SW103340 Does the Stormwater Management Program describe the mechanism (ordinance or other regulatory
mechanism) the permittee will use to effectively prohibit illicit discharges into the MS4 and why the
permittee chose that mechanism?
Yes
Comments:Prohibition of illicit discharges shall be formalized via inclusion in the homeowner's documents.
SW103350 Does the Stormwater Management Program describe the permittee's plan to ensure appropriate
enforcement procedures and actions such that the permittee's illicit discharge ordinance (or other
regulatory mechanism) is implemented?
Yes
Comments:All homeowners document, community documents, and deed restrictions are enforceable,
ultimately via court action. The management of Sandy Point will issue notices of violation, where
necessary, without the court's involvement in order to bring violators into compliance.
SW103360 Does the Stormwater Management Program describe the permittee's plan to detect and address illicit
discharges to the permittee's system, including discharges from illegal dumping and spills?
Yes
SW103370 The permittee must implement an inspection program to detect dry weather flows at system outfalls and,
at a minimum, must address the following:

SW103620 The permittee may also develop a list of other similar occasional, incidental non-storm water discharges
that will not be addressed as illicit discharges.
SW103630 These non-storm water discharges must not be reasonably expected (based on information available to
the permittees) to be significant sources of pollutants to the Municipal Separate Storm Sewer System,

responsible person or position for implementation?
Yes
Comments:All of these elements are outlined in the Coastal Stormwater Permit for each Phase of

mechanism and the program to address post-construction runoff from newly developed areas and
redevelopment projects. All of Sandy Point fall under the maintenance responsibility of The Fund
for Sandy Point North Carolina, LLC.
SW104920 The permittee's ordinances, and subsequent modifications, will be reviewed and approved by DWQ prior
to implementation. The approval process will establish subsequent timeframes when DWQ will review

management program, does the permittee's Post-construction Stormwater Management Program equal
or exceed the stormwater management and water quality protection provided by the following model
practices:
SW105570 Does the permittee issue local stormwater management permits to new development or redevelopment
projects as either a low density project or a high density project?
Not Applicable
Comments:All infrastructure will ball under the coverage of NCDENR Coastal Stormwater Permits for each
phase. All other construction (homes on individual lots, etc.) will be required to conform to the
Construction Specifications and Stormwater Maintenance Specifications for Sandy Point which
have been reviewed and approved by NCDENR.

SW105580 Do projects permitted as a low density projects meet the following criteria:
Not Applicable
Comments:Upland construction has not yet begun. No infrastructure exists at this time. When low-density
areas of the west side of Sandy Point are permitted, they will conform fully to low density
requirements.

phase will also adhere to the same requirements.
SW105620 The stormwater control measures control and treat the difference between the pre-development and
post-development conditions for the 1-year 24-hour storm. Runoff volume draw-down time must be a
minimum of 24 hours, but not more than 120 hours;

Comments:Upland construction has not yet begun. No infrastructure exists at this time. There are a series of
covenants, as outlined in this report and as required by stormwater permits, current and future, that
will be incorporated into ownership document for each property within Sandy Point.

Not Applicable
Comments:As a "New Urban Waterfront", Sandy Point is permitted to build within the 30 foot buffer with
appropriate stormwater infrastructure and management practices. This NPDES permit is a part of
these requirements which allow the construction within the buffer. All stormwater requirements of
the "New Urban Waterfront" rules have been satisfied.

specific to the development.
SW105680 Areas within the jurisdictional area of the permittee that are already subject to the existing state
stormwater management programs are deemed compliant with the post-construction stormwater
management model practices identified in (a). The programs are: the Water Supply Watershed
protection programs for WS-I – WS-IV waters, the HQW and ORW waters management strategies, the
Neuse River Basin Nutrient Sensitive Waters (NSW) Management Strategy, the Tar-Pamlico River Basin
Nutrient NSW Strategy, and the Randleman Lake Water Supply Watershed program.
35Page Number:
SW105690 A regulated entity may develop its own comprehensive watershed plan, use the model ordinance
developed by the Commission, design its own post-construction practices based on the Division’s
guidance and engineering standards for best management practices, or incorporate the
post-construction model practices to satisfy, in whole or in part, the requirements for post-construction
stormwater management.
SW105700 Additional Requirements for Trout Waters: Has the permittee developed, adopted, and implemented an
ordinance (or similar regulatory mechanism) to ensure that the best management practices selected do
not result in a sustained increase in the receiving water temperature?
Not Applicable
SW105710 Additional Requirements for Nutrient Sensitive Waters
SW105720 Has the permittee developed, adopted, and implemented an ordinance (or similar regulatory mechanism)
to ensure that the best management practices for reducing nutrient loading is selected?
Yes
Comments:BMP's for the entire development fall under the permitting requirements for each phase of the
development and will be reviewed and approved by NCDENR.
SW105730 Has the permittee developed and included a nutrient application (fertilizer and organic nutrients)
management program in the Post-construction Stormwater Management Program?
Yes
Comments:Initial fertilization in order to establish vegetation is covered in the Sandy Point Construction
Specifications. Common areas will be maintained by a landscape professional hired by The Fund
for Sandy Point. BMP's will be maintained in accordance with the maintenance requirements
approved by NCDENR with each phase of construction. Maintenance of individual lawns will be left
up to the homeowner, but proper fertilization techniques will be a component of the public outreach
and education efforts as outlined earlier in this report.
SW105740 In areas where the Environmental Management Commission has approved a Nutrient Sensitive Water
Urban Stormwater Management Program, the provisions of that program fulfill the nutrient loading
reduction requirement.

SW105770 Does the Stormwater Management Program list the permittee’s municipal operations that are impacted
by this operation and maintenance program?
Yes
SW105780 The permittee must also include a list of industrial facilities the permittee owns or operates that are
subject to NPDES Stormwater General Permits or individual NPDES permits for discharges of storm
water associated with industrial activity that ultimately discharge to the permittee’s MS4, including the
