Reference is made to your request for rescission of the subject State Permit. Staff of I�
the Wilmington Regional Office have confirmed that this NonDischarge Permit is no
longer required. Therefore, in accordance with your request, State Permit No.
WQ0001758 is rescinded, effective immediately. =�
If in the future you wish to again operate a nondischarge wastewater treatment
system, you must first apply for and receive a new State Permit. Operating without a
valid State Permit will subject the facility to a civil penalty of up to $10,000 per day.

I have obtained a copy of correspondence from CP&L to the
Division which requests rescission of Permit No. WQ0001758. This
letter is enclosed for your records. The Regional Office has
recommended approval for CP&L's request to use a land application
contractor in Brunswick County. As I mentioned in our previous
telephone conversation, CP&L should not be assessed a penalty for
not renewing Permit No. WQ0001758.

purpose of this letter is to inform you that CP&L does not intend to renew Permit No.
001.758 for the land application of sludge facility at the Brunswick Steam Electric Plant in
b,unswick County. This facility has been in operation since late 1989, but due to meticulous
care in operating the on-site sewage treatment plant, sludge has only been wasted infrequently.
Therefore, it is to our advantage to cease operation of the land application facility upon the
expiration of the permit on October 31, 1994, and handle our sludge disposal needs through a
private hauler. CP&L has already contacted the DEM Wilmington Regional Office concerning
amending the private hauler's permit to accept sludge from the Brunswick PIant.

the rescission of this permit.
