Lumina Avenue, Wrightsville Beach, NC 28480 Authorizing development in County at Banks Channel, 410 and 330 Waynick New Hanover Blvd., Wrightsville Beach, as requested in the permittee's application dated revised 11108, including the attached workplan drawings (9), 1-3 of 9 dated revised 12/15/08, 4-8 of 9 dated revised 11/08 and 9 of 9 dated 7/8/08 This permit, issued on June 5, 2009 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 2) No vegetated wetlands shall be excavated or filled without permit modification. 3) No excavation shall take place at any time outside of the alignment of the area indicated on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. NiM"?^rCUn..n ._a: } Carolina Yacht Club c/o Paul Rhinehart Permit #.69-09 z Page 2 of 3 ADDITIONAL CONDITIONS Spoil Disposal/Estuarine Beach Renourishment 4) All excavated materials shall first be placed iii a barge and allowed to prcperI dewater before being placed in the estuarine beach renourishment area. 5) All excavated material to be placed into the estuarine beach renourishment area shall be confined behind a turbidity curtain installed between the estuarine beach renourishment area and the existing sound to prevent spillover of solids into any surrounding waters. A 24 hour period after completion of renourishment shall elapse prior to removal of the turbidity curtain to prevent unnecessary siltation into the adjacent waterbody. 6) The area designated for beach renourishment and the turbidity curtain shall be inspected and approved by a representative of the Division of Coastal Management prior to the beginning of any dredging activity. Wooden Groin 7) Authorization to construct the groin to the dimensions proposed was based in part on the amount of material proposed to be placed on the recreational beach, as well as the resulting normal high water line. Additional coordination with the Division shall be required should the amount of material paced on the beach be significantly less than that proposed in the permit application package, or should the resulting normal high water line be significantly landward of the anticipated location depicted on the attached workplan drawings. 8) The permitted groin shall be constructed to the dimension and specifications shown on the attached workplan drawings. 9) No portion of the groin shall extend more than l' above the normal high water level. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized groin. General 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. Carolina Yacht Club c/o Paul Rhinehart Permit # 69-09 Page 3 of 3 ADDITIONAL CONDITIONS 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 15) The federally endangered West Indian manatee (Trichechus manatus), has been reported in North Carolina waters. In order to protect the manatee, all work should be done between November 1 and May 31. If work must be done outside of this time frame, the permittee shall adhere to enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina". 16) No vegetated wetlands shall be excavated or filled, even temporarily. 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No. 01-1797v2. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id.
