Modifications to the subject permit are as follows: The field parameters of Dissolved Oxygen, Oxidation Reduction Potential, Specific Conductance and Temperature have been added to the groundwater sampling requirements. This permit shall be effective from the date of issuance until May 31, 2021, shall void Permit No. WQ0002378 issued July 12, 2007, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements listed in Attachments A, B and C, for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information shall result in future compliance problems. Please note the following permit conditions have been removed since the Iast permit issuance dated July 12, 2007: ➢ Old Condition III.4. — This condition pertained to an earlier stage in the reclamation process. Please note the following permit conditions are new since the last permit issuance dated July 12, 2007: ➢ Condition II.3. — This condition requires compliance with the 2C well construction standards. ➢ Condition 11.6. — This condition excludes most wells from within the compliance boundary. ➢ Condition IV.8. — This condition requires an annual report to be submitted every year. ➢ Condition V1.6. — This condition allows permit modification or revocation under certain circumstances. Sincerely, Jay Zimmerman, P.G., Director Division of Water Resources cc: Iredell County Health Department (Electronic Copy) Mooresville Regional Office, Water Quality Regional Operations Section (Electronic Copy) Beth Buffington — Protection and Enforcement Branch (Electronic Copy) Digital Permit Archive (Electronic Copy) Central Files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENTAL QUALITY RALEIGH SURFACE DISPOSAL OF CLASS B RESIDUALS PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Mooresville Iredell County FOR THE continued operation of a residuals management program for the Town of Mooresville that is undergoing a closure and post -closure management program that includes groundwater monitoring and methane gas monitoring for the surface disposal units, and consisting of the landfilling of Class B residuals from the surface disposal units (inactive since December 31, 2001) listed in Attachment A to the approved landfilling sites listed in Attachment B with no discharge of wastes to surface waters, pursuant to the application received November 12, 2015, and subsequent additional information received by the Division of Water Resources, and in conformity with other supporting data subsequently filed and approved by the Department of Environmental Quality and considered a part of this permit. The use and disposal of residuals are regulated under Title 40 Code of Federal Regulations Part 503. This permit does not exempt the Permittec from complying with the federal regulations. This permit shall be effective from the date of issuance until May 31, 2021, shall void Permit No. WQ0002378 issued July 12, 2007, and shall be subject to the following specified conditions and limitations: I. SCHEDULES 1. Upon completion of the reclamation of the surface disposal units and prior to the removal of public access control devices, the Mooresville Regional Office, telephone number (704) 663-1699, shall be notified. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. [G.S. 143-215.3.(a)] 2. No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal application. PERFORMANCE STANDARDS The subject residuals management program shall be effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall immediately cease removing residuals from the surface disposal unit, contact the Mooresville regional office supervisor, and take any immediate corrective actions. [G.S. 143-215.1] 2. This permit shall not relieve the Permittee of responsibility for damages to groundwater or surface water resulting from the operation of this residuals management program. [15A NCAC 02B .0200, 02L.01001 3. All wells constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 02C .0108 (Standards of Construction for Wells Other than Water Supply), and any other jurisdictional laws and regulations pertaining to well construction. [15A NCAC 02C .0108] 4. The residuals surface disposal units were individually permitted prior to December 30, 1983; therefore, the compliance boundary is established at either 500 feet from each surface disposal unit, or at the property boundary, whichever is closest to the surface disposal unit. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A NCAC 02L .0106(d)(2), as well as enforcement actions in accordance with North Carolina General Statute 143-215.6A through 143-215.6C. Any approved relocation of the COMPLIANCE BOUNDARY will be noted in Attachment B. [ 15A NCAC 02L .0107(a)] 5. The review boundary shall be established midway between the compliance boundary and the surface disposal unit. Any exceedance of groundwater standards at the review boundary shall require action in accordance with 15A NCAC 02L A106. [15A NCAC 02L .0108] 6. No wells, other than Division approved monitoring wells, shall be constructed within the compliance boundary, except as provided by 15A NCAC 02L .0107(g). [15A NCAC 02L .0107(d)] 7. No residuals shall be approved for disposal in the surface disposal units. [15A NCAC 02T .0108(b)(1)] III. OPERATION AND MAINTENANCE REQUIREMENTS The residuals management program shall be properly maintained and operated at all times. The program shall be effectively maintained and operated as a non -discharge system to prevent any contravention of surface water or groundwater standards. [I5A NCAC 02T . 