KCI Associates of North Carolina, P.A. (KCI) has completed a jurisdictional stream and wetland
delineation on the above referenced project for the North Carolina Department of Transportation
(NCDOT). The attached information is submitted for your review and determination of
jurisdiction under the Clean Water Act.

Project Description & Methodology
As shown in Figure 1, B-5503 project is located in Martin County, NC. The study area lies
within the Tar-Pamlico River Basin (USGS Hydrologic Unit 03020103), and comprises
approximately 5.9 acres. The feld work for the delineation was performed on February 25, 2015
in compliance with methodology set forth in the USACE Wetland Delineation Manual (USACE
1987) and subsequent guidance. This included the use of the four stratum Wetland

Determination Form for the Atlantic Gulf and Coastal Plain (Version 2.0). Streams were
assessed for jurisdiction under the Clean Water Act using field indications of ordinary high water
mark and the NC Division of Water Quality (NCDWQ) Stream Identification Form Version
4.11. Wetland Determination Forms and NCDWQ Wetland Rating Worksheets were completed
for each type of wetland community encountered.
Delineation Results
Figures 2 and 3 present the resu(ts of the delineation, including sheams and wetlands. Figure 2
is presented using the Robersonville East (2013), US Geological Survey 1:24,000 Quadrangle
Map. Figure 3 is presented using 2012 NC statewide aerial photography. Figure 4 is presented
using the Martin County NRCS Soil Survey: Sheet 6.
Table 1 presents detailed information on each jurisdictional stream within the study area,
including status, bankfull measurements, length within the study area, NCDWQ and USACE
data form scores, and latitude/longitude. One jurisdictional stream measuring approximately 217
linear feet is present within the study area.
Table 2 presents detailed information on each wetland feature NC Wetland Assessment Method
type, Hydrologic Class, Cowardin Classification, isolated status, size, representative wetland
delineation form identification, NCDWQ wetland rating score, and latitude/longitude. A total of
3.70 acres of wetlands are present within the study area.
We request your review of the attached documentation and mapping, and issuance of a
Preliminary Jurisdictional Determination for this project. A copy of this information is also
being provided to the NC Division of Water Resources.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to fnal production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard-
copy submittals include at te�si one ori inal Plat t� sca1� that is n� lar er than � I"x 17"
(the use of match lines for lazger tracts acceptable). Additional copies of a plat, including
those larger than 11 "x 17", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
pla�s and return them via e-mail to the requestor.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
°pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatary mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a perrnit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any chaflenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Fu�ther, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit deniaf can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
