This would affect the Apex Peakway project and would mean that providing level spreaders for diffuse flow to buffered streams would be sufficient and that bioretention cells would not be necessary. During the public comment period, we allow applicants to choose whether to follow the old or the new policy. Because of our statutory timeframe for project review on the Apex Peakway, we are going to issue the 401 based on the information we received on May 29, 2009 that includes designs for bioretention cells. If you decide that you would prefer to use level spreaders on this project in lieu of bioretention cells, you can submit a request for stormwater management plan modification in the future. Based on my preliminary review of the level spreader information that the DWQ received on Feb. 27, 2009, 1 note the following deficiencies: 1. The level spreaders at outlets 16 and 13 have been placed within the riparian buffer. This is not permitted. Also, these two levels spreaders must be located so the entire filter strip is not impeded by fill slopes, wing walls, etc. 2. For the level spreader at Outlets 22 and 27: It is not allowable to divide the level spreader into two level spreaders in series that are only half of the required length. These level spreaders are also within the riparian buffer, which is not allowed. 3. The following items were omitted from the submittal: • A 1" = 30' plan view of each proposed level spreader with proposed one-foot topo lines. • The construction sequence. • A photograph of the filter strip vegetation. • The drainage area for each level spreader depicted on the plan sheets. • The signed and notarized operation and maintenance agreements.
