The application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Cowpens Creek in con- junction with the proposed boat basin construction in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this act- ivity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions herein- after set forth. , Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent signi- ficant increases in turbidity outside the area of construction or con- struction-related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. That the effluent spillway outlet.pipe shall be extended to.the mean low water contour in order to prevent erosion and sedimentation. 3. That adjustable flashboard risers and stilling well be constructed at the outfall of the diked disposal basin. Violations of any condition herein set forth shall result in revocation of this Certification. "t4rrative description The applicant is an industrial fish processing company which has large investments in.a plant located adjacent to-Taylors Creek, off Lennox- ville Road in Beaufort, Carteret County. The property is composed of several parcels that add up to about 8 acres. The tract is di- vided by a small creek known as Cowpen Creek which extends inland from Taylors Creek to the right-of-way of Lennoxville Road.- This creek separates this industrial plant from a traditional residen- tial area. Elevations on the property are.3-4' and soils are pre- dominently sandy. Cowpen Creek appears to have.been modified prior to 1970. This early excavation has given.it a straight, perpendicular configuration with Taylors Creek. It has recovered from this early modification and has. an extensive intertidal shoal at the mouth. A small oyster rock lies just inland of this, and fringes of smooth-cordgrass lines the edge. This marsh fringe is 15-20' wide on the east side of the creek and 3-5' wide on the west. Various small boats utilize this creek as a harbor. The applicant is proposing to excavate a channel and basin rectangular in shape*350' long by 40' wide by 5' deep MLW. The channel is to ex- tend about 3/4 of the way into Cowpen Creek. The channel and basin are to service the menhaden fleet purse boats when they are dropped from the larger vessels in.order to facilitate the larger vessels' docking. The dredging will be done by hydraulic dredge and spoil de- posited in an upland spoil site on'the menhaden plant property. 10.-Anticip%ted impacts Conducting this project as proposed will involve the disturbance. of 1600 sq.ft. of shallow, intertidal area, 12,000 sq.ft. of previously excavated shallow saltwater bottom, and 400 sq.ft. of an existing oyster rock. The excavation will involve displacing 2,000 cu.yds. of material from the creek which is expected to be composed primarily of silt with small amounts of sand. No4marsh vegetation will be excavated. h. Excavation will not exceed 5 feet below the elevation of mean low water (MLW). Narrative description T plicant is an industrial fish processing company which has large investments in a plant located adjacent to Taylors Creek, off Lennox- ville Road in Beaufort,. Carteret.County. The property is composed of several parcels that add up to about 8 acres. The tract is di vded by a small creek known as Cowpen.Creek which extends inland from Taylors Creek to the right-of-way of Lennoxville Road. This creek separates this industrial plant from a traditional residen- tial area. Elevations on the property are 3-4' and soils.are pre- dominently sandy. Cowpen Creek appears to have been modified prior to 1970. This early excavation has.given_it a straight, perpendicular configuration with Taylors Creek. It has recovered from this.early modification and has'• an extensive intertidal shoal at the mouth. A small oyster rock lies just inland of this, and fringes of smooth-cordgrass-lines the edge. This marsh fringe is 15-20' wide on the east side of the crecY.and 3-51.wide on the west. Various small boats utilize this creek as a harbor. The applicant is proposing to excavate a channel and basin.rectangular in shape,350' long by 40' wide by 5' deep MLW. Thechannel is to ex- tend about 3/4 of the way.into Cowpen Creek. The channel and basin are to service the menhaden fleet purse boats when they are dropped from the larger vessels in order to facilitate the larger vessels docking. The dredging will be done by hydraulic dredge.and.spoil de- posited in an upland spoil site on'the menhaden plant property. 10. 'Anticipated impacts Conducting this project as proposed will involve the disturbance of 1600 sq.ft. of shallow, intertidal area, 12,000 sq.ft., of previously excavated shallow saltwater bottom, and 400 sq.ft. of an existing. oyster rock. The excavation will involve displacing 2,000 cu.yds. of material from the creek which is expected to be composed primarily of silt with small amounts of sand.
