Authority
The Corps will evaluate this application and a decide whether to issue, conditionally
issue, or deny the proposed work pursuant to applicable procedures of Section 404 of the
Clean Water Act.
Location
The proposed site for Wendell Falls is approximately 1,300 -acres of contiguous land
located on the west side of Martin Pond Road (SR 2503), 2,600 feet north of the
intersection of Martin Pond Road and Poole Road (SR 1007) in Wendell, Wake County,
North Carolina (Latitude 35.7694 and Longitude 78.4221). The site contains unnamed
stream channels and adjacent wetlands which drain to Mark's Creek, a tributary in the
Neuse River Basin (Hydrologic Unit Code 03020201).
Existing Site Conditions
The existing site conditions for the proposed development contains approximately 195-
acrs of w�,-tls and 6. miles of stream channels. The wetlands are comprised of
headwater forest wetlands, naturalized beaver impoundments, wetland seeps, and
freshwater marshes. Vegetation within these wetlands is comprised of red maple (Acer
rubrum), tulip poplar (Liriodendron tulipifera), sweetgum (Liquidambar styraciva), tag
alder (Alnus serrulata), netted chain fern (Woodwardia areolata), possum -haw viburnum
(Viburnum nudum), lizard's tail (Saururus cernuus), and greenbriar (Smilax spp.). The
remaining upland areas are comprised of agricultural fields, pastures, and woodlands.
Vegetation within these areas is comprised of loblolly pine (Pinus taeda), tulip poplar,
black cherry (Prunus serotina), sourwood (Oxydendrum arboreum), dog fennel
(Eupatorium capillifolium), and other typical species. The U.S. Army Corps of
Engineers (Corps) has conducted site visits and has field verified the aquatic features
listed above.
Applicant's Stated Purpose
The project is to provide a variety of land uses including residential, commercial, office,
institutional, and park features. This mix of land use represents an attempt to achieve a
balance of community goals and market dynamics for the Wendell area and Eastern
Wake County. Increased transportation demands, within and around the project site,
would be accommodated by a proposed interchange with U.S. 64/264 and construction of
a major thoroughfare.
Project Description
The, proposed development would construct 4,000 residential dwelling units and
approximately 450,000 square feet of retail and office space. Nearly 160 acres of land
along'the Mark's Creek corridor and Lake Myra will be dedicated to Wake County for the
creation of a park.
Originally, the North Carolina Department of Transportation (NCDOT) proposed an
interchange with U.S. 64/264 at mile marker 427 and Knightdale Eagle Rock Road (SR
2501/2502), but has no immediate plans to construct this interchange. Therefore, the
applicant has incorporated this interchange into the project to handle the projected traffic
flows. The ramps, loops and Y -line for the proposed interchange would be confined by
the existing right-of-way that was previously acquired by the NCDOT. The typical
section for the deceleration ramp of the proposed intersection leading from U.S. 64/264 is
a 4 -foot paved shoulder section with a 16 -foot wide lane. The acceleration ramp leading
from SR 2501/2502 shows a curb -and -gutter typical section with a 20 -foot lane and 4 -
foot paved shoulders. The Wendell Falls thoroughfare would leave the interchange and
cross Mark's Creek via a proposed bridge as it enters the property.

The proposed thoroughfare would begin at the proposed interchange and terminate at the
intersection of Richardson Road with Wiley Oaks Road, just east of the existing
intersection of SR2502 and Martin Pond Road. Maps, showing each crossing are
available upon request.
The applicant is currently developing a compensatory mitigation package containing
possible. on-site preservation and payment to the North Carolina Ecosystem Enhancement
Program (NCEEP) to mitigate for unavoidable impacts to aquatic resources.
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate
State agencies for review. The Corps will generally not make a final permit decision
until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives
State certification required by Section 401 of the Clean Water Act (PL 92-500). The
receipt of the application and this public notice in the NCDWQ Central Office in Raleigh
serves as application to the NCDWQ for certification. A waiver will be deemed to occur
if the NCDWQ fails to act on this request for certification within sixty days of the date of
the receipt of this notice in the NCDWQ Central Office. Additional information
regarding the Clean Water Act certification may be reviewed at the NCDWQ Central
Office, 401 Oversight and Express Permits Unit, 2321 Crabtree Boulevard, Raleigh,
North Carolina 27604-2260. All persons desiring to make comments regarding the
application for certification under Section 401 of the Clean Water Act should do so in
writing delivered to the North Carolina Division of Water Quality (NCDWQ), 1650 Mail
Service Center, Raleigh, North Carolina 27699-1650 Attention: Ms Cyndi Karoly by
November 5, 2006.
Essential Fish Habitat
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the
Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial
determination is that the proposed project will not adversely impact EFH or associated
fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils
or the National Marine Fisheries Service.
Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic
Places and is not aware that any registered properties, or properties listed as being
eligible for inclusion therein are located within the project area. However, two areas (the
Richardson Farm and cemetery) that might contain archeological resources are located
near the project site. It has not yet been determined if these areas are within the permit
area for this project; however, the Corps will coordinate with the State Historical
Preservation Office regarding potential effects. Presently, unknown archeological,
scientific, prehistoric, or historical data may be located within the project area and/or
could be affected by the proposed work.
Endangered Species
The Corps has reviewed the project area, examined all information provided by the
applicant and consulted the latest North Carolina Natural Heritage Database. Based on
available information, the Corps has determined pursuant to the Endangered Species Act
of 1973, that the proposed project will have no effect on federally listed endangered or
threatened species or their formally designated critical habitat.
Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable
impacts, including cumulative impacts, of the proposed activity on the public interest.
That decision will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. All, factors
which may be relevant to the proposal will be considered including the cumulative effects
thereof, among those are conservation, economics, aesthetics, general environmental
concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain
values (in accordance with Executive Order 11988), land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of property
ownership, and, in general, the needs and welfare of the people. For activities involving
the discharge of dredged or fill materials in waters of the United States, the evaluation of
the impact of the activity on the public interest will include application of the
Environmental Protection Agency's 404(b)(1) guidelines.
Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials, including any consolidate State Viewpoint or written position of
the Governor; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any comments received will be considered by the
Corps of Engineers to determine whether to issue, modify, condition or deny a permit for
this proposal. To make this decision, comments are used to assess impacts on endangered
species, historic properties, water quality, general environmental effects and the other
public interest factors listed above. Comments are used in the preparation of an
Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS)
pursuant to the National Environmental Policy Act (NEPA). Comments are also used to
determine the need for a public hearing and to determine the overall public interest of the
proposed activity.
In addition, any person may request, in writing, within the comment period specified in
this notice, that an additional public hearing be held to consider the application. Requests
for public hearings shall state, with particularity, the reasons for holding a public hearing.

