Dear Mr. Jones:
In accordance with your request received February 10, 1989, we are forwarding
herewith Permit No. WQ0000230, dated March 20, 1989, to Federal Nail Manufacturing
Company for the continued operation of the subject wastewater pump and haul disposal.

This permit shall be effective from the date of issuance until May 31, 1989,
and shall be subject to the conditions and limitations as specified therein. Please
by advised, Permit No. WQ0000230 issued August 31, 1988 expired February 29, 1989
and is no longer a valid permit.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150E of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Federal Nail Manufacturing Company
Surry County
FOR THE
operation of an 8,000 gallon -per -day pump and haul disposal system from Federal Nail
Manufacturing Company to Seaboard Chemical Corporation, pursuant to the application
received August 26, 1988, and the request received February 10, 1989, and in
conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Natural Resources and Community
Development and considered a part of this permit.
This permit shall. be effective from the date of issuance until. May 31, 1989, and
shall be subject to the following specified conditions and limitations:
1. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
2. The facilities shall be properly maintained and operated at all times.
3. This permit is not transferable.
4. This permit shall become voidable unless the agreement between Federal Nail
Manufacturing Company and Seaboard Chemical Corporation for the collection and
final treatment of wastewater is in full .force and effect.
5. The permittee is liable for any damages caused by a spill or failure of the pump
and haul. operations.
6. The issuance of this permit shall not relieve the Permittee of the
responsibility .for damages to surface or groundwaters resulting from the pump and
haul operation.
7. The facilities shall be effectively maintained and operation as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this fatality.
8. The accurate record must be maintained by the Permittee, indicating:
a, date holding facility pumped
b. volume of wastewater pumped
9. This permit shall not be renewed or extended.
10, The wastewater collected, pumped and hauled, shall be adequately treated by
Seaboard Chemical Corporation.
