or before March Ist of the year following the disposal event to the following address: NCDENR-DWQ Water Quality Section Non -Discharge Compliance/Enforcement Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 7. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 251- 6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence with surface disposal activities that results in the disposal of significant amounts of wastes that are abnormal in quantity or characteristic. b. Any failure of the surface disposal activities resulting in a release of material to receiving waters. c. Any time that self-monitoring information indicates that the surface disposal unit has gone out of compliance with the conditions and limitations of this permit or the parameters on which the system was designed. d. Any process unit failure, due to known or unknown reasons, that renders the surface disposal unit incapable of adequate residual treatment. e. Any spillage or discharge from a vehicle or piping system transporting residuals to the surface disposal unit. Persons reporting such occurrences by telephone shall also file a written report in letterform within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS Within 60 days of this permit's issuance, an additional groundwater monitoring well, downgradient from Pit No. 10 and designated as MW -4 shall be installed to monitor groundwater quality. The well shall be constructed such that the water level in the well is never above or below the screened (i.e., open) portion of the well at any time during the year_ The general location and name for this well is marked on Figure 1 of this permit. The groundwater monitoring well shall be constructed in accordance with this permit and approved by the Groundwater Section of the Asheville Regional Office. 2. All wells that are constructed for the purpose of groundwater monitoring shall be constructed in accordance with 15A NCAC 2C .0108 (i.e., "Standards of Construction for Wells Other than Water Supply") and any other state and local laws and regulations pertaining to well construction. The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours prior to the construction of any groundwater monitoring well, so that an inspection can be made of the well location. Such notification shall be made to the Regional Groundwater Supervisor during normal office hours (i.e., from 8:00 a.m. until 5.00 p.m.) on Monday through Friday, excluding State Holidays. 4. Within 30 days of completion of all well construction activities, a certification shall be received from a North Carolina -licensed Professional Engineer or North Carolina -licensed Professional Geologist certifying that the groundwater monitoring wells are located and constructed in accordance with 15A NCAC 2C (i.e., "Well Construction Standards") and this permit. This certification shall be subtnitted with one copy of a GW -1 Form (i.e., "Well Completion Form") for each well. Mail this certification and the associated GW -1 Forms to NCDENR-DWQ, Groundwater Section, Permits and Compliance Unit, 1636 Mail Service Center, Raleigh, NC 27699-1636_ 5. Within 60 days of groundwater monitoring well installation, the Permittee shall submit two original copies of a scaled topographic reap (i.e., with a scale no greater than one inch equals 100 feet) Ihat has been signed and sealed by a North Carolina-Iicensed Professional Engineer or a North Carolina - licensed Land Surveyor and contains all of the following information: a. Location of all property lines, b. Location of all active and inactive pits, c. Location and identity of each groundwater monitoring well, d. Latitude and longitude of the established horizontal monument, e. Relative elevation of the top of the casing for each groundwater monitoring well (i.e., known as the measuring point"), and ZP f. Depth of water below the measuring point at the time the measuring point is established. This survey shall be conducted using approved practices as outlines in the North Carolina General Statutes Chapter 89C and the North Carolina Administrative Code Title 21, Chapter 56. The surveyor shall establish a horizontal control monument on the property of the disposal system and determine the latitude and longitude of this horizontal control monument to a horizontal positional accuracy of +1-10 feet. All other features listed above shall be surveyed relative to this horizontal control monument. The positional accuracy of these features shall have a ratio of precision not to exceed an error of closure of one foot per 10,000 feet of perimeter of the survey. Any features located by the radial method shall be located from a minimum of two points. Horizontal control monuments shall be installed in such a manner and made of such materials that the monument will not be destroyed due to activities that may take place on the property. The map shall also be surveyed using the North American Datum of 1983 (NAD 83) coordinate system and shall indicate the datum on the map. All bearings or azimuths shall be based on either the true or NAD 83 grid meridian. If a Global Positioning System. (GPS) is used to determine the latitude and longitude of the horizontal control monument, GPS receiver that has the capability to perform differential GPS shall be used and all data collected b_ the GPS receiver shall be differentially corrected. The map and any supporting documentation shall be sent to NCDENR-DWQ, Groundwater Section, Permits and Compliance Unit, 1636 Mail Service Center, Raleigh, NC 27699-1636. 6. For the initial sampling of the groundwater monitoring well as specified elsewhere in this permit, the Permittee shall submit a copy of the GW -1 Form with the GW -59 Form (i.e., "Compliance Monitoring Form'') for that well. GW -59 Forms for groundwater monitoring wells that have not had a GW -1 Form previously submitted shall be returned to the Permittee without being processed. Failure to submit these forms as required by this permit may result in the initiation of enforcement actions pursuant to NCGS §143-215-6. 