1110] 2. The Permittee shall maintain an approved Operation and Maintenance Plan (O&M Plan). Modifications to the O&M Plan shall be approved by the Division prior to utilization of the new plan. The O&M Plan, at the minimum, shall include: a. A description of the operations of the program and any associated facilities and equipment in sufficient detail to show what operations are necessary for the program to function and by whom the functions are to be conducted, b. A detailed closure plan for the facility including: i. Detailed maps showing location of disposal units, including both areas reclaimed and yet to be reclaimed. ii. Anticipated schedule for completion of reclamation of the facility including any incremental phases for individual areas or units to be reclaimed. c. A description of the anticipated maintenance of facility and equipment that are associated with the program WQ0002378 Version 3.0 Shell Version 150101 Page 2 of 7 d. Provisions for safety measures including restrictions of access to the site and equipment, as appropriate, e. Spill control provisions including: i. Response to upsets and bypasses including control, containment, and remediation, ii. Contact information for program personnel, emergency responders, and regulatory agencies, f. Detailed procedures for sampling and monitoring to ensure that the program stays in compliance with this Section and any issued permit. [15A NCAC 02T. 11001 3. Appropriate measures shall be taken to control public access to the surface disposal unit during active use, and for the 36-month period following closure of the surface disposal unit. Such controls may include fencing and the posting of signs indicating the activities conducted at each site. [15A NCAC 02T .1109(c)(2)(G)] 4. The final cover system for each fully excavated cell of the surface disposal unit shall consist of fertile soil. After construction, a vegetative cover shall be established to protect the final cover system against erosion. The root system of the vegetative cover shall not extend more than 24-inces below the final cover surface. [15A NCAC 02T .1109(b)] 5. Adequate provisions shall be taken to prevent surface runoff from any surface disposal unit. If runoff cannot be prevented, a collection system shall be installed with the capacity to handle runoff from a 24- hour, 25-year storm event. All collected runoff shall be disposed in a Division approved manner. jl 5A NCAC 02T .I 109(c)(2)(C)] 6. Adequate provisions shall be taken to prevent wind erosion from conveying residuals from the surface disposal sites onto adjacent properties or into surface waters. [15A NCAC 02T .1109(c)(2)(C)] 7. This permit shall become voidable if operation of the surface disposal sites causes contravention of surface water or groundwater standards, and may be revoked unless the surface disposal sites are maintained and operated in a manner that will protect the assigned surface water and groundwater quality standards. [15A NCAC 02T .0110] 8. A copy of this permit, as well as the post -closure management program plan, shall be maintained onsite for the life of this permit. 9. MONITORING AND REPORTING REQUIREMENTS 1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sample reporting schedule shall be followed. [ 15A NCAC 02T .0108(c)] 2. Representative residuals samples shall be analyzed to demonstrate they are non -hazardous under the Resource Conservation and Recovery Act (RCRA). Residuals that tests or is classified as a hazardous or toxic waste under 40 CFR Part 261 shall not be used or disposed under this permit. The analyses [corrosivity, ignitability, reactivity, and toxicity characteristic leaching procedure (TCLP)] shall be performed at the frequency specified in Attachment A, and the Permittee shall maintain these results for a minimum of five years. Any exceptions from the requirements in this condition shall be specified in Attachment A. Monitoring wells shall be sampled at the frequencies and for the parameters specified in Attachment C. All mapping,_ well construction forms, well abandonment forms and monitoring data shall. refer to the ermit number and the well nomenclature as provided in Attachment C and Figure 2. Two copies of the monitoring well sampling and analysis results shall be submitted on a Compliance Monitoring Form (GW-59), along with attached copies of laboratory analyses, on or before the last working day of the month following the sampling month. The Compliance Monitoring Form (GW-59) shall include this permit number, the appropriate well identification number, and one GW-59a certification form shall be submitted with each set of sampling results. The air at the surface disposal unit boundary shall be monitored for methane gas on an annual basis. The methane gas concentration shall not exceed the Lower Explosive Limit (LEL). The Division reserves the right to require continuous methane monitoring in accordance with established policy should weekly monitoring indicate that the surface disposal unit is producing significant volumes of methane gas that may endanger public health and safety. [15A NCAC 02T .l 109(c)(2)(F)] 6. Analytical determinations made pursuant to the monitoring and reporting requirements of this permit shall be made by a laboratory certified by the