The owner feels they have vested rights as it relates to the current Neuse Buffer Requirements. The owner has made substantial expenditures in good faith on their residential property and subsequent upkeep. Their subdivision, Section One Club Terrace (recorded in PB 21 Page 221) was recorded in 1990, prior to the adoption of the Neuse Buffer rules. The owners purchased the property in 1994, prior to the adoption of the Neuse Buffer Rules as evident in attached deed. There exist a detriment in the ability to enjoy their property at its fullest; due to the fact that since the property was purchased it has become encumbered by a Neuse Buffer. Therefore, we would like to build the proposed structure and adjacent walk in the Neuse Buffer (Zone 2) without complying with the new rules because of our vested rights. Additionally, it appears that the buffered ditch is eroding part of the bank on the subject property. Lastly, our lot seems to be one of the more "shallower" lots adjacent to the buffer in the subdivision.
