REGAN Secretary LINDA CULPEPPER Interim Director Mr. George Howard Restoration Systems, LLC 1101 Haynes St, Ste 211 Raleigh, NC 27604 NORTH CAROLINA Environmental Quality August 23, 2018 DWR Project #: 2010-00990 Wayne County Re: Neuse Riparian Buffer and Nutrient Umbrella Mitigation Umbrella Banking Instrument (UMBI) Pancho Bank Parcel Credit Release - Task 8 partial Dear Mr. Howard: On December 19, 2017, the Division of Water Resources (DWR) received a Year 5 Monitoring Report from Restoration Systems, LLC (RS) for the subject site. On March 28, 2018, Katie Merritt with DWR, along with Raymond Holz with RS, visited the site to compare vegetation data and evaluate the site's conditions for closeout of the monitoring requirements. No encroachment was observed within the easement boundaries which were clearly marked. Additionally, site conditions were good and vegetation data results showed stem densities higher than the required 320 stems/acre throughout most of the site. However, Ms. Merritt does not support closing out the site for further monitoring. An area of concern (AOC) close to one (1) acre was observed around plots 11 and 12 (see map attached). In this area, Ms. Merritt noted that herbaceous cover was either minimal or absent, most of the trees were stunted and with low vigor, thus, generating little to no potential for tree canopy at maturity. Ms. Merritt documented her findings along with pictures in correspondence to Mr. Holz on June 15, 2018 in which she requested that RS propose some level of intervention in the AOC to allow more opportunity for stormwater infiltration and treatment due to the areas being dedicated to nutrient offset credits. On July 23, 2018, RS responded to this request by providing a preliminary remediation proposal. Ms. Merritt documented her concern regarding the level of intervention RS was proposing within the AOC to establish ground cover. On August 2, 2018, RS submitted a final "Remedial Action Plan" to Ms. Merritt indicating the following: 1. No replanting within the AOC would be provided 2. Temporary and permanent ground cover would be established within the AOC in Fall 2018 Additionally, RS has renewed the monitoring bond (#22BSBGQ8686) for this site. This bond will expire on January 14, 2019, and could cover maintenance activities necessary on the subject site. Lastly, on June 15, 2018, RS provided confirmation that the conservation easement for the subject bank has been successfully assigned to the NC Wildlife Habitat Foundation (NCWHF). The NCWHF is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this mitigation bank. DWR is issuing a partial credit release for successfully assigning the conservation easement, for submitting a Remediation Action Plan, and for renewing the performance bond. When completed, RS must provide written notification that the Remedial Action Plan has been fully implemented within the AOC. Ms. Merritt must perform an onsite visit of the AOC to confirm whether the plan was successful at establishing temporary and permanent herbaceous cover prior to the issuance of the final credit release. According to the UMBI signed on March 17, 2008, the following additional Project Milestones have been partially met, and the corresponding credits shall be released: Task/Milestones Credit 8) Submit Monitoring Report #5 to DWR (partially meets success criteria) 2.5% By copy of this correspondence, DWR confirms that you have partially satisfied the above requirements for the above -referenced tract and 2.5% of your Neuse riparian buffer credits (0.025 x 218,671.2 ftz = 5,466.78 ft2) are now available for sale. Additionally, 2.5% of your nitrogen nutrient offset credits (0.025 x 25,753.31 lb -N = 643.83 lb -N) are now available for sale. Please update your credit ledgers accordingly. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Neuse River Basin excluding the Falls Watershed. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin according to guidelines in 15A NCAC 02B.0295 which became effective on November 1, 2015.
