This permit, issued on .Time .5, 2009 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) An earthen plug shall be left between the area to be excavated and the existing waters of the Cape Far
River and a 24 hour period after completion of excavation shall elapse prior to plug removal to
prevent unnecessary siltation into the adjacent water body.
2) No excavation shall take place outside the area indicated on the attached workplan drawings.
3) Excavation shall not exceed -6 feet below the nonnal low water level. In no case shall the depth of
excavation exceed the depth of the connecting waters.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
4) No vegetated wetlands shall be excavated outside the area indicated on the attached workplan drawings.
5) The temporary placement of double handling of excavated materials within waters or vegetated wetlands
is not authorized.
6) The limits of excavation shall be located a sufficient distance away from the existing fish house to
ensure that its structural integrity is not compromised.
Spoil Disposal
7) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
8) No spoil material shall be placed within 30 feet of the normal high water line.
9) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
beginning of any dredge activities.
Sedimentation and Erosion Control
10) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
11) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30
calendar days of completion of the bulklhead.
Shoreline Stabilization
12) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
13) The alignment of the permitted bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Upon verification by the Division of Coastal Management, the approved bulkhead
alignment shall be surveyed prior to construction. Failure to survey approved alignment and initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re-verified by DCM and surveyed within a maximum of 30 days prior to the new
expected start of construction.
14) The bulkhead shall be constructed prior to any backfilling activities.
15) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
16) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.

17) All backfill material shall be clean and free of any pollutants except in trace quantities.
18) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
19) No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
20) All fill material to be placed below normal high water level shall be confined behind the permitted
bulkhead.
Docking Facility
21) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non-water dependent uses of structures shall be conducted on, in or
over public trust waters without permit modification.
22) This permit authorizes a maximum of ten formalized boat slips associated with the docking facility.
23) No attempt shall be made by the pennittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
24) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
25) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
26) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
27) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
28) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
29) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
30) In accordance with commitments made by the permittee, deed restrictions shall be placed on Lots 1-4
dedicating the entire shoreline of these lots to Cape Fear landing, LLC for the proposed docking facility.
The deed restrictions shall further state that no piers or docking facilities shall be constructed off Lots 1-
4 in the future, for as long as the permitted facility is in place. These deed restrictions shall be recorded
with the Brunswick County Register of Deeds, and copies of the recorded deeds provided to the
Division of Coastal Management, prior to the initiation of construction of the docking facility.
31) In accordance with requirements of the U.S. Army Corps of Engineers, an as-built survey shall be
performed on the docking facility, and copies of the survey provided to the U.S. Army Corps of
Engineers and Division of Coastal Management, within 60 days of completion of construction of these
portions of the project.
Upland Development
32) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated
with the construction of the uncovered deck and walkway, all as specifically set forth in the permit
application and depicted on the attached workplan drawings. Any additional land disturbing activities
and/or construction shall be evaluated on a case-by-case basis by a representative of the Division of
Coastal Management (DCM) to determine additional permit requirements. Contact a representative of
the Division at (910)796-7215 prior to the commencement of any such activity for this determination.
Cultural Resource Protection
33) The project site is located in an area having a high probability of containing cultural resources, such as
shipwreck remains. If such materials are encountered, the permittee shall immediately stop work and
notify the District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910) 251-4629, and
the N.C. Division of Coastal Management at (910) 796-7215.
General
34) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
35) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
06-0053v2.

SAW-2009-00586-071 which was issued on 5/19/09.
