REGAN , Sect elan' LINDA CULPEPPER a4r1 f~' Intel int De ecla • i san maw r - p ,vti NORTH CAROLINA Environmental Quality September 25, 2018 The Honorable Eulis Willis, Mayor Town of Navassa 334 Main Street Navassa, NC 28451 Subject: NOTICE OF VIOLATION NOV-2018-OP-0011 Failure to Apply for System-Wide Wastewater Collection System Permit(WQCS00383) Navassa Collection System Brunswick County Dear Mayor Willis: On May 31, 2018 correspondence from the Division of Water Resources directed you to apply for an individual collection system permit based on an actual, permitted or Division approved average daily flow of 200,000 gallon per day or over. Your response received on June 28, 2018 disputed the average flow rates used by the Division to determine that an individual permit is required. Further information was requested to be submitted by August 13, 2018 to support your position that an individual permit is not required. Other information also required to be submitted by August 13 are the operation and maintenance plan and inspection log forms. To date the requested information has not been received nor has a permit application been submitted. Therefore,the Town of Navassa is in violation of 15A NCAC 02T.0405(a)for failing to submit a completed collection system permit application within 60 days of the Division's request for application. It is imperative that the system-wide collection system permit application be completed and submitted, or documentation of the flow rates demonstrating a permit is not required be provided, to the letterhead address within 30 days of receiving this letter to avoid future enforcement actions. Include in your response the items mentioned above with a required due date of August 13. Your response to this letter will be considered in deciding whether a Notice of Violation/Notice of Intent to Enforce will be issued regarding the above noncompliance.
