This permit, issued on 101 /lo , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) There shall be two additional culverts 36" in diameter added through the roadway between the bridge and station 15 on the Brunswick County side of the creek to help equalize waterflows in swamplands on either side of the new fill road. (2) Unsuitable muck to, be removed for construction on the new alignment should be stockpiled for use after removing the old road bed. The old road bed should be removed below existing wetland elevations and then backfill6d with the unsuitable muck to provide a suitable topsoil. (3) Water oak (Quercus nigra), cypress (Taxodium distichum), and water tupelo (Nyssa aquatica see ings shall be transplanted in t e restored area. (4) The ditch on the western side of the road in Columbus County contains a rare pygmy sunfish (Elassoma new species). Therefore, a temporary barrier shall be placed in t eownstream end of the ditch bottom adjacent to the point that construction modifications will start (near station 33). The new 20-foot wide flat bottom ditch then would be constructed in such manner (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or , project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Dept. of Transportation ADDITIONAL CONDITIONS Permit #200-86 Page 2 of 2 that a permanent barrier at or near the entrance to Juniper Creek would retain about 3 feet of water in the ditch on a permanent basis when the project is completed and the temporary barrier is removed. The permanent barrier shall be situated such that water will be retained in as much of the modified and unmodified portions of the ditch as possible following completion of the project. NOTE: The planning of the new bridge should be closely coordinated with U. S. Fish and Wildlife and N. C. Department of Agriculture Plant Protection Section to avoid unnecessary impacts to the plant sea pink (Sabatia kennedyna) found growing in the area; and with the N. C. Wildlife Resources tommim ssion in consultation with the Division of Coastal Management to discuss protection measures for the rare sunfish found at the site. NOTE: The permittee and/or his contractor is urged to meet with representatives from the local field office at DCM to discuss the permit conditions. Telephone (919) 256-4161. NOTE: Stringent erosion and sedimentation control techniques should be used at all times. Failure to utilize such techniques could result in significant adverse impacts on fisheries resources in Juniper Creek. Department of Transportation pursuant to an application filed on the 13th day-of March, 1986 to construct a new bridge for S.R. 1333 to replace existing bridge. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Juniper Creek in conjunction with the proposed new bridge in Brunswick County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That silt fences and other erosion control measures shall be in place prior to beginning earth moving for the project. 3. That fill material be clean material from an upland source and free of any toxic material. 4. That the side slopes of the filled areas be stabilized with vegetation as soon as possible to prevent erosion. 5. That silt fences be in place before the wetland restoration work begins. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. D.O.T. - Bridge #88 S.R. 1333 Juniper Creek Brunswick County The applicant proposes to fill 1.02 acres of wetland while restoring 1.2 acres of wetland. The purpose is to replace Bridge #88 on S.R. 1333,,the new bridge would be approximately 50 feet west of the existing bridge. The wetlands are adjacent to Juniper Creek, classified S Swamp. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project will require 401 certification for the filling of the wetlands. The certification should contain the following conditions: a. That silt fences and other erosion controls be in place prior to any earthen movement associated with the project. b. That all the fill material be from a clean upland source; free from any toxic material. c. That the turbidity in Juniper Creek not exceed 50 N.T.U. due to the project. d. That the side slope of the filled areas be stabilized with vegetation as soon as possible to prevent erosion. 2. Prior to restoration of the wetlands that silt fences be in place. The existing roadway measures about 40' in width with a 24' asphalt surface. Two large V ditches (borrow ditches) run parallel to the road and measure about 12' in width. Extensive wooded swampland follows the run of Juniper Creek on both sides of the main branch which is comprised predominately of water oak (Quercus nigra), cypress (Taxodium distichum), black gum (N ssa aquatica); sweet gum (Liquidumbar styraciflua), and swamp red maple (Acer rubrum). Other segments of the relocated roadway will go through low elevation woodland comprised predominately of Loblolly Pine (Pincus taeda). The Juniper Creek channel measures 38' in width by -3'-4' in depth relative to the ordinary high water line (OHW). The existing bridge measures 310' in length and is 28' in width. The bottom of the existing bridge lies approximately 7' above the OHW. These waters are considered public trust waters and are classified as SC swamp water. 9(b) PROJECT DESCRIPTION: The N.C. Department of Transportation proposed to replace the existing bridge (#88) with a new 315' bridge just ±50' west of the existing structure. The ±1,700 linear feet of existing road bed will be removed off the wetlands. Approximately 6,550 cubic yards of this roadway fill will be excavated and removed to an approved upland disposal site. The roadway will be graded to preproject wetland grade elevations thus restoring 1.2 acres of wetlands. The bottom of the proposed new bridge will be approximately 8' above the OHW level. The span lengths for the proposed bridge are 45' with support pilings at least that far apart. Unlike the existing structure there will be no bent located inside the main channel. The bottom of the bridge will be at or above the 25 year flood discharge. There will be a new 1,600' by 36' fill road bed constructed ±50' west of the existing road. About 600 cubic yards of unsuitable muck will be excavated. About 1,800 cubic yards of fill will be placed in wooded wetlands. Total road fill will amount to 4,225 cubic yards. The waters are classified as C - swamp waters. 10. ANTICIPATED IMPACTS: The project as proposed will cause the placement of 1,800 cubic yards of fill below the OHW line and fill ±1.02 acres of wooded swampland in Brunswick County. There will be an additional 427 cubic yards of fill placed below OHW and fill .42 acres of wetland in Columbus County, which is not a CAMA county. Removal of the old road bed and fill road shoulders will account for a positive impact of restoring 1.2 acres of wooded swampland back to its original grade. A rare plant species known as sea pink (sabatia kennedyna) was found growing at the project site. NCDOT "Bridge No. 88" Page 3 It is hoped that the new bridge alignment will minimize impacts to this plant species. The bottom of the new bridge will be slightly higher than the old bridge and no bents will be in the main channel. This should improve navigation. Flooding impacts are anticipated for any storm greater than a 25 year storm whereby the entire bridge structure will be overtopped. There should be no stormwater impacts.
