Thanks Monte. This land is a managed gamelands and we cannot legally use it
for commercial purposes but only for silviculture and forest maintenance.

Yes, the excemption is for the 404 also. You must minimize the impact as
much as possible and use the roadway for normal silviculture operations. If
conditions change so that you no longer use it for timber (i.e. subdivision,
etc.) then it must be removed or permitted.

I thought the 33 CFR 323.4 (a)(6) applied only to the 401. Does this exempt
this crossing from the 404? The stream crossing meets the criteria.

I apologize, your email became buried in my list of things to get back to.
The exemption you mention is completely up to Monte to determine if this
project qualifies. If it does, then no NWP 14 is even necessary. If Monte
determines that a NWP 14 is necessary, then a corresponding DWQ written
certification will be required from me.
