Subject: REQUEST FOR ADDITIONAL INFORMATION
Autumn Lakes Subdivision — Phase 2 and 3
Dear Mr. Hansley:
On May 14, the Division of Water Resources (Division) received your application dated May 10,
2018, requesting a 401 Water Quality Certification from the Division for the subject project.
Additional information including a modified PCN was received on July 11, 2018. This
modification expanded the scope of the project to include Phase 3 which had additional
impacts. The Division has determined that additional information is required to process your
application, therefore this application is on -hold until all of the following information is
received:
1. Regarding the sewer crossing, the permanent maintenance corridor through the buffer
was stated to be ten feet in width. Please update the plans to reflect this. Specifically
sheet 4 of 8 (Impact Area A-2) shows a fifteen foot wide corridor through Zone 1 and 2
of the buffer and this is listed as "Conversion Impacts'. It's the Division's understanding
that this is permeant impacts for the establishment of a permeant maintenance corridor
in the buffer and should be ten feet in width based on your response to the July 10,
2018 letter requesting more information. Please clarify that this is the corridor that will
be maintained and its width. Also, please confirm that the areas in the buffer that are
shown as Temporary Impact Areas on the plan sheets will be allowed to re-establish
vegetation. Will this area be marked to show the difference between the permanently
maintained (mowed) corridor and the wider thirty foot utility easement?

2. The updated plans show impacts to buffers and streams for a greenway crossing of two
stream tributaries in Phase 3.
a. Please provide aside view drawing of the culverts showing their location in
relationship to the stream bed and bank, so that hydrological connection and
aquatic life passage during low flow can be assured. Please include the size of
the culverts.
b. Is the sewer shown on the northside the proposed greenway new or proposed?
If the sewer is in place, is there an existing maintenance corridor associated with
it?
c. On Impact Area C (sheet 7 of 8) no impacts area shown immediately adjacent to
the culvert. Please clarify what is happening in this area and why no impacts are
shown.
d. Please note the Division limits greenways to ten feet wide (as you've proposed)
with a two foot wide grassed maintenance corridor on either side.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested
information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC
27699-1617 OR by submitting all of the above requested information through this link:
https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (please note that the DWR#
requested on the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this
letter, the Division will be unable to approve the application and it will be returned. The return
of this project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