Division for the required parameter(s) under 15A NCAC 02T .1111. [15A NCAC 02T .1111] 7. The Permittee shall maintain records tracking all residual surface disposal events. At a minimum, these records shall include the following: Volume of residuals removed from the surface disposal unit (express volume in gallons per year, dry tons per year, or kilograms per year); b. Date of removal; and c. Disposal location of removed residuals. [ 15A NCAC 02T .0109(a)] 8. Three copies of an annual report shall be submitted on or before March 1'. The annual report shall meet the requirements described in the Instructions for Residuals Application Annual Rep-grting Forms. Instructions for reporting and annual report forms are available at hgp://portal.ncdenr.org/web/wq/as/lau/repor,ting, or can be obtained by contacting the Land Application Unit directly. Noncompliance Notification The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Surface disposal of residuals abnormal in quantity or characteristic. b. Any failure of the surface disposal program resulting in a release of material to surface waters. c. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations. d. Any process unit failure, due to known or unknown reasons, rendering the facility incapable of adequate residual treatment. e. Any spill or discharge from a vehicle or piping system during residuals transportation. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300.Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to betaken to ensure that the problem does not recur. [15A NCAC 02T .0105(i), 02T .0108(b) (1)] V. INSPECTIONS 1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the subject facilities and shall be in accordance with the approved O&M Plan. [ 15A NCAC 02T A 108(b)] 2. The Permittee or his designee shall inspect the residuals surface disposal facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of inspection, and this log shall be made available to the Division upon request. [15A NCAC 02T ,0108(b)] 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the land application sites or facilities permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit; and may collect groundwater, surface water or leachate samples. [G.S. 143-215.3(a)(2)] VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. [G.S. 143-215.6A to 143-215.6C] 2. This permit shall become voidable if the residuals land application events are not carried out in accordance with the conditions of this permit. [15A NCAC 02T .0110] 3. This permit is effective only with respect to the nature and volume of residuals described in the permit application and other supporting documentation. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 1 SA NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. [15A NCAC 02T .0105(c)(6)] 5. In the event the residuals program changes ownership or the Permittee changes his name, a formal permit modification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate documentation from the parties involved and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the residuals program permitted herein until a permit is issued to the new owner. [ 15A NCAC 02T .0104] 6. This permit is subject to revocation or unilateral modification upon 60 days' notice from the Division Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. Unless the Division Director grants a variance, expansion of the permitted residuals program contained herein shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b). [ 15A NCAC 02T .0120] 8. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to pay the annual fee accordingly shall be cause for the Division to revoke this permit. The measurement of water levels shall be made prior to purging the wells. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measurement of pH shall be made after purging and prior to sampling for the remaining parameters. 3. The measuring points (top of well casing) of all monitoring wells shall be surveyed to provide the relative elevation of the measuring point for each monitoring well. Volatile Organic Compounds (VOC) - In November only, analyze by one of the following methods: a_ Standard Method 6230D, PQL at 0.5 µg/L or less b. Standard Method 6210D, PQL at 0.5 µg/L or less c. EPA Method 8021, Low Concentration, PQL at 0.5 µg/L or less d. EPA Method 8260, Low Concentration, PQL at 0.5 µg/L or less e. Another method with prior approval by the Water Quality Permitting Section Chief Any method used must meet the following qualifications: a. A laboratory must be DWQ certified to run any method used. b. The method used must, at a minimum, include all the constituents listed in Table VIII of Standard Method 6230D. c. The method used must provide a PQL of 0.5 µg/L or less that must be supported by laboratory proficiency studies as required by the DWQ Laboratory Certification Unit. Any constituents detected above the MDL but below the PQL of 0.5 µg/L must be qualified (estimated) and reported. 5. If any volatile organic compounds (VOC) are detected as a result of monitoring as provided in Attachment C, then the Mooresville Regional Office supervisor, telephone number (704) 663-1699, must be contacted immediately for further instructions regarding any additional follow-up analyses required. 6. Monitoring wells shall be reported consistent with the nomenclature and location information provided in Figure 2 and this attachment.
