This Permit shall be effective from the date of issuance until December 7, 1990, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this Permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this Permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this to Permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. This Permit shall be effective from the date of issuance until December 7, 1990, and shall be subject to the following specified conditions and limitations: 1. The Mooresville Regional Office, phone no. (704) 663-1699, shall be notified so that an in-place inspection can be made prior to commencing operation of the Cement Kiln Dust Stabilization process. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 2. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the City of Statesville shall take immediate corrective action, including those as may be required by this Division. �' '' �•� t I 416 -9-9910 13 I I. The Cement Kiln Dust Sludge Stabilization facilities shall be effectively maintained and operated at all times in such a manner as to produce a product which will meet the requirements of the Process to Further Reduce Pathogens. i Ill • ' , j. � ' • ' �1��� 11: ul ill_. 1. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. The City of Statesville shall implement a monitoring program for the Cement Kiln Dust Sludge Stabilization Program at the time of operation. This program shall include a sludge analysis and TCLP analysis to be conducted by the City of Statesville and the results maintained on file by the City of Statesville for a period of three years after the pilot program has concluded. The sludge analysis shall include but is not necessarily limited to the following parameters: Percent Total solids* pH* Magnesium Chlorides Sulfate Phosphorus Potassium Lead Zinc Copper Nickel Cadmium Chromium Sodium Calcium Total Nitrogen Ammonia Nitrogen Nitrate/Nitrite Nitrogen Plant Available Nitrogen (by calculation) Temperature"'* Hexachlorobenzene daily samples shall be taken prior to processing, after initial mixing, and three (3) days after initial mixing. Temperature measurements shall be taken at varying depths in the processed sludge pile such that a representative temperature profile can be created to show a uniform temperature of 52 degrees Celsius. The temperature measurements shall be made for the first three days of the pilot study initially after mixing, and at intervals of two (2) hours for the first twelve (12) hours after initial mixing occurs. Thereafter temperature measurements shall be made at intervals of twelve (12) hours for the ,remainder of the thirty six hour period The sludge analysis and TCLP analysis shall be of a composite of all material processed during one day's operation. Note the testing frequency for percent total solids, pH and temperature are not to be composite samples and shall be sampled as outlined above. The TCLP analysis shall include the following parameters: Arsenic Barium Benzene Cadmium Carbon tetrachloride Chlordane Chlorobenzene Chloroform Chromium o -Cresol m -Cresol p -Cresol Cresol 2,4-D 1,4 -dichlorobenzene 1,2-dichloroethane 1,1-Dichloroethyiene 2,4-Dinitrotoluene Endrin Heptachlor (and its hydroxide) Hexachlorobenzene Hexachloro- 1,3 -butadiene Hexachloroethane Lead Lindane Mercury Methoxychlor Methyl ethyl ketone Nitrobenzene Pentachlorophenol Pyridine Selenium Silver Tetrachloroethylene Toxaphene Trichloroethylene 2,4,5 -Trichlorophenol 2,4,6 -Trichlorophenol 2,4,5 -TP (Siivex) Vinyl chloride 3. Three copies of all monitoring and reporting requirements as specified in conditions IH -2, shall be submitted to the Assistant Chief of Operations at the following address: NC Division of Environmental Management Water Quality Section Permits and Engineering Unit PO Box 27687 Raleigh, NC 27611-7687 4. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office, telephone no. (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the cement kiln dust sludge stabilization facilities which results in the treatment of significant amounts of sludge which are abnormal in quantity or characteristics. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate sludge stabilization such as mechanical or electrical failures of equipment c. Any time that self-monitoring information indicates that the facility is not in compliance with its permit limitations. Any occurrence of this shall cause the stabilized sludge to be reprocessed so that the Process to Further Reduce Pathogens can be met. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The City of Statesville or a designee shall inspect the cement kiln dust sludge stabilization facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The City of Statesville shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the City of Statesville. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this Permit; or may obtain samples of sludge, processed sludge, groundwater, surface water, or leachate. 3 1. This Permit is subject to revocation unless the cement kiln dust sludge stabilization facilities are operated in accordance with the conditions of this Permit, the approved plans and specifications. 2. This Permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The following facilities are approved sites for the operation of the Cement Kiln Dust Sludge Stabilization Pilot Program: Facilily Permit Number County Volume of Sludge Fourth Creek WWTP NC0031836 Iredell 4 wet tons per day 4. Failure to abide by the conditions and limitations contained in this Permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 5. The issuance of this Permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. Cement Kiln Dust Stabilized Sludge must be disposed of at the Fourth Creek Sludge Landfill (Non -Discharge Permit No. WQ0001759). 7. The Permittee shall provide adequate dust control such that nussiance conditions are not created by the cement kiln dust sludge stabilization program.
