Dear Mr. Bolton:
In accordance with your request received January 19, 1989, we are forwarding
herewith Permit No. WQ0001077, dated May 1, 1989, to Finetex, Incorporated for
the continued operation of the subject wastewater treatment and disposal faciliCies.
This permit shall be effective from the date of issuance until March 31, la94,
shall void Permit No. 360OR2, which was issued on August 17, 1.985,and shall be
subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the, form of a written petition, conforming to Chapter 150E of North Caroli:la
General. Statutes, and filed with the Office of Admiai.strative Hearings, Post Office
Drawer 11.666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and banding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a 5,000 GPD wastewater treatment and disposal facility which
consists of an influent screening structure, dual. 115,000 gallon aeration basins. an
' 8,000 gallon holding tank, a pump station with dual 120 GPM spray irrigation pumps, a
four acre spray irrigation field, and all associated piping, nozzles, flow measuring
and recording equipment, and appurtenances to serve Finetex, Incorporated with no
discharge to the surface waters of the State, pursuant to the request received
January 19, 1989, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Natural
Resources and Community Development and considered a part of this permit.
This permit shall be effective from the date of issuance until March 31, 1994,
shall void Permit No. 3600R2, which was issued August 17, 1985, and shall be subject
to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
,3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner, which will protect the assigned
water quality standards of the surface waters and ground waters.
6. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
7. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as to
prevent any contamination of the surface or groundwaters of the State.
8, The Permittee shall employ a certified wastewater treatment plant operator to be
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
Within thirty days after the wastewater treatment facilities are 50 percent
complete, the owner must submit a letter to the Certification Commission which
designates the operator in responsible charge. Questions regarding operator

9. Diversion or bypassing of the untreated wastewater from the treatment facility
is prohibited.
10. Wastewater application rates shall not exceed:
A. Annual Loadings:
a. 200 lbs. of plant available nitrogen (PAN) per acre per year.
b. 0.45 lbs. of cadmium per acre per year after January 1, 3.987.
A . Ciimulat ive Loadings:
a. .Lead: 900 lbs/acre
b. Zinc: 450 lbs/acre
C. Copper; 225 lbs/acre
d. Nickel: 225 lbs/acre
e. Cadmium: 4.45 lbs/acre
Any site which attains the above cumulative metal loadings must be retired from
service and shall receive no future wastewater applications.
11. Soil pH shall be tested annually on each application field and each field shall
be limed to a minimum pll of 6.5. Records of soil. pH and lime additions
(lbs/acre) shall. be maintained and reported annually to the Division of
Environmental Management.
1.2. The Permittee shall submit an annual report to this Division which summarizes the
following records: the wastewater disposal method (surface or subsurface); the
amount applied by dry weight (tons/acne/yeas.) and •wet volume (million
gallons/year); metals and nutrient loading for nitrogen, phosphorus, zinc,
copper, lead, nickel and cadmium (lbs/acre/year); date of applications; and the
location of applications on designated disposal areas. A permanent record of
wastewater applications shall be accurately maintained at the Spencer Plant
Office and shall be available for review.
13. No wastewater shall be surface applied within a 100-foot buffer zone of a water
course or wet -weather drainage area; or within a 200-foot buffer zone of an A -II
classified water course and its tributaries.
14. No wastewater shall be applied in the form of surface application within a
50-foot buffer zone of any property line or right-of-way boundary.
1.5. Wastewater shall not be disposed of within areas prone to flooding by the
100-year storm.
16. The three (3) monitor wells shall be sampled every March, July, and November for
the following parameters:

* The measurement of water level must be made prior to sampling for the remaining
parameters.
If TOC concentrations greater than 10 mg/1 are detected in any downgradient
monitoring well, additional sampling and analysis must be conducted to identify
the individual constituents comprising this TOC concentration. If the TOC
concentration, as measured in the background monitor well, exceeds 10 mg/l, this
concentration will be taken to represent the naturally occurring TOC
concentration. Any exceedances of this naturally occurring TOC concentration in
the downgradient wells shall be subject to the additional sampling and analysis
as described above.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above the method detection limit (MDL) must be identified and
quantified utilizing EPA methods 601, 602, 604 and 611.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management of Form GW-59 (Compliance Monitoring Report Form) every
April, August and December.
17. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
I.S. The following buffer zones shall be maintained between any applied wastewater and
a permanent residence:
1. 200 feet from Any on -site residence
2. 400 feet from any off -site residence
19. The Permittee shall submit a current wastewater analysis report and an annual
summary of all applications to the North Carolina Department of Natural Resources
and Community Development, Mooresville Regional Office (919 North Main Street,
Mooresville, Forth Carolina. 28115). The wastewater analysis report shall contain
at least the following:

The summary of wastewater applications shall specify the dates of application,
the location of application, and the loading rates for nutrients, metals and
hydraulic.
The Permittee shall contact the Mooresville Regional Office to obtain proper
forms and assistance in maintaining proper records and submitting reports.
20. A suitable year round vegetative cover shall be maintained.
21. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
22. No root or leaf crops for public consumption shall be raised on these sites.
23. All spraying of treated wastewater must be done within the designated and
protected spray irrigation fields, as indicated on the approved engineering plans.
24. Application rates shall not exceed a maximum irrigation rate of 0.25 inches/hour
or an average of 0.55 inches/acre/week. of wastewater, uniformly applied so as to
avoid runoff, ponding, or erosion.
'25. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
.26. Wastewater shall not be applied during inclement weather or until 24 hours
following a rainfall event 1/2-inch or greater in 24 hours.
