Narrative Descri ptfon Lee Spell is the owner of the Tr-adewinds Marina which is located on the north side of Hwy. 58 in the Town of Indian Beach'on Bogue Banks in Carteret County. The Tradewinds' property includes a mobile home park with about 53 trailer sites on each side of a man-made canal that runs about 800' north and south by 80' wide. The applicant proposes to reconstruct a 100' long section of bulk- head that was destroyed by Hurricane Gloria on September 26, 1985. This section of the bulkhead is located along the north shore- line east of the canal entrance on Bogue.Sound and adjoins Mr. Ronnie Smiths property. Erosion" .of the highground property now aliowsthe MHW line to ex- tend some 5-10' landward of the original bulkhead alignment. As a.result of the storm and washout, the mobile home which was situated on the lot fell into the water and totaled. Since that date the mobile home has been removed and the site readied for re- construction which will include backfilling the new structure with at.least 90 cu.yds. of earthen material. Approximately 500 sq.ft of intertidal land will have to be filled landward of the original bulkhead alignment to restore the highground elevations which ap- proximate.5'. Once the highground lot ha's-been restored, a new mobile home will.be repositioned on the lot in exactly the same location as the old trailer. 10. Anti cipatedA mpacts Reconstruction of the 100' long section of bulkhead with backfill will directly displace approximately 500 sd.ft. of intertidal bottom land landward of the original bulkhead alignment. The Application provides adequate assurance that the discharge of .fill material into a wetlands area adjacent to the waters of Bogue Sound in conjunction with the proposed bulkhead reconstruction in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the new bulkhead alignment not extend more than two feet waterward from the previous bulkhead alignment. 3. That silt screens and tightly spaced boards shall be installed to minimize turbidity and sedimentation. 4. That the backfill material be comprised of clean sand from an upland source. 5. That the mobile home to be replaced on the site be spaced at least 30 feet back from the mean high water contour, if possible to do so with the existing utility connections. Violations of any condition herein set forth shall result in revocation of this Certification. The following information is provided: 1. The project will require 401 certification, and should contain the following conditions: a. The bulkhead alignment shall not extend any further waterward than 2 feet from the previous bulkhead alignment. b.
