Dear Mr. Baker:
In accordance with your application received June 24, 1988, we are forwarding
herewith Permit No. WQ0000738, dated November 4, 1988, to the City of Burlington
for the construction and operation of the subject sludge .removal and disposal
program.
This permit shall be effective from the date of issuance until October 30,
1990, and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 1.1666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall. be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of a program to remove approximately 3,800 cubic yards of
illegally disposed of wastewater treatment sludge from the East Burlington Landfill
and to apply this sludge at agronomic rates to the cover soil at the Anthony Road
Landfill, pursuant to the application received June 24, 1988, and in conformity with
the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of issuance until October 30, 1990,
and shall be subject to the following specified conditions and limitations:
J.. This permit shall become voidable unless the facilities are operated in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4, This permit is not transferable.
5. A copy of the approved plans shall be maintained on file by the permittee for a
minimum of five years from the date of issuance.
6. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
7. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
8. Satisfactory controls shall be provided to contain the accidental discharge or
spillage of sludge either stored or being used on the project site.
9. Adequate facilities shall be provided to prevent surface runoff from carrying any
disposed or stored material into any surface waters.
10. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
11. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
12. No type of sludge other than that from the East Burlington Landfill shall be
placed on the land application disposal site.
13. Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property or into the surface waters.
14. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
15. Maximum slope for sludge application shall be 10% for surface application and 18%
for subsurface applications.
16. A 50 -font buffer shall be maintained between draina.geways, a 100 -font buffer
shall be maintained between each landowner's property lines, and a 400 -foot
buffer shall be maintained between any residence and any applied sludge.
17. A recorded log of sludge applications including amounts applied, dates, method of
application, and site location shall be maintained at by the Permittee as a
permanent record.
18. Trucks transporting sludge from the East Burlington Landfill to the .Anthony Road
Landfill shall be covered.
19. Public access to the land application sites shall be controlled during active
site use and for the 5 -year period following the land application event.
20. A suitable year round vegetative cover shall be maintained.
21. Sludge stored at the Anthony Road Landfill shall be placed on an impervious
surface, covered with polyethylene fabric and protected from migration by earthen
berms.
22. The application rates shall not exceed 13.6 dry tans/acre/year.
23. Annual cadmium application rate shall not exceed .45 lb/ac.

25. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2 -inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
26. Care shall be taken when removing sludge from the stockpile area in order to
prevent accidental breaching of the landfill cap. If such damage should occur,
the Permittee shall inform the Winston-Salem Regional Office, and take the
necessary steps to repair the landfill cap.
27. The Division of Health Services, Solid Waste Management Section, phone no.
919/733-0692 shall be notified at least one (1) week prior to the "start" date of
sludge application so that a representative may be present. Such notification
shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on
Monday through friday, excluding State Holidays.
