Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile fish populations, spawning anadromous fish • and water quality, no excavation or filling may be carried out within the waters of Symonds Creek from March 1 - August 30 of any years without prior approval of the Division of Coastal Management. (2) All excavated material must be trucked to a highground disposal site and not allowed to enter adjacent wooded wetlands or waters of Symonds Creek. (3) All disturbed areas must be revegetated as construction is completed. Silt fencing and other temporary erosion control devices must remain in place until a permanent ground cover is established. (4) The activity must be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the Stream is 50 NTus or less are not considered significant). NOTE: This project must be carried out in compliance with the rules and regulations of the N. C. Sedimentation Pollution Control Act. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. DOT proposes to replace the bridge over Symonds Creek on SR 1182 with three 3 0 inch x 46 inch corrugate steel pipe arc culverts. NORTH CAROLINA DEPARTMENT OF TRANSPORTATION BRIDGE #56 BIO REPORT PAGE 2 SITE DESCRIPTION The applicant proposes to replace Bridge #56 located over Symonds Creek on SR 1182. The existing bridge does not allow boatists to pass underneath, yet the creek is navigable on both sides of the-bridge. The bridge is bordered on either sides by wooded swamp, with such species as cypress, typa, pickle weed and other such species. The applicant-proposes to replace the existing bridge with three (3) 60" X 46" corrugated steel pipe arch culverts. This project will result in the filling of 275 cubic yards below N.W.L. ANTICIPATED IMPACTS The proposed project will result in the filling of 2000 square feet of creek bottom below N.W.L.
