"JOE" HUDSON, JR., DIRECTOR OF WATERIWASTEWATER TREATMENT CITY OF STATESVILLE POST OFFICE BOX 1111 STATESVILLE, NORTH CAROLINA 28687 Subject: Permit No. WQ0001759 City of Statesville Fourth Creek WWTP Monofiil Facility Surface Disposal of Wastewater Residuals Iredell County Dear Mr. Hudson: In accordance with your application received on May 31, 2000 as well as the additional information received on September 20, 2000, we are forwarding herewith Permit No. WQ0001759, dated October 16, 2000, to the City of Statesville for the continued operation of a wastewater residuals surface disposal unit at its Fourth Creek Wastewater Treatment Plant for the purposes of groundwater monitoring only. This permit shall be effective from the date of issuance until September 30, 2005; shall void Permit No. WQ0001759, issued July 17, 1996; and shall be subject to the conditions and limitations as specified therein. Please take time to review this permit thoroughly. Of special interest are the following new and/or amended provisions: ♦ Condition 1. L.- This condition requires that a formal closure plan and a post -closure care management program along with applicable implementation schedules be submitted to the Division of Water Quality within 360 days of permit issuance. ♦ Condition Il. 2.: This condition has been modified to clarify that no residuals are permitted for disposal in the surface disposal unit, as it is now inactive. ♦ Condition 11. 3.: This condition has been amended to require that public access to the surface disposal unit site be controlled throughout this entire permit cycle (i.e., as opposed to only 36 months following closure). ♦ Condition I11.4.: Written reports for events of non-compliance must now be filed within five clays (i.e., reduced from 15 days) following first knowledge of the event's occurrence. ♦ Condition N. 2.: As requested by the Permittee, groundwater monitoring events are now limited to the month of December only. In addition, ammonia -nitrogen and zinc have been dropped from the list of parameters for which groundwater. samples must be analyzed. Please note that new guidance is provided in this condition regarding acceptable methods for the analysis of volatile organic compounds in the groundwater samples. The surface disposal unit, which was originally constructed in 1983, has been inactive since 1996, is no longer permitted to receive residuals, and consists of eight areas comprising 9.4 acres total. Area No. 1 was utilized during 1983, Area No. 2 was utilized during 1984, Area No. 3 was utilized in 1985, Area No. 4 was utilized in 1985 and 1986, Area No. 5 was utilized in 1986, Area No. 6 was utilized from 1987 through 1994, and Area Nos. 7 and 8 were utilized from 1995 through 1996. All eight areas were filled in with trenches that were approximately 80 to 100 feet in length and 10 feet in depth. All residuals disposed in the surface disposal unit were generated by the City of Statesville's Fourth Creek Wastewater Treatment Plant (NPDES Permit No. NC0031836), Third Creek Wastewater Treatment PIant (NPDES Permit No. NC0020591), as well as the Statesville Water Treatment Plant. The above -described operational activities shall not result in a discharge of wastes to the surface waters; shall be pursuant to the application received on May 31, 2000 as well as the additional information received on September 20, 2000; and shall be in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until September 30, 2005; shall void Permit No. WQ0001759, issued July 17, 1996; and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS 1. Within 360 days of this permit's issuance a formal closure plan and a post -closure management care program shall be submitted to the Division of Water Quality (Division). This information shall be specific to the subject surface disposal unit site as well as relate to the Permittee's future plans for the land. A schedule for implementing both the closure plan and the post -closure management care program shall be provided as well. The Division will accept a submittal that has been prepared in accordance with the document entitled "Process Design Manual: Surface Disposal of Sewage Sludge and Domestic Septage (EPA/625/R-95/002)," published by the United States Environmental Protection Agency's Office of Research and Development. Submit three copies of all information to the Non - Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. Each surface disposal unit shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastes resulting from the operation of this program. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or groundwater resulting from the operation of this surface disposal unit. 4. A copy of this permit shall be maintained at the surface disposal unit site during the life of this permit. II. OPERATION AND MAINTENANCE REQUIREMENTS The surface disposal unit shall be properly maintained and operated at all times. 2. No residuals shall be approved for disposal in the surface disposal unit. Appropriate measures shall be taken to control public access to the surface disposal unit during active use and following closure of the surface disposal unit. Such controls may include fencing and the posting of signs indicating the activities being conducted at each site. 4. Adequate provisions shall be taken to prevent any surface runoff from occurring from any active surface disposal unit. If runoff cannot be prevented, a collection system shall be installed with the capacity to handle runoff from a 24-hour, 25-year storm event. All collected runoff shall be disposed in a manner approved by the Division of Water Quality (Division). Adequate provisions shall be taken to prevent wind erosion from conveying pollutants or residuals from the surface disposal unit onto the adjacent property or into any surface waters. III. MONITORING AND REPORTING REQUIREMENTS Any monitoring (i.e., including groundwater, surface water, residuals, soil, or plant tissue analyses) deemed necessary by the Division to ensure protection of the environment shall be established and an acceptable sampling and reporting schedule shall be followed. 