Dear Mr. Crisp:
On June 5, 2009, the Division of Water Quality (DWQ) received your application dated June 5, 2009, to fill
or temporarily impact 110 linear feet of intermittent stream, and permanently impact 6,600 square feet of
Zone 1 Neuse River basin protected riparian buffers and 2,200 square feet of Zone 2 Neuse River basin
protected riparian buffers, to install a waterline at the site. On June 17, 2009, the DWQ received your
response to our June 11, 2009, "Request For More Information" correspondence. Your responses to the
requests (restated below) from that correspondence were inadequate.
Please indicate all stream impacts including all fill slopes, dissipaters, and bank stabilization on
the site plan.
2. Please provide a restoration/bank stabilization plan, including a planting plan, cross-section (not
included), and longitudinal views (not included).
3. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing
Zone 1 and Zone 2.
For these reasons your permit application is hereby considered returned. Once you have redesigned
your project to address the problems and inadequacies with your application as it was submitted, you will
need to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity
and any work done within waters of the state would be a violation of North Carolina General Statutes and