Requests for a public hearing shall be granted, unless the District Engineer determines
that the issues raised are insubstantial or there is otherwise no valid interest to be served
by a hearing.
Written comments pertinent to the proposed work, as outlined above, will be received
by the Corps of Engineers, Wilmington District, until 5pm, November 12, 2006.

interchange with US 64/264 to better serve access to the development. The proposed impacts consist of 2,191 linear feet of perennial
stream channel and 3.09acres of wetland impacts for roadway crossings & lot fill. An additional 720 linear feet of stream channel and
1-65 acres of wetlands will be temporarily impacted for the installation of a utility line. Following construction of the utility line, the
stream channel will be returned to pre -construction contours. Approximately 5 5 acres (ZI 3.52, Z2: 1.99) of riparian buffer will be
permanently impacted for roadways and greenway trails and 1 97 acres (Z 1: 1.36, Z2: 0.61) of buffer will be temporarily be impacted
for the installation of utility lines.

On behalf of Mercury Development, we are requesting Department of the Army
- authorization for stream and wetland impacts associated with the construction of a
residential/commercial development and an interchange on Highway 264 bypass.
We are also requesting 401 -certification and buffer compliance from the NC-DWQ.

the Neuse River Basin and contains unnamed tributaries to Mark's Creek. The water
quality classification for these features is C; NSW and the Stream Index #is 27-38.
The Hydrologic Unit Code for this basin is 030202o1.The project boundaries are
indicated on the attached USGS Quadrangle Map and the Wake County Soil Survey.
1.2) Existing Site Conditions
The property is approximately 1,3oo acres in size and contains un -named tributaries
to Mark's Creek. Existing conditions on site consist of agricultural fields, pastures,
and woodlands. Wetlands on site consist of headwater forest wetlands, beaver
impoundments, wetland seeps, and freshwater marshes. The site contains
approximately 195 acres of wetlands and 6.6 miles of stream channel. Vegetation
within the wetland areas consists primarily of red maple (Acerrubrum), tulip poplar
(Liriodendron tulipifera), sweet gum (Liquidambarstyraciflua), tag alder (Alnus
serrulata), netted chain fern (Woodwardia areolata), possum -haw viburnum
(Viburnum nudism), Smilax (Smilax spp.), and Lizard's tail (Saururus cernuus).
Upland vegetation consists of loblolly pine (Pinus taeda), tulip poplar (Liriodendron
tulipifera), black cherry (Prunus serotina), sourwood (Oxydendrum arboreum),
dogwood (Cornus florida), grape vine (Vitis rotundifolia), honeysuckle (Lonicera
japonica), and southern arrowwood (Viburnum dentatum). Within the fallow fields
early successional species such as dog fennel (Eupatorium capillifolium),
broomsedge (Andropogonsp.), and black berry (Rubussp.) were also observed.
Based on the Wake County Soil Survey, soils across the site consist primarily of
Appling sandy loam and Louisburg loamy sand within the upland areas. Wehadkee-
Bibbs and Worsham sandy loam soils are typically found in the wetland areas and
along the riparian corridor.
1.3) Project Description and Purpose
Wendell Falls Planned Unit Development proposes a variety of land uses including
residential, commercial, office, institutional and a county park. The assemblage of
land involved in this project will ultimately be annexed into the Town of Wendell.
The North Carolina Department of Transportation has proposed an interchange with
U.S. 64/264 bypass to serve this area of Wake County and ultimately Wendell Falls
as proposed. NCDOT has no immediate plans to construct this interchange therefore
Wendell Falls Development has taken the initiative to work with DOT to construct this
interchange in order to better serve the access to this development.
Upon completion, Wendell Falls will locate 4,00o residential dwelling units and
approximately 450, 000 square feet of retail and office space. 16o acres of land
along the Marks Creek corridor and Lake Myra will also be dedicated to Wake County
for the -creation of a park. The mix of land uses in Wendell Falls represents an
attempt to achieve a balance of community goals and market dynamics for the
growing Wendell area as well as Eastern Wake County. Wendell Falls will strive to
minimize stream impacts while also providing proper circulation ultimately preferred
by planning officials from the Town of Wendell. A well-designed circulation plan for a
site of this size is a main factor in justifying impacts to any waters of the U.S. These
impacts will be presented in more detail throughout the remainder of this document.
This project is privately funded by the development company and its investors and
while benefiting these private groups, will also benefit the Town of Wendell and
Eastern Wake County by providing new opportunities for residential and commercial
uses. Construction of the proposed interchange with U.S. 64/264 bypass creates a
major thoroughfare that will pass through Wendell Falls to points east of the site.
With a project of this size, vehicular circulation is crucial in providing a hierarchy of
routes between all site uses. With the proposal of other vehicular routes (other than
the thoroughfare), impacts must be addressed to provide the proper circulation
throughout the development.
The intersection and bridge project consists of a grade -separated interchange with
SR -2501/2502, (Knightdale Eagle Rock Road) and US 64/264. The ramps, loops and
Vine for the proposed interchange will be confined by the existing right-of-way that
was previously acquired by the state of North Carolina. The typical section for the
deceleration ramp of the proposed intersection leading from US 64/264 is a 000t
paved shoulder section with a 16 -ft wide lane. The acceleration ramp leading from
SR 25o1/SR 2502 has a curb -and -gutter typical section with a 20 -foot lane and 000t
paved shoulders. The urban arterial leading from the US 64/264 intersection to the
intersection of Martin Pond Road and Richardson Road will consist of four, 12 -ft
lanes with 000t paved shoulders. The approaches to the proposed bridge will be a

