Dear Mr. Willson:
In accordance with your renewal request received November 5, 1986, we
are forwarding herewith Permit No. 3213112, dated May 7, 1986, to Martin
Marietta Basic Products for the continued operation of the subject "closed
circuit" wastewater treatment facility.
This permit shall be effective from the date of issuance until May 1,
1991, and shall be subject to the conditions and limitations as specified
therein.
If any parts, requirements, or limitations contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing before
a hearing officer upon written demand to the Director within thirty (30) days
following receipt of this permit, identifying the specific issues to be contended.
Unless such demand is made, this permit shall be final and binding.

For the Discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a 0.324 MGD "closed circuit" type wastewater treatment
- facilities consisting of an influent pump system, two (2) settling ponds in series
with an effluent pump system to recycle the treated wastewater to the Bessemer
City Quarry operation so that there shall not be any discharge to the surface
waters of this State,
pursuant to the renewal request received November 5, 1986, and in conformity
with the project plans, specifications, and other supporting data, subsequently
filed and approved by the Department of Natural Resources and Community
Development and considered a part of this permit.
This permit shall be effective from the date of issuance until May 1, 1991,
and shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. In event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Division, including the construction of
additional or replacement wastewater treatment or disposal facilities.

6. The sludge generated from these treatment facilities must be disposed of
in accordance with General Statutes 143-215.1 and in a manner approvable
by the North Carolina Division of Environmental Management.
7. The Permittee, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission
will review the adequacy of the facilities described therein, and if indicated,
will extend the Permit for such period of time and under such conditions
and limitations as it may deem appropriate.
8. The issuance of this permit shall not relieve Martin Marietta of the responsibility
for damages to surface or ground waters resulting from the operation of this
facility.
9. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as
to prevent any contamination of the surface or groundwaters of the State.
10. Two monitor wells, one upgradient and one downgradient, should be installed
to monitor groundwater quality at the settling ponds. The location and
construction details for these wells should be by approval of the Mooresville
Regional Office, from which a well construction permit must be obtained.
11. The monitor wells should be sampled initially after construction and every
March, July, and November thereafter for the following parameters:

The measurement of water level should be made prior to sampling for the
remaining parameters.
