APPROVAL OF STORMWATER MANAGEMENT PLAN

On April 23, 2009, the Division of Water Quality (DWQ) received a courtesy copy of an application (dated
April 17, 2009) to fill or otherwise impact 0.06 acre of headwater wetland. As required by Condition 12 of
General Certification 3705 (corresponding to Nationwide Permit 18), this project requires a stormwater
management plan designed in accordance with state standards to remove a minimum of 85 percent TSS
from the stormwater generated by this project. As a part of the application, a stormwater management plan
that includes a Wet Detention Basin was submitted.
The DWQ has reviewed the stormwater management plan and has determined that it has been designed in
accordance with the current NCDWQ BMP Manual, and thereby approves the stormwater management
plan with the following conditions:
The entire stormwater management system consisting of the modified Wet Detention Pond and
all other BMP devices that were previously approved on November 21, 2008 and their associated
appurtenances, stormwater conveyances, the grading and drainage patterns depicted on the
respective plans, as approved by this office must be maintained in perpetuity. No changes to the
structural stormwater practices shall be made without written authorization from the Division of
Water Quality. The stormwater management structures shall have maintenance access and at
least a 10-foot drainage easement on each side to allow for the ability to maintain the structures,
and to perform corrective actions. The stormwater easements shall be recorded to provide
protection of the structures from potential alterations by future property owners.
2. All stormwater management devices shall be inspected and maintained in accordance with the
signed and notarized Wet Detention Basin Operation and Maintenance Agreement.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