curb -and -gutter section with a 20 -ft raised median. All other sections will have
shoulders with a 4o -ft raised median.
The purpose of the proposed interchange is to fulfill transportation demand through
improved accessibility to the US 64 Bypass and by increasing the capacity of the
existing roadway system. Increasing capacity conforms to the Wake County
Transportation Plan, and is needed to accommodate community growth and its
related traffic increases. Currently, Wendell Boulevard serves as the only entrance
into Wendell off of US 64. Traffic volumes in 2030 on this facility are projected to be
double of current traffic volumes. In addition to providing needed capacity, the
proposed project is expected to alleviate existing traffic volumes on Wendell
Boulevard.
A secondary purpose of the proposed project is to correct existing roadway
deficiencies at the intersection of Richardson Road and Martin Pond Road. The
existing intersection of Richardson Road and Martin Pond Road does not meet
NCDOT design standards due to limited sight distance in either direction on Martin
Pond Road.
The proposed project's western terminus is at the interchange leading to and from
the existing US 64 Bypass at mile marker 427. The project will terminate at the
intersection of Richardson Road with Wiley Oaks Road, just east of the existing
intersection of SR 2502 and Martin Pond Road.
1.4) Cultural Resources
On May 5, 2006, Withers & Ravenel utilized the resources provided by the North
Carolina State Historic Preservation Office to research and identify any historic
structures potentially located within the Wendell Falls project boundaries. Withers &
Ravenel found no structures listed on the National Register located within the project
boundaries (see attached maps). However, two features, 1995 (Richardson Farm)
and 1996 (Mattox Farm), were located within or adjacent to the project boundaries
but are not currently proposed for the historic structures "study list" (SQ. We have
also attached a letter from the State Historic Preservation Office stating that no
known recorded archeological sites are located within the project boundaries.
However, because a systematic survey has not been conducted, archeological
surveys may be required, depending on the permit areas.
1.5) Endangered Species
On May 5, 2oo6 Withers & Ravenel reviewed the Knightdale and Clayton
Quadrangles to determine whether any known recorded federally listed species were
located within the project boundaries. No known populations of federally listed
species have been recorded within 0.5 miles of the proposed development.
1.6) Project History — Wendell Falls
Wetlands were delineated by Withers & Ravenel in the Fall of 2oo5 and the Spring of
2oo6. Site meetings were conducted with the USACE on August 8, 2oo6 (AID#:
2oo620100). The NC-DWQ conducted site meetings on 10/14/05,11/17/05, 2/1/o6,
5/4/o6, and 9/2o/o6 to confirm our riparian buffer determinations (DWQ Project #:
05-270, 05-27oB, o6-122). Copies of the buffer letters are included with the
attachments. In addition, on July 10, 2oo6, a pre -application meeting was held with
NC-DWQ and the USACE to review the proposed site plan (USACE AID#: 2oo620100).
The site plans have been revised slightly as per suggestions by both agencies.
1.6a) Summary of Permit Activity - Hij4hway 264 Bypass
The US 64 Bypass project is located in eastern Wake County (Division 5). The project
is broken into 3 -parts; Part BB, Part C and Part CC (see Appendix . The construction
limits for each part are provided below:
r R-2547 Part BB -New Hope Road to east of SR 26o1, includes
Interchange at Hodge Road;
R-2547 Part C -East of SR 26o1 to west of SR 2501, includes SR 2233
and SR 2502/2501 Interchange; and -
R-2547 Part CC -SR 2502 to US 64, includes US 64 interchange.
1.6b) Permit Activity Timeline:
July 1995 Draft Environmental Impact Statement was published. The
Preferred alternative included the interchange at Eagle Rock Road.
(Appendix B -See Figure 1)
September 1995 Public Hearing was held September 26, 1995.
May 1998 Final Environmental Impact Statement was published in May 1998
(See Appendix -C -Final Environmental Impact Statement). Direct
impacts to wetlands were anticipated to be 25.91 acres. According
to the FEIS (page 31, 2°d paragraph) NCDOT determined that the
preferred alternative was the least environmentally damaging
practicable alternative and the COE concurred with the corridor
selection.
October 1998 Record of Decision issued.
September 2001 A Pre-RFQ Design -Build meeting was held on- September 28,
2001. According to the meeting notes, "NCDOT has already designed
approximately 80% of the project. On the NCDOT plans, there are
interchanges designed for Hodge Road, the future East Wake
Expressway, Smithfield Road, future Eagle Rock Road and Taylor
Road relocation, and at US 64 Business and Rolesville Road."

The bridge for the future interchange at relocated Eagle Rock Road
and Taylor Road is not included in the structure design work that
was under design contract.
March 2002 The Indirect and Cumulative Impact Study Nutrient Analysis for
the US 64 Bypass was completed. As requested by the North
Carolina Division of Water Quality, this analysis was completed
using the nutrient Export Coefficient Method. The study boundary
incorporates 7535 hectares (29 square miles) of developed and
undeveloped land. The study boundary is bounded to the west by
the Raleigh Beltline, to the north by existing US -64, to the south
by Poole Road and to the east by Martin Pond Road (SR 2503) and
Eagle Rock Road (SR 1003). The study assumes that the Bypass
would be a limited -access roadway and include seven interchanges
including Hodge Road (SR 2516), Smithfield Road (SR 2233), and
Knightdale Road (SR 2501), serving the City of Raleigh, Town of
Knightdale and the Town of Wendell.
April 2002 NC Department of Environment and Natural Resources, Division
of Water Quality (DWQ) issued Certification No. 3377 to the
North Carolina Department of Transportation (NCDOT) on April
10, 2002. Sites 9 and 11 were included in the certification as
indicated in the Impact Summary of the application (See Appendix
C-DWQ letter and design sheets).

