Dear Mr. Mayberry:
On October 9, 2006, the North Carolina Division of Water Quality (DWQ) received your application for a
General 401 Water Quality Certification to impact 3001inear feet of an unnamed tributary to South Buffalo
Creek located at 3219 Rehobeth Church Road in Greensboro, Guilford County. In order that we may
determine your project's compliance with 15A NCAC 2H .0500, please provide five (5) copies of the
following information:
1. ~ The stream impacts proposed in your application equal or exceed 150 linear feet of impact to
perennial waters. Therefore, compensatory mitigation will be required for the entire proposed
impact length to perennial waters of 300 linear feet. Please provide the Division of Water Quality
with information detailing how you will fulfill this mitigation requirement.
2. You have not demonstrated an adequate effort to avoid and minimize impacts to the onsite perennial
stream by considering alternatives to piping and placement of riprap. Other effective methods of
stream bank stabilization are available that do not require piping the stream and placing riprap in the
channel and on the banks. Please provide a description of your efforts to avoid and/or minimize this
impact by considering and evaluating alternative methods of bank stabilization.
Until the information requested in this letter is provided, I will request (by copy of this letter) that the U.S.
Army Corps of Engineers place this project on hold. Also, this project will be placed on hold for DWQ
processing due to incomplete information (15A NCAC 2H .0507(h)). The processing of this application
will begin when the requested information is received. Please be advised that if your proposed activity is
subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), you must also receive a Section 401
Water Quality Certification from the N. C. Division of Water Quality before you begin any work.