7. The three existing groundwater monitoring wells, MW -1, MW -2, and MW -3, as well as the new groundwater monitoring well, MW -4, shall be sampled every March, July, and November for the following parameters: Ammonia -Nitrogen Arsenic Cadmium Chlorides Chromium Copper Iron Lead pH Phenol Sulfate Total Coliform Total Dissolved Solids Total Organic Carbon Water Level Zinc Nitrate -Nitrogen Volatile Or Compounds (VOCs) in November only The analysis for VOCs shall be completed using one of the following methods: (A) Standard Method 6230D (PQL at 0.5 gg/L or less), (B) Standard Method 62I0D (PQL at 0.5 gg/L or less), C. (C) EPA Method 8021 (Low Concentration, PQL at 0.5 gg/L or less), (D) EPA Method 8260 (Low Concentration, PQL at 0.5 gg/L or less), or (E) Another method with prior approval by the Groundwater Section Chief. Any method used shall meet the following qualifications: (1) The laboratory shall be Division certified to run any method used. (2) The method used shall, at a minimum, include all the constituents Iisted in Table VIII of Standard Method 6230D. (3) The method used shaII provided a PQL at 0.5 gg/L or less, which shall be supported by laboratory proficiency studies as required by the Division's Laboratory Certification Unit. Any constituents detected above the MDL, but below the PQL at 0.5 4g/L, shall be qualified (estimated) and reported. If any VOCs are detected by the methods listed, then the Asheville Regional Office Groundwater Supervisor, telephone number (828) 251-6208, shall be contacted immediately for further instructions regarding any additional follow-up analyses required. The results of all initial and follow-up analyses shall be submitted simultaneously. if total organic carbon concentrations greater than 10 milligrams per liter are detected in any downgradient monitoring well, additional sampling and analysis shall be conducted to identify the individual constituents comprising this total organic carbon concentration. If the total organic carbon concentration as measured in the background groundwater monitoring well exceeds 10 milligrams per liter, the concentration shall be taken to represent the naturally -occurring total organic carbon concentration. Any exceedances of this naturally -occurring total organic carbon concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. The measurement of water levels shall be made prior to sampling the groundwater for the remaining parameters. The depth to water in each monitoring well shall be measured from the surveyed point on the top of the casing. The results of the sampling and analysis shall be received on the GW -59 Form on or before the last working day of the month following the sampling month at the following address: NCDENR-DWQ Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh, North Carolina 27699-1636 The COMPLIANCE BOUNDARY for disposal systems shall be as specified by regulations in 15A NCAC 2L (i.e., Groundwater Classifications and Standards). The Compliance Boundary for disposal systems constructed prior to December 31, 1983 shall be established at either (1) 500 feet from the waste disposal area, or (2) the property boundary, whichever is closest to the waste disposal area. An exceedance of groundwater quality standards at or beyond the Compliance Boundary shall be subject to immediate remediation action in addition to the penalty provisions applicable under North Carolina General Statute §143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY shall be established around the disposal system midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the Permittee. 9. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS The Permittee or his designee shall inspect the residuals storage, transport, and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the - .. release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection; observations made; and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of five years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 2. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the surface disposal unit at any reasonable time for the purpose of determining compliance with this permit; inspect.or copy any records that must be kept under the terms and conditions of this peanut; and obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the disposal activities are carried out in accordance with the conditions of this permit, the supporting materials, and in the manner approved by this Division. • F 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit shall not be automatically transferable. In the event that there is a desire for the surface disposal unit to change ownership or a name change of the Pennittee, a formal permit request shall be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes § 143-• 215.6A through §143-215.6C. 5. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H.0205 (c)(4). 6. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (i.e., local, state, and federal) that have jurisdiction. 7. The Permittee, no later than January I, 2002, shall request a renewal and modification of this pennit, even if the surface disposal unit is not intended to receive additional residuals. The following minimum items shall comprise a suitable permit renewallmodification application package: a. * A surveyed site map of the surface disposal unit site. This map shall include the following minimum features: a scale, a north arrow, all existing and proposed topography; all property lines and limits of fencing; all structures within 500 feet of the surface disposal unit site; all drainageways and surface waters within .500 feet of the surface disposal unit site; all wells, including groundwater monitoring wells, within 500 feet of the surface disposal unit site; the location of all continuous methane gas monitoring stations; and the limits of residuals placement by pit number. b. A formal closure plan and a post -closure management plan. These plans shall be specific to the subject surface disposal unit site as well as relate to the Permittee's future plans for the land. The Division will accept a submittal that has been prepared in accordance with the document entitled "Process Design Manual: Surface Disposal of Sewage Sludge and Domestic Septage (EPA/625/R- 95/002)," published by the United States Environmental Protection Agency's Office of Research and Development. c. An implementation schedule for both the closure plan and the post -closure management plan. Upon receipt of the request, the Division shall review the adequacy of the plans provided therein and, if warranted, shall extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. S. This permit may be modified, or revoked and/or reissued to incorporate any conditions, limitations, and monitoring requirements the Division deems necessary in order to protect the environment and public health adequately.