July 2002 On July 11, 2006 NCDOT makes payment totaling $4,283,974 to
the Wetlands Trust Fund regarding TIP R-2547 and R-2641; 404
Permit No. 00220819 and DWQ Project No. 011689. The
compensatory mitigation was for 6,254 linear feet of stream
impacts and 3,648,150 square feet of buffer associated with the
project.
October 2003 On October 15, 2003 the NCDOT informed the Corps that it had
violated its Individual Permit 200220819 and DWQ Certification
No. 3377 401 by doing unauthorized mechanized clearing and fill
of piedmont bottomland and alluvial forest wetlands for
construction access causeways at both Poplar Creek and Marks
Creek. Impacts at Popular Creek totaled 0.03 acres; impacts at
Marks Creek totaled 0.71 acres.
1.7) Proposed Impacts
The proposed impacts consist of 2,191 linear feet of perennial stream channel and
3.o9 acres of wetland impacts for roadway crossings and lot fill. An additional 720
linear feet of stream channel and 1.65 acres of wetlands will be temporarily impacted
for the installation of a utility line. Following construction of the utility line, the
stream channel will be returned to pre -construction contours.
Approximately 5.51 acres (Z1:3.52, Z2: 1.99) of riparian buffer will be permanently
impacted for roadways and greenway trails and 1.97 acres (Z1: 1.36, Z2: o.61) of
buffer will be temporarily be impacted for the installation of utility lines.
Impacts are summarized in the table below. The impacts for the proposed
interchange and the subdivision are presented in separate tables and figures as per
discussions with the USACE and the NC-DWQ. Additionally, although we are using
arch culverts at two of the crossings and do not anticipate any stream impacts at
these locations, for the time being they called out as impacts in the table below.

2.1) Avoidance and Minimization
Prior to site plan development, the applicant requested that a detailed wetland
delineation be conducted so that impacts to wetlands and `waters' could be
minimized. Impacts were minimized by the use of bottomless culverts along
Wendell Parkway and by steeper fill slopes or headwalls on the secondary roads.
Additionally, of the 195 acres of wetlands and over 6.5 miles of stream channel
within the project boundaries, the applicant only proposes to impact 1.4 acres of
wetlands and 1,024 feet of stream channel. The remaining wetlands and stream
channels will be preserved in perpetuity.
As part of the NEPA process for the Highway 264 bypass, a number of alternatives
were examined in order to determine which alignment would be the least damaging
to the environment. The decision making process is described below and at your
request we can provide the environmental impact statement that was written for this
project.
2.2) NCDOT Alternative Selection:
Based on the NEPA review process and comments received from federal and state
agencies, NCDOT chose Alternative S3-13 as the preferred alternative (See Appendix B)
the US 64 Bypass and Eastern Wake Expressway. The reasons stated in the
FHWA/NCDOT Final Environmental Impact Statement (FEIS) dated May 4, 1998,
include the following:
Traffic: The proposed US Bypass would provide the most direct east -west connection of
all alternative under consideration, saving 0.2 miles.
Thoroughfare Plan/Land Use Planning_ The preferred alternative follows the conceptual
location shown on the CAMPO, Knightdale and Wake County Thoroughfare Plans.
Alternative S3 conforms best with locally adopted land use plans.
Cultural Resources: Alternative S3 would not adversely affect any historic structures.
Wetlands: While Alternative S3 would affect wetlands, the alignment at Marks Creek
avoids the highest quality wetlands and takes almost all low quality wetlands.
Local Government Input: Both the Town of Knightdale and Wake County has expressed
preference for S# -B. The City of Raleigh has not expressed a preference.
Agency Input: The Corp of Engineers, NC Wildlife Resource Commission and Division
of Environmental Management support the S3 -B due to the fact that the S3 corridor
eliminates impact to some very high quality wetlands (rated 100 by DEM) and shifted the
impact to much lower quality wetlands (rated 29 by DEM).

Community Facilities: The S3 alternative will improve traffic service for police and fire
protection emergency vehicle access and school transportation. No school property will
be taken by any alternative.
Hazardous Material Sites: The S3 alternative affects the lowest number of potential sites.
Floodplains: Alternative S3 has the least amount of floodplain impact.
Economic Development: The US 64 Bypass and Eastern Wake Expressway would have
positive local economic impact by increasing access, providing a direct route of through
and local traffic, by relieving congestion on existing streets, and by accommodating
growth in eastern Wake County and in eastern North Carolina.
The FEIS Summary of comparison of alternatives for the US 64 Bypass is provided in
Appendix.
2.3) Comparison Summary of Proposed Alip_nment and CAMPO Plan Alignment
The proposed Wendell Falls Parkway is located north of the CAMPO LRTP alignment
and closer to existing developed areas (See Appendix D). The LRTP alignment and its
more southern approach would encroach on existing wetlands and open up more spaces
to development and decrease overall open space in Wake County; it should be noted that
Wendell Falls Parkway would be built in addition to the LRTP alignment to serve the
development. The Wendell Falls Parkway and accompanying thoroughfare plan would
preserve the existing characteristics of land use in the surrounding areas.
The Wake County Transportation Plan specifies to "create a plan that accommodates
community growth and its related traffic increases," and also to "relieve existing
congestion on key roadways." Wendell Falls Parkway will provide access to existing as
well as the planned development in the area which could include up to 4,000 new homes,
schools, medical facilities and commercial areas. It would also provide a secondary
entrance and gateway into Wendell. Wendell Boulevard, which serves as the oniy
entrance into Wendell off of US 64, has traffic volumes in 2030 that are projected to be
double of current volumes. Wendell Falls Parkway would alleviate and provide capacity
for the expected community growth and related traffic increases.
The Wake County Transportation Plan provides guideline for maintaining and improving
roadway safety. The intersection of Martin Pond Road and Richardson Road currently
has inadequate sight distance. Intersection improvements are proposed as part of Wendell
Falls Parkway. Sight distance and dedicated turn areas are slated to improve intersection
safety at the intersection of Martin Pond Road and Richardson Road thereby fulfilling
part of the Wake County Transportation Plan.
An important goal of the Wake County Transportation Plan is to "minimize
environmental impacts." The proposed Wendell Falls Parkway and thoroughfare plan
have less stream impacts and avoid more pockets of wetlands than the CAMPO LRTP
alignment. Another key factor to reducing environmental impacts is the fact that the
Wendell Falls Parkway and accompanying thoroughfare plan provide connectivity using

