Community Development letter to you of November 7, 1986, we were
informed that your application for State authorization to
construct a boat.ramp on the north side of the Atlantic
Intracoastal Waterway (AIWW), west of Holden Beach, Brunswick
County, North Carolina, was denied. Under the administrative
rules of our regulatory program, denial of required State
authorization precludes favorable consideration of a Federal
permit. Accordingly, your Department of the Army application is
hereby denied, and your file has been retired.

This letter is in response to your request for a permit under the Coastal
Area Management Act and State Dredge and Fill Law to construct a boat ramp on
the AIWW at the end of Canal Street, Fulford Estate Subdivision, Holden Beach,
N. C. Processing of your application, including onsite investigation, is now
complete.
Based on this review, the Division of Coastal Management has made the
following findings:
1) . Construction of the boat ramp would cause the direct removal of 192
square feet of productive Spartina alterniflora marsh. The project
site is also located in a functional shellfish area, currently open
for harvest.
2) Alternative sites, such as beside the new NC 130 bridge to Holden
Beach , are available for the boat ramp that would reduce the impact
to adjacent coastal wetlands.
3) It is doubtful that the ramp could be restricted to use by residents
of the Fulford Estate Subdivision and the potential for adverse
effects on the value and enjoyment of the property of any riparian
owners is significant.
4) Adjacent riparian property owners on either side of the Canal Street
site have filed objections to the proposed project.
5) The project, as proposed, is inconsistent with the following partial
listing of State Guidelines for Areas of Environmental Concern:
a) 15 NCAC 7H.0205(c). Management Objectives (for coastal
wetlands). This requires projects to give highest priority to

the protection and management of coastal wetlands so as to
safeguard and perpetuate their biological, social, economic and
aesthetic values; to coordinate and establish a management
system capable of conserving and utilizing coastal wetlands as
a natural resource essential to the functioning of the entire
estuarine system;
b) 15 NCAC 7H.0208(a)(2)(B). This standard requires that there be
no suitable alternative outside of the AEC for the project and
that the applicant select a combination of sites and design
that will have a minimum adverse impact upon coastal marshland,
and spawning and nursery areas; and
c) 15 NCAC 7H.0209(e)(4). This standard requires that development
(within the estuarine shoreline AEC) not have a significant
adverse impact on estuarine resources.
Given the foregoing findings, it is necessary that your request for
permits under the Coastal Area Management Act and the State Dredge and Fill
Law be denied. This denial is made under N.C.G.S. 113A-229(e)(5), which
provides for permit denial upon finding a significant adverse impact on
estuarine resources, N.C.G.S. 113A-229(e)(2), which requires permit denial
upon finding a significant adverse effect on the value and enjoyment of the
property of any riparian owners, G. S. 113A-120(2), which requires CAMA permit
denial when the project is found to be inconsistent with the State Dredge
and Fill Law, and, G. S. 113A-120(8), which requires denial of projects
inconsistent with the State Guidelines for Areas of Environmental Concern.
If you wish to appeal this denial, you are entitled to a quasi-judicial
hearing to challenge the factual findings or legal conclusions regarding this
denial. A hearing is similar to a trial, involving appearing before a hearing
officer who listens to the evidence and arguments of both parties and then
makes a recommendation to the Coastal Resources Commission. A decision by the
Commission, adverse to you, may be appealed in the Courts. Your request for
such a hearing must be in the form of a written petition, complying with the
requirements of Chapter 150B of the General Statutes of North Carolina, and
must be filed with the Office of Administrative Hearings, P. 0. Drawer 11666,
Raleigh, N. C. 27604. The request for a hearing must be submitted to the
Office of Administrative Hearings within twenty days of your receipt of this
letter. A copy of this petition should be filed with this office. Enclosed,
please find a petition which may be used for your request.
If you request a hearing, you have a choice of hearing officers, either a
hearing officer of the Office of Administrative Hearings, or a hearing officer
selected by the CRC (usually a member of the CRC). Unless you waive your
right to a hearing before the Office of Administrative Hearings, the hearing
will be conducted by a hearing officer of that agency. If you prefer to have
your hearing before a hearing officer of the CRC, you must sign the "Waiver"
contained in the enclosed petition form.

Also, you should be advised that as long as this State permit denial
stands, your project must be deemed inconsistent with the N. C. Coastal
Management program, thereby precluding issuance of Federal permits for this
project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives the
right to appeal this finding to the U. S. Secretary of Commerce, within 30
days of receipt of this letter. Your appeal must be based on the grounds that
the proposed activity is (1) consistent with the objectives or purposes of the
CZMA, (2) is necessary in the interest of national security, and thus, may be
federally approved.

Enclosed is the application of Mr. Thomas A. Johnson for a
Department of the Army permit and a State Water Quality
Certification to construct a boat ramp on the north side of the
Atlantic Intracoastal Waterway (AIWW), west of Holden Beach,
Brunswick County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by July 9, 1986, the District Engineer
will deem that waiver has occurred.