2. Noncompliance Notification.: The Perrnittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence with surface disposal activities that results in the disposal of significant amounts of wastes that are abnormal in quantity or characteristic. b. Any failure of the surface disposal activities resulting in a release of material to receiving waters. c. Any time that self -monitoring information indicates that the surface disposal unit has gone out of compliance with the conditions and limitations of this permit or the parameters on which the system was designed. d. Any process unit failure, due to known or unknown reasons, that renders the surface disposal unit incapable of adequate residual treatment. e. Any spillage or discharge from a vehicle or piping system transporting residuals to the surface disposal unit. Persons reporting such occurrences by telephone shall also file a written report in letterform within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 2 IV. GROUNDWATER REQUIREMENTS Existing groundwater monitoring wells MW-I, MW-2, and MW-3 shall be sampled every December for the following parameters: - Cadmium (Cd) pH Copper (Cu) Total Dissolved Solids (TDS) Chlorides Total Organic Carbon (TOC) Fecal Coliform Water Level Nitrate -Nitrogen (NO3-N) Volatile Organic Compounds (VOCs), using one of the following methods: (A) Standard Method 6230D (PQL at 0.5 pgg/L or less), (B) Standard Method 62 1OD (PQL at 0.5 µg/L or less), (C) EPA Method 8021 (Low Concentration, PQL at 0.5 µg/L or less), (D) EPA Method 8260 (Low Concentration, PQL at 0.5 µg/L or less), or (E) Another method with prior approval by the Groundwater Section Chief. Any method used shall meet the following qualifications: (1) The laboratory shall be Division certified to run any method used. (2) The method used shall, at a minimum, include all the constituents listed in Table VIII of Standard Method 6230D. (3) The method used shall provided a PQL at 0.5 µg/L or less which shall be supported by laboratory proficiency studies as required by the Division's Laboratory Certification Unit. Any constituents detected above the MDL, but below the PQL at 0.5 µg/L, shall be qualified (estimated) and reported. If any V OCs are detected by the methods listed, then the Mooresville Regional Office Groundwater Supervisor, telephone number (704) 663-1699, shall be contacted immediately for further instructions regarding any additional follow-up analyses required. The results of all initial and follow-up analyses shall be submitted simultaneously. If TOC concentrations greater than 10 milligrams per liter are detected in any downgradient groundwater monitoring well, additional sampling and analysis shall be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background groundwater monitoring well exceeds 10 milligrams per liter, this concentration shall be taken to represent the naturally -occurring TOC concentration. Any exceedances of this naturally - occurring TOC concentration in the downgradient groundwater monitoring well shall be subject to additional sampling and analysis as described above. The measurement of water levels shall be made prior to sampling the groundwater for the remaining parameters. The depth to water in each monitoring well shall be measured from the surveyed point on the top of the casing. The results of the sampling and analysis shall be received on the Groundwater Quality Monitoring Compliance Report Form (i.e., Form GW-59) on or before the last working day of the month following the sampling month at the following address: NCDENR-DWQ Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh, North Carolina 27699-1636 2. The COMPLIANCE BOUNDARY for the surface disposal unit shall be specified by regulations in 15A NCAC 2L (i.e., Groundwater Classifications and Standards). The Compliance Boundary for surface disposal units constructed after December 31, 1993 shall be established at either (1) 250 feet from the surface disposal unit. or (2) 50 feet within the property boundary, whichever is closest to the surface disposal unit. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary shall be subject to immediate remediation action in addition to the penalty provisions applicable under NCGS § 143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY shall be established around the surface disposal unit midway between the Compliance Boundary and the perimeter of the surface disposal unit. Any exceedance of Groundwater Quality Standards at the Review Boundary shall require remediation action on the part of the Permittee. 3. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. The Permittee or his designee shall inspect the surface disposal unit to prevent malfunctions and deterioration, operator errors and discharges that may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection; observations made; and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of five years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 2. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the surface disposal unit at any reasonable time for the purpose of determining compliance with this permit; inspect or copy any records that must be kept under the terms and conditions of this permit; and obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the surface disposal unit activities are carried out in accordance with the conditions of this permit, the supporting materials, and in the manner approved by this Division. 2. This permit shall not be automatically transferable. In the event that there is a desire for the surface disposal unit to change ownership or a name change of the Permittee., a formal permit request shall be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate_ The approval of this request shall be considered on its merits and may or may not be approved. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with NCGS § 143-215.6A through § 143-215.6C. 4. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 5. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (i.e., local, state, and federal) that have jurisdiction. 4 5. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Division shall review the adequacy of the surface disposal unit described therein and, if warranted, shall extend the permit for such period of time and under such conditions and limitations as itxnay deem'appropriate. 7. This permit may be modified, or revoked and/or reissued to incorporate any conditions, limitations, and monitoring requirements the Division deems necessary in order to protect the environment and public health adequately.