existing roadway alignments. The plan makes use of existing stream crossings, existing
roadway footprints, and existing infrastructure whereas the CAMPO LRTP alignment
uses new construction and thereby has much greater environmental impacts. The
Wendell Falls Parkway and accompanying thoroughfare plan follows the Wake County
Transportation Plan in regards to minimizing environmental impacts.
2.4) Intersection Improvements/Safety
The existing intersection of Richardson Road and Martin Pond Road does not meet
NCDOT design standards. Due to these deficiencies the safety of this intersection is
questionable. A motorist turning left or right onto Martin Pond Road from Richardson
Road has limited sight distance in either direction due to the low profile of Martin Pond
Road. The grade of Martin Pond Road sits in a cut with high ditch banks (See drawing
below). These high ditch banks impair a motorist's ability to see oncoming traffic,
especially from a driver on Richardson Road looking to the south. This impaired sight
distance has dangerous ramifications; a driver may in turn pull out in front of an
oncoming vehicle.
Existing Intersection Significant improvements are needed at the intersection of Martin Pond Road
and Richardson Road to improve public safety. Included in the proposed Wendell Falls Parkway
project are significant improvements to this intersection. The roadway profile grade of Martin Pond
Road would be lifted up in the vicinity of the intersection, and the southern roadway ditch graded
back to increase sight distance along with other improvements. In the drawing below the proposed
geometric improvements are detailed. Included in the improvements are added dedicated turn bays,
improved intersection turning radii, and dedicated sight triangles. The proposed improvements
would greatly increase motorist safety in the intersection; it is important to note that Martin Pond
Road is not scheduled to receive any improvements by the year 2030.

Proposed Intersection
2.5) Stormwater Management Plan
The first phase of this project will contain less than 30% impervious; therefore, we
do not believe that a stormwater management plan will be required by the NC-DWQ.
The applicant will utilize level spreaders in order to provide diffuse flow into the
riparian buffers. The proposed impervious surface for future phases has not been
quantified. If the impervious surface exceeds 30%, the applicant will provide a
detailed stormwater management that meets the NC-DWQ requirements for sites
located within a Nutrient Sensitive Watershed. Specifically, the applicant will utilize
constructed wetlands in order to protect downstream water quality. The stormwater
plans for the future phases have not been finalized, however; based on the drainage
area, adequate space has been reserved for future BMP locations. We are requesting
that the NC-DWQ issue the 401- approval with a condition that work will not begin on
future phases until the stormwater management plans for these phases have been
reviewed and approved by the NC-DWQ.
Public Interest Items
The USACE must also address a number of factors related to Public Interest. These
items are discussed below.
3.1)Conservation:
A detailed wetland delineation was conducted prior to site plan development in
order to minimize impacts to jurisdictional areas to the maximum extent possible.

The site contains approximately 195 acres of forested wetlands and beaver
impoundments and over 6.5 miles of streams and riparian buffers. With the
exception of the proposed impact areas, a 5o -foot riparian buffer will be retained
along all jurisdictional stream channels and the remaining wetlands (approximately
193 acres) will be preserved in perpetuity. We believe that the preservation of the
wetlands/beaver impoundments and the riparian buffers will provide a refugia for
the wildlife that may be displaced during the development of this tract.
3.2)Economics:
The applicant would be the primary beneficiary, with the capacity to develop and
offer real estate opportunities to a wide variety of citizens and entrepreneurs. This
project will greatly benefit the local economy by providing jobs and services not
currently located in this area. Local, state and federal tax revenues will also be
increased due to the project.
3.3) Aesthetics
Wendell Falls is not expected to diminish the aesthetic value of the surrounding
area. As mentioned earlier in this document, 16o acres of park land is being
preserved along the Marks Creek corridor and Lake Myra. All high intensity uses are
proposed in close proximity to the bypass with the lower intensity uses transitioning
throughout the remainder of the site. All land use buffers required by the Town of
Wendell shall be provided between on-site land uses as well as adjacent off-site
land uses.
3.4) General Environmental Concerns — Erosion and Sedimentation
During construction, the applicant will utilize sediment basins to protect
downstream water quality. If the impervious surface exceeds 30%, the applicant will
provide a detailed stormwater management that meets the NC-DWQ requirements for
sites located within a Nutrient Sensitive Watershed. Specifically, the applicant will
utilize constructed wetlands in order to protect downstream water quality. In areas
where the percent impervious is less than 3o%, the applicant will provide level
spreaders to ensure that stormwater enters the buffers in a non-erosive manner.
3-5) Wetlands
Prior to site plan development, the applicant requested that a detailed wetland
delineation be conducted so that impacts to wetlands and `waters' could be
minimized. Mr. Monte Matthews of the USACE, reviewed the delineation and agreed
with our wetland boundaries (USACE 2oo620100). The NC-DWQ conducted site
meetings on 10/14/05,11/17/05, 2/1/o6, and 5/4/o6 to confirm our riparian buffer
determinations (DWQ Project #: 05-270, 05-27oB, o6-122). Copies of the buffer
letters are included with the attachments. As mentioned above, approximately 195
acres of wetlands and 6.5 miles of stream channel are present within the project
limits.

