Dear Mr. Jeter:
In accordance with your application received August 1, 1988, we are
forwarding herewith Permit No. WQ0000048, dated October 27, 1988, to the City of
Whiteville for the operation of the subject land application of municipal sludge.
This permit shall be effective from the date of issuance until October 31,
1993, and shall be subject to the conditions and linl.itations as specified therein.
If any parts, requirements, or limitations contained in this perinit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11665, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

6. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and air acceptable
sampling reporting schedule shall be followed.
7. A suitable year round vegetative cover shall be maintained.
B. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
9. Adequate facilities shall be provided to prevent surface runoff from carrying any
disposed or stored material into any surface waters.
10. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
11. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
12. Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property or into the surface waters.
13. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2 -inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental lianagement.
14. A 100 -foot buffer shall be maintained between the appropriate land owner's
property line and any applied sludge.
15. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
16. No crops for direct human consumption shall be raised on these sites for a period
of 18 months following sludge application.
17. No liquid sludge shall be surface applied within a 100 -foot buffer zone of any
water course or surface drainage area.
18. No liquid sludge shall be applied by subsurface injection within a 25 -foot buffer
zone of any water course or surface drainage area.
19. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
20. In any future transfer of this land, a notice shall be given to the new owner
that gives full details of the materials applied or incorporated at this site.
21. No sludge shall be applied within a 50 -foot radius of the existing or within a
50 -foot buffer of the associated drainageway.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
The City of Whiteville

FOR THE
operation of a land application program to dispose of liquid sludge from an existing
lagoon and sludge from the daily operation of the Whiteville Wastewater Treatment
Plant, with disposal by surface application and subsurface injection onto a total
area of approximately 469 acres identified in condition No. 33, pursuant to the
application received August 1, 1988, and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the
Department of Natural Resources and Community Development and considered a part of
this permit.
This permit shall be effective from the date of issuance until October 31, 1993,
and shall be subject to the following specified conditions and limitations:
1. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
2. The facilities shall be properly maintained and operated at all times.
3. This permit is not transferable.
4. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a spanner which will protect the assigned
water quality standards of the surface waters and ground waters.
5. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
22. A 50 -foot buffer shall be maintained between drainageways, a 100 -foot buffer
shall be maintained between each landowner's property lines, and a 4.00 -foot
buffer shall be maintained between any residence and any applied sludge.
7.3. Animals should not be grazed on sludge applied land within a 30 -day period
following the sludge application. Application sites that are to be used for
grazing shall have fencing that will be used to prevent access during the 30 -day
periods after each application.
24. Surface applied sludge will be plowed or disced in immediately after application
on lands with no cover crop established.
25. Surface application of liquid sludge shall not be used on sites that are prone to
flooding conditions. (Below the 100 -year flood level..)
26. Prior to initial disposal of the sludge currently being generated by the
Whiteville Wastewater Treatment Plant a sample must be collected and tested for
mixed -liquor -volatile -solids to determine stability. The sample data must be
submitted to the Wilmington Regional Office and approval. obtained prior to
disposal.
27. The application rates on a 3 year cycle shall not exceed:

24. Proper records shall be maintained for tracking sludge applied on the permitted
sites. These records shall include, but are not necessarily limited to, the
following minimum information:
a) The date of each sludge application.
b) The location of sludge application.
c) The area of each field to which the sludge is applied in acres or square feet.
d) Volume of each sludge application in gallons.
e) Annual and cumulative totals of dry tons/acre of sludge, lbs./acre of
phosphorus, lbs./acre of plant available nitrogen. (PAN), and lbs./acre heavy
metals applied to each field.
These records shall be summarized annually and submitted to the Water Quality
Superior of the Wilmington Regional Office on or before January 15 of the
following year.
30. This permit shall become avoidable unless the., agreement between the City of
Whiteville and Mr. Wilbur Freedman and Mr. Billy Hooks are in full force' and
effect.
31. The City of Whiteville shall provide to all landowners annual reports concerning
sludge disposal activities on their property.
32. Any additional sites for land disposal of sludge shall be approved by this
Division prior to disposal.
33. The following is a list of all permitted sites for land application of municipal
sludge from the City of Whiteville:
