Dear Mr. Melville:
Reference your application for a Department of the Army permit
to excavate a channel and basin on Hawkins Creek off the White Oak
River, Swansboro, Onslow County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary, as revised
plans must be reviewed and the authorization modified.

authorizing development in Onslow County at Hawkins Creek in Swansboro
as requested in the permittee's application dated 4/22/86 including
attached plat dated /4/1/86.
This permit, issued on (?! 1?6 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without the
prior approval of the Division of Coastal Management.
(2) The basin will be excavated from high ground waterward. An earthen plug
will be left between the basin and Hawkins Creek until excavation landward
of the. plug has been completed. To prevent unnecessary sediments from reaching
adjacent waters, 24 hours will be allowed to elapse before the plug is removed.
(3) Excavation will not exceed 2 feet below the elevation of mean low water (Ml_W).
(4) All excavated materials will be confined landward of the mean high water
(MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands.
(5) No excavated or fill materials will be placed at any time in any vegetated
wetlands or waters of the state.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
. This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989

agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) Resulting spoil material placed on highground behind existing bulkhead shall
be leveled and smoothed to conform to surrounding area and provided with
ground cover sufficient to restrain erosion.
(7) Adequate sedimentation and erosion control measures must be employed through-
out the project in order to reduce the possibilities of sedimentation reentering
the waterway.
NOTE: The project is certified under General Water Quality Certification #1272
issued by the Division of Environmental Management for bulkhead work.

9. Narrative Description
o
Mr. Robert Melville has recently purcliased Lot 19, Block D in Edge-
water Heights Subdivision which is located in'the Town of Swansboro
at 601 West Shore Drive on Hawkings Creek in Onslow County.
A private residence is situated on this one-half acre lot which is
well'stabilized with a wooden bulkhead measuring about 1310' long.
The land elevations slope gradually from aproximately a 5' eleva-
tion at the bulkhead to approximately 15' high above MSh near the-
City street.
The applicant proposes to excavate a boat basin in the high ground.
The area will measure 28' long into the hill by 22' wide. Because
of the shallow water depths in Hawkings Creek, all proposed dredging
?r*ill be limited to -21-on MLW. In order to connect to the naturally
occurring 2' water depth in Hawkings Creek, a funnel shaped entrance
channel is planned measuring 25' long by 40' wide. This will ensure
water depths of -2.2' in Hawkings.Creek. An extimated 176 cu.yds.
of spoil material will be generated by the proposed project. This
mixture of sand, mud and shell will be placed on the high ground
landward of the existing bulkhead line.
The project design also includes the construction of 78 lin.ft. of
wooden bulkhead around the.interior perimeter of the new boat basin.
10. Anticipated impacts
The onsite inspection revealed no coastal wetlands or submerged
grass beds are involved with the proposed project. In addition,
the proposed 40' x 25' channel passes nearby natural oyster beds.
-However, the SC waters'of Hawkings Creek and the extended area along
the IWW are closed to the harvesting of shellfish. This may be due
to the proximity of the Swansboro.wastewater treatment plant.
CAMA Review -
The 1981 LUP for Swansgoro was reviewed. The proposed project appears
to be consistent with the goals and objectives of that document where
the high ground property is classified as developed and the surface
waters as conservation.

Dear Mr. Parker:
Reference the application of Mr. Robert I. Melville for a
Department of the Army permit to excavate a channel and basin and
construct a bulkhead on Hawkins Creek off the White Oak River,
Swansboro, Onslow County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The basin will be excavated from high ground waterward.
An earthen plug will be left between the basin and Hawkins Creek
until excavation landward of the plug has been completed. To
prevent unnecessary sediments from reaching adjacent waters,
24 hours will be .allowed to elapse before the plug is removed.
b. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded vegetated wetlands.
c. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters of the State.
d. Excavation will not exceed 2 feet below the elevation of
mean low water (MLW).

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 12, 1986, for a
Department of the Army permit to excavate a channel and basin on
Hawkins Creek off the White Oak River, Swansboro, Onslow County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

The applicant proposes to excavate a boat basin in the high ground adjacent to
Hawkins Creek. The proposed basin measures 28' into the high ground, by
22' wide to a depth of -2' MLW. In addition a funnel shaped entrance channel
is proposed. The entrance channel would be dredged to a depth of -2.2'
MLW. The project is located adjacent to Hawkins Creek, classified SC.
The project has been reviewed to determine impacts to water quality. The
following comments are offered:
1. The project will require 401 certification, but should meet the conditions
for the general 401 certification for bulkhead construction.
2. No discharge from the spoils area to Hawkins Creek shall occur.
3. Any excess spoils that need to be trucked off site must be dried prior to
removal from site.
4. This office has no objections to this project providing the above
conditions are met.

Mr. Robert Melville has recently purchased
water Heights Subdivision which is located
at 601 West Shore Drive on Hawkings Creek
Lot 19, Block D in Edge-
in'the Town of Swansboro
in Onslow County.
A private residence is situated on this tine-half acre lot which is
well'stabilized with a wooden bulkhead measuring about 1310' long.
The land elevations slope gradually from aproximately a 5' eleva-
tion at the bulkhead to approximately 15' high above MSL near the
City street.
The applicant proposes to excavate a boat basin in the high ground.
The area will measure 28' long,,into the hill by 22' wide. Because
of the shallow water depths in Hawkings Creek, all proposed dredging
will be limited to -21-on MLW. In order to connect to the naturally
occurring 2' water depth in Hawkings Creek, a funnel shaped entrance
channel.is planned measuring 25' long by 40' wide. This will ensure
water depths of -2.2' in Hawkings Creek. An extimated 176 cu.yds.
of spoil material will be generated by the proposed project. This
mixture of sand, mud and shell will be placed on the high ground
landward of the existing bulkhead line.
The project design also includes the construction of 78 lin.ft. of
wooden bulkhead around the.interior perimeter of the new boat basin.
Anticipated impacts
The onsite inspection revealed no 'coastal wetlands or submerged
grass beds are involved with the proposed project. In addition,
the proposed 40' x 25' channel passes nearby natural oyster beds.
However, the SC waters'of Hawkings Creek and the extended area along
the IWW are closed to the harvesting of shellfish. This may be due
to the proximity of the Swansboro wastewater treatment plant.
CAMA Review -
The 1981 LUP for Swansgoro was reviewed. The proposed project appears
to be consistent with the goals and objectives of that document where
the high ground property is classified as developed and the surface
waters as conservation.