3.6) Historic and Cultural Resources
On May 5, 2oo6, Withers & Ravenel utilized the resources provided by the North
Carolina State Historic Preservation Office to research and identify any historic
structures potentially located within the Wendell Falls project boundaries. Withers &
Ravenel found no structures listed on the National Register located within the project
boundaries (see attached maps). However, two features, 1995 (Richardson Farm)
and 1996 (Mattox Farm), were located within or adjacent to the project boundaries
but are not currently proposed for the historic structures "study list" (SL). We have
also attached a letter from the State Historic Preservation Office stating that no
known recorded archeological sites are located within the project boundaries.
However, because a systematic survey has not been conducted, archeological
surveys may be required, depending on the permit areas.
3.7) Fish and Wildlife Values
On May 5, 2oo6 Withers & Ravenel reviewed the Knightdale and Clayton
Quadrangles to determine whether any known recorded federally listed species were
located within the project boundaries. No known populations of federally listed
- species have been recorded within 0.5 miles of the proposed development (see
attached map). The project is not expected to have any adverse effect on federally
listed species.
3.8) Flood Hazards
Not Applicable
3-9) Floodplain Value
Most of the western portion of the site is located within the floodplain. A 5o -foot
riparian buffer will be maintained adjacent to the stream channels, which should
reduce the amount of sediment entering the floodplain due to stormwater run-off.
No structures will be placed in the floodplain; therefore we do not anticipate any
hazards to structures due to flooding. Moreover, a 16o -acre park is proposed along
the Mark's Creek corridor in order to preserve this area. The increased run-off from
the site may increase the floodplain elevation downstream from the site.
3.1o) Land Use
Land use in the surrounding area is generally rural and includes a mixture of
residential homes and agricultural fields. The project will comply with local zoning
ordinances. The site was chosen based on the need for additional housing in this
area.
3.11) Navigation
Not applicable
3.12) Shore Erosion and accretion
Not applicable

3.13) Recreation
There are currently no recreational or scenic areas within the project boundaries.
Lake Myra, located near the southwest property corner may serve as a recreational
area for the local residents (i.e. fishing/bird watching), however, during construction
the applicant will provide the appropriate erosion controls to minimize the risk of
sediment entering the Lake or its tributaries.
3.14) Water Supply
At present, the water in this area is supplied by the Town of Wendell. A merger
between place the City of Raleigh and the Town of Wendell is expected to take place
in early October, following the merger, the water will provided by Raleigh. The
increase in impervious area may is not expected to significantly affect ground water
recharge, because the stormwater outfalls will be placed outside of the 5o -foot
riparian buffer and a approximately 193 acres of wetlands and stream channels will
be preserved.
3.15) Water Quality
No major impacts to water quality are expected as a result of this project; however,
turbidity may increase slightly during construction. The applicant will employ
erosion control measures during construction. Additionally, the applicant will be
required to meet the NC-DWQ 401 Certification requirements. Measures to protect
water quality will include level spreaders at stormwater outlets, bio -retention, and
stormwater wetlands.
3.16) Energy Needs
Not applicable
3.17) Safety
During construction the contractors will follow OSHA guidelines in order to protect
the workers on-site. When completed, the entrances to the subdivision will meet the
standards of the NC -DOT.
3.18) Food and Fiber Production
Not applicable
3.19) Mineral Needs
Not applicable
3.20) Considerations of Property Ownership
Not applicable — A list of the adjacent property owners is included with the
attachments.

4) Mitigation
Because impacts to perennial channels exceed 150 linear feet and wetlands impacts
are greater than o.1 acres, the applicant proposes payment to the NC-EEP and/or
preservation to satisfy mitigation requirements. As stated above, the proposed
interchange was previously permitted and mitigation was paid for these impacts,
however we have included these impacts in our mitigation request and may amend
the mitigation amounts pending additional discussions with the USACE and/or NC-
DWQ.

This action involves construction of the US 64 Bypass and the Eastern Wake Expressway in Wake County.
This Final Environmental Impact Statement (EIS) presents the Preferred Alternative selected based on the
findings of the Draft EIS as well as agency comments and public input obtained at the Corridor Public Hearing.
The Draft EIS was published in July 1995. The Public Hearing was held on September 26, 1995. All
comments and public input received subsequent to publication of the Draft EIS are addressed in this document.
This Final EIS is an abbreviated document which presents only those sections of the Draft EIS which required
modification or clarification. The Draft EIS is incorporated into this Final EIS by reference.

Reference the Department of the Army permit issued on April 25, 2002, subsequently
modified on May 4, 2004, for the discharge of fill material in waters of the United States,
including wetlands, to facilitate construction of the US 64 Knightdale Bypass (T.I.P. No.
R-2547), in the Neuse River basin, Wake County, North Carolina. Reference also your written
request of December 13, 2004, for additional permit modification to impact an additional 10
linear feet of stream for extension of a pipe to accommodate an access driveway, at Site 19, in
Section BA of TIP No. R-2547.
We have reviewed your proposal and have determined that impacts are temporary or
relatively minor, and an additional public notice is not necessary. Therefore, the permit is
hereby modified to include the work as shown on the enclosed plans, subject to the following
additional special condition:
xx. Compensatory mitigation for the unavoidable impacts to an additional 10 linear feet
of stream associated with the proposed project shall be provided by the Ecosystem Enhancement
Program (EEP), as outlined in the letter dated December 8, 2004 from William D. Gilmore, EEP
Transition Manager. Pursuant to the EEP Memorandum of Agreement (MOA) between the
State of North Carolina and the US Army Corps of Engineers signed on July 22, 2003, the EEP
will provide 20 linear feet of restoration equivalent warm water stream channel in the Neuse
River basin (Hydrologic Cataloging Unit 03020201) by one year of the date of this permit.
The NCDOT shall, within 30 days of the issue date of this permit, certify that sufficient funds
have been provided to EEP to complete the required mitigation,* pursuant to Paragraph V. of the
MOA.
It is understood that all other conditions of the original permit remain applicable and that
the expiration date is unchanged. Please note that the current permit expiration date is December
31, 2005.

