Dear Mr. Wilson:
In accordance with your application .received August 29, 1988, we are
forwarding herewith Permit No. WQ0000267, dated November 21, 1988, to N.C.
Department of Corrections for the construction and operation of the subject
wastewater treatment and disposal facilities.
This permit shall be effective from the date of issuance until November 30,
1993, and shall be subject to the conditions and limitations as specified therein..
The permittee should be advised that unless the lagoon is constructed during
the very dry portion of the year de -watering activities may be necessary'to Lower
the groundwater table and allow proper installation of the comparted clay liner.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to .request art adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150E of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article. 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
N. C. Department of Corrections
Gates County
FOR THE
construction and operation of a 25,000 GPD wastewater treatment and spray irrigation
disposal facility consisting of an influent bar screen, a 45 GPM duplex grinder pump
station with high water alarms, 4,300 linear feet of 3 -inch force main, a 1.5 MG
treatment/ storage lagoon, hypochlorination, a 9,290 gallon chlorine contact tank with
turbine pumps, a 20 HP irrigation pump and approximately 7.0 acres of spray
irrigation field to serve the N.C. Department of Corrections Gates County Subsidiary
with no discharge to the surface waters of the State, pursuant to the application
received August 29, 1988, and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of
Natural Resources and Community Development and considered a part of this permit.
This permit shall be effective from the date of issuance until November 30, 1993,
and shall be subject to the following specified conditions and limitations:
I. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the
requirements of this permit and the approved plans and specifications. Mail the
certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C.
27611-7687.
6. Plans and specifications for sewer lines must be retained for five (5) years
after completion of construction, also plans and specifications for all other
projects must be retained for the life of the project.
7. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
8. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
9. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
14. The sludge generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approvable by the North
Carolina Division of Environmental Management.
11. The facilities shall be effectively maintained and operated at all times so that
there is no discharge to the surface waters, nor any contamination of ground
waters which will render them unsatisfactory for normal use. In the event that
the facilities fail to perform satisfactorily, including the creation of nuisance
conditions or failure of the irrigation area to adequately absorb the wastewater,
the Permittee shall take such immediate corrective action as may be required by
the Division of Environmental Management.
12. A suitable year round vegetative cover shall be maintained_
13. Irrigation shall not be performed during inclement weather or when the ground is
in a condition that will cause runoff.
14. Adequate measures shall be taken to prevent wastewater runoff from the spray
field.
15. Diversion or bypassing of the untreated wastewater from the treatment facilities
is prohibited.
16. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
17. The application rates shall not exceed:
.30 inches/acre/hour
1.0 inches/acre/hour
18. The Permittee shall employ a certified wastewater treatment plant operator to be
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
19. Freeboard in the treatment/ storage lagoon shall not be less than two (2) feet
at any time.
20. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
21. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
22. No type of wastewater other than that from the N.C. Department of Corrections
Gates County Subsidiary shall be sprayed onto the irrigation area.
23, Prior to beginning waste disposal operations, four (4) monitor wells, one (1)
upgradient and three (3) downgradient, must be installed to monitor groundwater
quality. The location and construction details for these wells must be by
approval of the Washington Regional Office, from which a well construction permit
must be obtained. (The well locations approved by the Washington Regional Office
may differ from the locations indicated on the approved plans.)
24. The monitor wells must be sampled initially after construction (and prior to
waste disposal operations) and thereafter every March, July, and November for the
following parameters:

The measurement of water level must be made prior to sampling for the remaining
parameters.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management on Form GW -59 (Compliance Monitoring Report Form) every
April, August and December.
25. The lagoon liner shall be at least one_goot -thick at all locations and shall have
a maximum permeability of 1 x 10 cm/sec. Following installation and
inspection of the lagoon liner, and prior to waste disposal operations,
verification of the liner's compliance with permeability and thickness
specifications must be provided to the Groundwater Section by the project
engineer,
26 The existing water supply well at the lagoon site must be abandoned in accordance
with requirements of 15 NCAC 2C (Well Construction Std.), prior to start of
lagoon construction.
