Therefore, as you requested, Permit Number WQ0001860, which expired on January 31, 1993, will be removed from our tracking files. If in the future, you determine that you want to engage in soil remediation activities, you must first apply for and receive a new Nondischarge permit. Failure to obtain a valid Nondischarge Permit for such activities will subject the owner to a civil penalty of up to $10,000 per day. The last sludge application to this facility took place in September 1991 and the last required groundwater sampling took place in November 1992. Although closure procedures for this facility were requested of DEM on two separate occasions, no response was received. We will continue to maintain the specified buffer zones and will temporarily abandon the groundwater monitoring wells.