Attached hereto is a modification to Certification No. 3377 issued to the North Carolina Department of
Transportation on April 10, 2002. The attached modification authorizes changes to the project design as
described in your submittal dated December 13, 2004. The modification authorizes a modification to the
horizontal alignment design for the project Section BA, an additional 10 linear feet of jurisdictional stream
impacts and 481 square feet of Zone 1 and 414 square feet of Zone 2 buffer impacts for the project Section BA,
and additional 204 square feet of Zone 1 and 280 square feet of Zone 2 buffer impacts for the project Section
CC.. The only modifications to the design of the project authorized by this certification are those submitted in
your December 13, 2004 application. All the authorized activities and conditions of certification associated
with the original Water Quality Certification dated April 10, 2002 and all other corresponding modifications

Impacts
The only modifications to the design of the project authorized by this certification are those submitted in your
December 13, 2004. All the authorized activities and conditions of certification associated with the original Water
Quality Certification dated April 10, 2002 and all other corresponding modifications still apply except where
superceded by this certification.
The application provides adequate assurance that the proposed impacts to the stream and riparian buffer zones in
conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable
portions of Sections 301, M,303, 306,307 of PL 92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application, as described in the
Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If
the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby
responsible for complying with all the conditions. If total -wetland fills for this project (now or in the future exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this
approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should
obtain all other federal, state or local permits before proceeding with your project including (but not limited to)
Sediment and Erosion control, Coastal Stormwater, Non -discharge and Water Supply watershed regulations.
Conditions) of Certification:
Construction will be conducted in such a manner as to prevent a significant increase in turbidity outside
the area of construction or construction -related discharge. Erosion and sediment control practices must be
in full compliance with all specifications governing the proper design, installation and operation and
maintenance of such Best Management Practices in order to assure compliance with the appropriate
turbidity water quality standard.
a. The erosion and sediment control measures for the project must equal or exceed the proper design,
installation, operation and maintenance outlined in the most recent version of the North Carolina Sediment
and Erosion Control Planning and Design Manual. These devices shall be maintained on all construction
sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits
associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must equal or exceed the proper
design, installation, operation and maintenance outlined in the most recent version of the North Carolina
Surface Mining Manual. The reclamation measures and implementation must comply with the
reclamation in accordance with the requirements of the Sedimentation Pollution Control Act.
2. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with
this permit without appropriate modification of this permit. Should waste or borrow sites be located in
wetlands or stream, compensatory mitigation will be required since it is a direct impact from road
construction activities;
3. No live or fresh concrete shalt come into contact with waters of the state until the concrete has hardened.
4. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources
has released the project;
5. No additional compensatory mitigation is required as a result of this certification.
6. All stormwater runoff shall be directed to sheetflow through stream buffers at nonerosive velocities, unless
approved otherwise by this certification. -
7. During the construction of the project, no staging of equipment of any kind is permitted in waters of the
U.S., or protected riparian buffers.
8. Riparian vegetation must be reestablished within the construction limits of the project by the end of the
growing season following completion of construction.
9. The dimension, pattern and profile of the stream above and below the crossing should not be modified by
widening the stream channel or reducing the depth of the stream. Disturbed floodplain and streams
should be restored to natural geomorphic conditions.
10. Any riprap used must not interfere with thalweg performance and aquatic life passage during low flow
conditions.
11. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
12. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited_
13. Compensatory mitigation for unavoidable impacts to 10 linear feet of stream shall be done at a
replacement ratio of 1:1. Applying a replacement ratio of 1:1, total mitigation for 10 linear feet of stream
shall be provided for in Cataloging Unit 03020201 of the Neuse River Basin by the Ecosystem
Enhancement Program (EEP) as outlined in the letter dated 8 December 2004.
14. Mitigation for impacts to 685 square feet of protected riparian buffers in Zone 1 and 694 square feet of
protected riparian buffers in Zone 2 will be mitigated for as described below:

We understand that you have chosen to perform compensatory mitigation for impacts to protected buffers through
an in lieu payment to the North Carolina Ecosystem Enhancement Program (NCEEP), and that the EEP has agreed
to implement the mitigation for the project. Mitigation for unavoidable impacts to Neuse Riparian Buffers shall be
provided through an in -lieu payment to the North Carolina Ecosystem Enhancement Program (NCEEP) at a rate of
$0.96 per square foot for 3,096 square feet of buffer impact. Therefore, a total payment of $ 2972.16 shall be
submitted to the NCEEP to offset the impacts. No construction activities m euse Iver iparian u ers s a
begin until payment for buffer mitigation is made and the Ecosystem Enhancement Program receives and clears
your check (made payable to DENR — Ecosystem Enhancement Program).
15. Pursuant to NCAC 15A 28.0233(6), sediment and erosion control devices shall not be placed in Zone 1 of
any Neuse Buffer without prior approval by the NCDWQ_ At this time, the NCDWQ has approved no
sediment and erosion control devices in Zone 1, outside of approved project impacts, anywhere on this
project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers
provided that Zone 1 is not compromised and that discharge is released as diffuse flow.
16. The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization shall be cleady-marked by highly visible fabric fencing prior to any land disturbing
activities. Impacts to areas within the fencing are prohibited unless otherwise authorized by this
certification.
17. NCDOT, and its authorized agents, shall conduct its activities in a manner consistent with State water
quality standards (including any requirements resulting from compliance with §303(d) of the Clean Water
Act) and any other appropriate requirements of State law and Federal law. If DWQ determines that such
standards or laws are not being met (including the failure to sustain a designated or achieved use) or that
State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ
may reevaluate and modify this certification to include conditions appropriate to assure compliance with
such standards and requirements in accordance with 15A NCAC 2110507(d). Before modifying the
certification, DWQ shall notify NCDOT and the US Army Corps of Engineers, provide public notice in
accordance with 15A NCAC 214.0503 and provide opportunity for public hearing in accordance with 15A
NCAC 2110504. Any new or revised conditions shall be provided to NCDOT in writing, shall be
provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to
Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
18. A'copy of this Water Quality Certification shall be posted on the construction site at all times. In addition,
the Water Quality Certification (and all subsequent modifications, if any, shall be maintained with the
Division Engineer and the on-site project manager.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS.CEItTIVICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and
95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15
NCAC 2H, Section .0500. Attached hereto is a modification to Certification No. 3377 issued to the North Carolina
Department of Transportation on April 10, 2002. The attached modification authorizes changes to the project design
as described in your submittal dated August 9, 2004. The modification an inlet number 51 to be moved back
Lute to station59 + 10 and the 375mm pipe redirected toward inlet 52B. The only modifications to the design of the