Dear Mr. Parker:
Reference the application of Mr. Thomas A. Johnson for a
Department of the Army permit to construct a boat ramp on the
north side of the Atlantic Intracoastal Waterway (AIWW), west of
Holden Beach, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to minimize adverse impacts on wetland
vegetation, the boat ramp will be a wooden structure, supported by
pilings, through its length where it spans the 16-foot-wide fringe
of cordgrass, (Spartina alterniflora).
b. The fill material, concrete, will be discharged into
tightly sealed forms.
c. Any material excavated to prepare the area for placement
of the ramp will be confined landward of the mean high water (MHW)
elevation contour and any regularly or irregularly flooded
vegetated wetlands.
d. The permittee's scheme of development, of which the
authorized work is a part, contemplates the presence of structures

and their attendant utilities on lands subject to an easement in
favor of the United States for the operation, maintenance,
r` improvement, and enlargement of the Atlantic Intracoastal Waterway
(AIWW). Accordingly, the permittee will be required to remove
such structures and improvements at his own expense in the event
that, in the judgment of the U.S. Army Corps of Engineers acting
on behalf of the United States, the lands are needed at any time
for any purpose within the scope of the easement. Permanent
buildings will not be constructed in areas subject to easement.
e. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
f. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 9, 1986, for a
Department of the Army permit to construct a boat ramp on the
north side of the Atlantic Intracoastal Waterway (AIWW), west of
Holden Beach, Brunswick County, North Carolina, indicates it to be
a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC086-N-010-0280 and will be coordinated by
Mr. Ernest Jahnke. He is available to address questions or

subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Thomas A. Johnson pursuant
to an application filed on the 4th day of March, 1986 to construct a
boat ramp at Fulford Estates Subdivision.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Atlantic
Intracoastal Waterway in conjunction with the proposed boat ramp in
Brunswick County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That concrete shall be placed during MLW with
the forms dewaters.
3. That silt screens be constructed completely around
the ramp construction area to minimize turbidity
impacts.
4. That the upland road remain as a dirt road.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

The applicant proposes to construct a private boat ramp within the
John E. Fulford Estate Subdivision located ±1600' west of the Holden
Beach Bridge along the AIWW, classified SA. The proposed ramp
construction measures 12' x 56' below the plane of MHW. The project
has been reviewed to determine impacts to water quality. The
following comments are offered.
1. The project will require 401 certification and should contain
the following conditions:
a. Concrete shall be poured during MLW with the forms
dewatered.
b. Silt screens shall be constructed completely around the ramp
construction area to minimize turbidity.
c. Turbidity in the receiving stream shall not exceed g_5 N.T.U.
as a result of the project activity.
d. The upland road shall remain a dirt road.
2. This office has no objections to this project providing the

8. Project summary The applicant wishes to construct a 12' x 56' concrete community boat
ramp at the end of Canal Street within the John E. Fulford Estate Subdivision located
±1,600 west of the Holden Beach Bridge along the AIWW.

9. PROJECT DESCRIPTION:
The project site is located at the end of Canal Street on the North side of the
AIWW approximately 1,600' west of the Old Holden Beach Bridge. It is within the
John E. Fulford Estate Subdivision. This is a 30' wide unimproved public street
which was dedicated by a plat of the property recorded in Plat Book 6, Page 130
in the Brunswick County Registry. The end of this small dirt road deadends along
an eroding 2'-3' escarpment. Automobile tires and wooden debris has been stock-
piled here to slow down the erosion rate. An existing bulkheaded lot borders the
roadway to the east and a vacant lot lies to the west.
Along the waterward portion of the project site lies a 3' band of woody glasswort
(Salicornia sue.) and a 16' wide fringe of cordgrass (Spartina alterniflora). The
intertidal area consists of fine sand. The site is a secondary nursery area and
the waters are S.A.
The applicant has been the self appointed spokesman for a segment of property
owners within this subdivision which desire a private boat access. Therefore,
they propose to build a 12' wide by 56' long concrete boat ramp out beyond the
MLW contour. Approximately 10 cubic yards of concrete will be poured in forms as
fill. The top of the ramp will tie into the existing grade of the dirt road
which is almost flat with a slight pitch towards the AIWW.
10. ANTICIPATED IMPACTS:
The project will fill approximately 192 s.f. of productive cordgrass marsh and
36 s.f. of woody glasswort. Also about 440 s.f. of intertidal habitat will be
distrubed. The ramp will border the property lines of the two adjacent riparian
owners. There may be some.acceleration of erosion at this location if the ramp
were permitted. Also the value and enjoyment of the adjacent riparian owners
may be an issue to consider. Certainly a boat ramp will encourage heavier
use of the site which may cause degradation of water quality.

Pursuant to NCGS 113A-119(b) and 143-215 3 (a) (1) (c) , the Department of
Natural Resources and Community Development hereby gives Public Notice
that Thomas A. Johnson
filed an application on April 10, 1986 for a permit from the
Divison of Coastal Management to develop in an Area of Environmental
Concern and for Certification from the Division of Environmental
Management that a discharge of fill material in project wetlands will
not violate applicable Water Quality Standards.

Enclosed is the application of Mr. Keith Edwin Johnson for a
Department of the Army permit and a State Water Quality
Certification to accomplish work associated with the
reconstruction and backfill of a bulkhead on Albemarle Sound,
Edenton, Chowan County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by May 21, 1986, the District Engineer
will deem that waiver has occurred.
