We are submitting payment for the assessed penalty of Case #DV-2018-0059. We have
responded to the Notice of Intent Tracking # NOV-2018-DV-0184 on July 2, 2018 which is
attached for the record. We assure you Union County takes sanitary sewer overflows seriously
responding as quickly as possible should they occur as well as committing significant financial
resources to upgrade our facilities and conduct I&I evaluations. If further information is

Dear Mr. Basinger:
Union County has received the NOV referenced above for collection system overflows.
Explanations of the overflows were on the BIMS Overflow Reporting Forms submitted by Union
County Public Works (UCPW)to the NCDEQ. However, we have added a few additional facts
in the explanations below:

The SSO is a result of heavy rain impacting our collection system
causing the WRF lift station and associated collection system to
become overwhelmed.The pumps at the CCWRF influent lift station
were running at max capacity,however with the rainfall and I&I the
collection system upstream was surcharged.Once the rain and
flooding receded,the collection system recovered shortly thereafter.
201800735 5/16/2018 4004 Sardis Church Union County Public Works has underwent a comprehensive Master
201800823 5/29/2018 Road(Across from CCWRF) Plan(Black&Veatch)and improvements strategy in efforts to better
identify areas of improvement within the Crooked Creek basin.
Efforts such as smoke testing,manhole inspections,flow monitoring
studies(CDM Smith/Hydrostructures and Frazier Engineering)to
identify areas of inflow and infiltration,capacity assessments of the
CCWRF and associated lift stations,and lift station assessments to

As a result of these studies, UCPW has developed a CIP plan to
address certain areas of concern.
• CCWRF is undergoing a significant plant upgrade which
includes new headworks,a 3MG EQ basin,and process
improvement. Total cost is$7.775M that includes
constructing a new 10.3 MGD influent PS,new headworks
containing new bar screens,compactor,and grit
removal/dewatering,3MG EQ basin,and relocation of 1200'
of 18"gravity sewer.CDM Smith is the design engineer.
MB Kahn is the general contractor.
o Partial Substantial Completion of the plant
upgrades was issued on June 27,2018
• 3 MG EQ basin is online
• New in-plant lift station is online
• Headworks including new bar screens,
compactor,and grit removal,is online
o The relocation of 1200'of 18"gravity sewer is
scheduled to begin September 2018 with
completion by October 2018.
• I&I flow studies have been conducted by CDM Smith
(Hydrostructures)and Frazier Eng. These studies have
narrowed the basin into concentrated sub-basins to target
I&l reduction.The resulting investigations determined a
point repair list of the system.
o 5/31/2018-RFP for I&l Sewer Repair and Rehab
Services was issued.
o 6/21/2018- UCPW received and reviewed
proposals from two firms(Bionomics and AM-
Liner)
o 6/28/2018-UCPW is currently in contract
negotiation with AM-Liner with a notice to proceed
to be issued soon.
In addition to the information provided above, the event that occurred on May 29, 2018 (Incident
#20180023) resulted from large amounts of rain during a Severe Natural Condition. The severe
natural condition was ratified by an issuance of Executive Order No. 44 declaring Union County,
NC in a State of Emergency by Gov. Roy Cooper.
UCPW has an aggressive Capital Improvement Program throughout the next 5 years. The
projects include:
> Crooked Creek Basin Improvements-$24,259,922.00
> Crooked Creek Interceptor Improvements Ph. 1 -$9,915,500.00
Suburban Estates PS and FM -$1,000,000.00
➢ Waxhaw Interceptor—3,200,000.00
•
> WW PS Improvements-$3,600,000.00
> Collection System SSES & Rehab—$2,080,000 (not including $85k annually in
Operations)
> PS Upgrades-$300,000 annually

UCPW's current CIP projects are also ongoing with projects including:
> Waxhaw Sewer Improvements-$295,000.00
> Blythe Creek Sewer Improvements-$3,083,200.00
• Forest Park PS Replacement& Interceptor Improvements-$2,540,000.00
> Crooked Creek I&I Study& Remediation -$2,538,300.00
> Suburban Estates PS replacement-$933,000.00
Union County Public Works continues to invest funds into SSES work, capital improvements,
maintenance and operations to improve the wastewater collection system. If further information
or details regarding the CCWRF Improvements, as well as, the CIP projects listed above are