ertificationThe application provides adequate assurance that the discharge of fill material into the proposed wetlands in
conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable
portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application, as described in the
Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If
the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby
responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed
_one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should
obtain all other federal, state or local permits before proceeding with your project including (but not limited to)
Sediment and Erosion control, Coastal Stormwater, Non -discharge and Water Supply watershed regulations.
Condition(s) of Certification:
1. Construction will be conducted in such a manner as to prevent a significant increase in turbidity outside
the area of construction or construction -related discharge. Erosion and sediment control practices must be
in full compliance with all specifications governing the proper design, installation and operation and
maintenance of such Best Management Practices in order to assure compliance with the appropriate
turbidity water quality standard.
a. The erosion and sediment control measures for the project must equal or exceed the proper design,
installation, operation and maintenance outlined in the most recent version of the North Carolina Sediment
and Erosion Control Planning and Design Manual. These devices shall be maintained on all construction
sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits
associated with the project_
b. For borrow pit sites, the erosion and sediment control measures must equal or exceed the proper
design, installation, operation and maintenance outlined in the most recent version of the North Carolina
Surface Mining Manual. The reclamation measures and implementation must comply with the
reclamation in accordance with the requirements of the Sedimentation Pollution Control Act.
2. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with
this permit without appropriate modification of this permit Should waste or borrow sites be located in
wetlands or stream, compensatory mitigation will be required since it is a direct impact from road
construction activities',

3. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
4. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources
has released the project;
5. No additional compensatory mitigation is required as a result of this certification.
6. All stormwater runoff shall be directed to sheetflow through stream_ buffers at nonerosive velocities, unless
approved otherwise by this certification.
7. During the construction of the project, no staging of equipment of any kind is permitted in waters of the
U -S., or protected riparian buffers.
No changes to the horizontal or vertical placement of the stormwater outfall locations, the horizontal or
vertical placement of the culverts, the horizontal or vertical placement of bridges, the horizontal or vertical
placement of grassed swales, or the horizontal or vertical placement of open ditches is permitted without
written approval from the NC Division of Water Quality 401 Wetlands Unit_ In addition, no changes to
the flow spreader locations or designs, preformed scour hole locations or designs are permitted without
written approval from the NC Division of Water Quality 401 Wetlands Unit. Any request for changes to
the referenced items above will require submittal of a modification request, with seven copies, and
corresponding fees will need to be submitted to the North Carolina Division of Water Quality.

growing season following completion of construction-

onstruction10. The dimension, pattern and profile of the stream above and below the crossing should not be modified by
widening the stream channel or reducing the depth of the stream. Disturbed floodplain and streams
should be restored to natural geomorphic conditions.
11. Any riprap used must not interfere with thalweg performance and aquatic life passage during low flow
conditions.
12. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
13. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited_
14. Pursuant to NCAC15A 2B.0233(6), sediment and erosion control devices shall not be placed in Zone 1 of
any Neuse Buffer without prior approval by the NCDWQ. At this time, the NCDWQ has approved no
sediment and erosion control devices in Zone I anywhere on this project. Moreover, sediment and erosion
control devices shall be allowed in Zone 2 of the buffers provided that Zone 1 is not compromised and that
discharge is released as diffuse flow.
15. The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization shall be clearly marked by orange fabric fencing prior to any land disturbing activities.
Impacts to areas within the fencing are prohibited unless otherwise authorized by this certification.
16. NCDOT, and its authorized agents, shall conduct its activities in a manner consistent with State water
quality standards (including any requirements resulting from compliance with §303(d) of the Clean Water
Act) and any other appropriate requirements of State law and Federal law_ If DWQ determines that such
standards or laws are not being met (including the failure to sustain a designated or achieved use) or that
State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ
may reevaluate and modify this certification to include conditions appropriate to assure compliance with
such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the
certification, DWQ_shall notify NCDOT and the US Army Corps of Engineers, provide public notice in
accordance with 15A NCAC 211.0503 and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be
provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to
Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
17. A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition,
the Water Quality Certification (and all subsequent modifications, if any, shall be maintained with the
Division Engineer and the on-site project manager.
18. All other conditions written into previous Water Quality Certifications and Neuse River Riparian Buffer
Certifications for this project still apply.

There are no known recorded archaeological sites within the project boundaries. However, the project area has
never been systematically surveyed to determine the location or significance of archaeological resources. There are
several areas within the 1200 -acre project boundaries that contain a high probability for the presence of Native
American and historic period archaeological sites. After the Army Corps of Engineers permit area is delineated,
please forward that information to us so we may recommend any necessary archaeological investigations to be
conducted prior to any ground disturbing activities.
The map that accompanied your letter shows the Richardson Farm as being located outside the project boundaries,
although earlier maps we examined for the project included this property. While it may not be eligible for listing in
the National Register of Historic Places for architecture, this nineteenth century farmstead may contain significant
archaeological resources. If the farmstead and the cemetery are part of this project and included within the permit
area, testing should be undertaken to determine the presence of such resources. The cemetery should be treated in
accordance with the provisions of North Carolina General Statutes Chapter 65 if it will be affected.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the Advisory
Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR Part 800.

This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writingc o Cyndi Karoly, DWQ We 401 Unit, 2321 Crabtree
Blvd., Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated Local
Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60 -day statutory
appeal time does not start until the affectedparty (including downstream and adjacent landowners) is notified of
this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150E of the North Carolina General Statutes to the Office of'Administrative Hearings, 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing
