Dear Mr. Shaver and Ms. Steenhuis:
The North Carolina Department of Transportation plans to replace existing 54" RCP at location Lat:
34.896212, Long: -78.227230 on SR 1004 Union School Road 1.0 miles North of SR 1147 (Old Camp
Road) with (1) @ 72" CMP w/Headwalls (See Attached Documents). NCDOT would like to request a
waiver from the depth specifications of the regional conditions 3.6.1 of the Nationwide Permit 3 and the
corresponding General Condition 11 of the Water Quality General Certification No. 4132. Due to the
existing geomorphologic fall of the stream channel, burying the inverts of the 72" CMPA 1' would result in
a 4 percent pipe slope, causing a high flow erodible condition. NCODT plans to place the pipe on a 3
percent slope leaving a LS' fall on the outlert end. Due to the 1.5' fall on the outlet end, 5 LF of additional
rip rap is proposed to be placed in the stream channel to protect from scour and destabilization.
(See Attached Permit Drawing).
By copy of this letter and enclosures, NCDOT is requesting issuance of Nationwide 3 approval from the US
Army Corps of Engineers and 401 Water Quality Certification (WQC) #4132 approval from the Division of
Water Resources (DWR). A method of debiting $240 to process the WQC request has been provided as noted
in the subject line of this application.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information
about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database, indicates that there are
no records for rare species, important natural communities, natural areas, and/or conservation/managed areas
within the proposed project boundary. Please note that although there may be no documentation of natural
heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have
been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists.
In the event that rare species are found within the project area, please contact the NCNHP so that we may
update our records.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that have been
documented within a one-mile radius of the property boundary. The proximity of these records suggests that
these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of
natural areas and conservation/managed areas within a one-mile radius of the project area, if any, are also
included in this report.
If a Federally-listed species is found within the project area or is indicated within a one-mile radius of the project
area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. Contact
information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation planning, project
review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions.

NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP
data may not be redistributed without permission.
The NC Natural Heritage Program may follow this letter with additional correspondence if a Dedicated Nature

ACTIVITIES EXEMPT FROM THE PROGRAMMATIC AGREEMENT
The acrivities in Appendis C are exempted from further review, provided the undertaking meets all of the following conditions:
• is limited to the activities specified;
• is not part of a largex undertaking;
• is not questioned by the owner of a historic property;
• has no known public controversy based on historic preservation issues; and
• is classified as a"categorical exclusion" (or state-equivalent) project.
EXEMPT ACTIVITIES
• Mowing, seeding/reseeding, and other ground cover maintenance activiries;
• Installation or replacement/repair of fixed static signs, interconnection devices, surveillance cameras, closed circuit TV and other
minor incident management devices, xailroad warning devices, and improved rail cxossing surfaces;
• In-kind replacement, reconstruction, or ordinary repair or modification of e�sting lighting, guardrails, modern fencing, traffic
signals, curbs and gutters, sidewalks, and variable message signs;
• Acrivities that do not involve construcuon or ground disturbance, such as preliminary engineering, training, technical studies,
non-invasive inspections, and educational programs;
• Overlay, milling, grooving, repairing (concrete or asphalt patching or slurry seal), striping, or resurfacing of e�cisring ramp,
roadway, and parking lot surfaces where there will be no new impacts outside an e�sring faciliry; rumble strips, loop detectors,
pavement markings (normal and raised), and snow and ice detectors to the same;
• Acrivities within the e�sting disturbed median, including installarion of new or replacement median barriers or guaxd rail;
• Modernization of an e�sting transpoxtation faciliry by widening less than a tsavel lane or adding lanes, provided such widening
does not extend beyond the limits of existing improved right-of-way (includes shoulder additions to roadways, bridge
approaches, turn lanes within the existing improved faciliry);
• Correcting substandard roadway geometrics and intexsections (i.e., spot improvements), provided such corrections do not extend
beyond the limits of e�sting improved right-of-way;
• Minor bridge rehabilitauon, bridge rails, or substructure alterauons where the work is confined to the bridge itself, and
a. rhe bridge is no older than 45 years at the date of NCDOT's project review, or
b. the bridge has been determined ineligible for the National Register of Histoxic Places;
• Minor safety related drainage improvements, including but not limited to: installarion, replacement or removal of culverts and
headwalls; installation, replacement and extensions of pipes; and addition of pipe end secuons;
• Rourine cleaning, maintenance and xepaix of e�sting dxainage, stormwater management, and watex quality faciliries and devices,
not including projects that seek to expand or extend such facilities;
• Replacement/relocation of existing underground utilities in kind and within e�sting footprint and replacement/relocation of
existing utiliry poles between edge of e�sting improved right-of-way and road;
• Repair of erosion control and pxotection measures, including but not limited to: slope stabilization, slide repair, rip rap, ox
retaining walls and new construction of such devices within e�cisting improved right-of-way;
• Rehabilitation of existing at-grade railroad crossings and installauon or upgrade of regulatory signs and railroad warniug signs
and devices, upgrade of advisory signs, and track and rail bed maintenance, provided there is no change in grade;
• Construction of bicycle and pedestrian lanes, paths, pedestrian signal heads, and facilities, and multi-use paths and facilities
provided such construcuon does not extend beyond the limits of e�sung improved right-of-way;
• Construcuon of ox improvements to rest areas, truck weigh stauons, park and ride lots, and other transportation related
maintenance, storage, and office facilities, where no new right-of-way is acquired;
• Landscaping on fill-slopes and back-slopes;
• Disposal of excess state-owned properties;
• Other minor actions if deemed appropriate fox coverage under this PA by consultation and mutual written agreement between
NCDOT and HPO/OSA.
