The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The riprap material will not be placed farther than eight feet waterward from the existing bulkhead at any point along its alignment. b. No material will be placed in excess of the minimum needed for protection of the bulkhead structure. c. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The rock revetment shall not extend waterward more than 8' from the mean high water contour (bulkhead) at any point along its alignment. (2) No material will be placed in excess of the minimum needed for protection of the bulkhead structure. (3) No excavation or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (4) The riprap shall be graded to where the smaller material is laid on the filter X cloth with the larger armor rock being on the top surface. NOTE: The permittee and/or his contractor is urged to meet with representatives from the local field office of the Division of Coastal Management to discuss the permit condition. Their number is (919) 256-4161. NOTE: Section 401 Water Quality Certification No. 1799 was issued on May 7, 1985 by the Division of Environmental Management for this project. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The Application provides adequate assurance that the discharge of rip-rap material into the waters of Motts Channel in conjunction with the proposed bulkhead stabilization in New Hanover County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity _ outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the rip-rap material be clean and free of toxic substances, and be of sufficient size to prevent movement by wave or tidal action. _ 3. That the rip-rap extend no further waterward than 10 feet from the toe of the bulkhead. Violations of any condition herein set forth shall result in revocation of this Certification. Page 2 9(a) SITE DESCRIPTION: The project.site is located along the 350' long shoreline of 7 residential lots bordering Motts Channel approximately 400' east of the Seapath Marina basin. All of the lots have been protected 12 years ago by a wooden bulkhead. Presently the 10' bulkhead is being undermined at places due to the deep water in the man-made basin and the deteriorated condition of the bulkhead sheet piles. All of the lots have fixed piers extending ±40' waterward of the bulkhead. The last dredge cut was made approximately 30' from the failing wall. Most of the six residences which border the bulkhead are within 25' of the MHW contour which follows the wall. The MLW contour lies about 8-12' out from the wall. The intertidal area is comprised of fine sand and silt. The area is classified as a secondary nursery area and is highly dis- turbed due to heavy boat traffic. 9(b) PROJECT DESCRIPTION: The applicants wish to place approximately 500 cubic yards of Class "C" marl riprap along the toe of their failing wooden bulkhead. The riprap will be obtained from the Martin Marietta Quarry and be approximately 40-60 lbs. apiece (foot-ball size). This rock revetment is to extend up to 8' waterward of the MHW contour and have a 1:1 slope up to the 2/4 height level of the existing wall. The rock is to be placed over a layer of filter "X" cloth and be stacked by a backhoe and hand labor. At the ends of the project the revetment is to be tapered into the newer bulkheads of their riparian neighbors. 10. ANTICIPATED IMPACTS: As proposed the project will cause-the disturbance of approxi- mately 2,800 sq.ft. of relatively unproductive intertidal bottom. The rock revetment sloping face may provide niches for many smaller marine organisms. The rock will not present a hazard to navigation since it will be landward of the dredge cut. The revetment may fill too much 'public trust bottoms with little supported erosion and failure data to justify this alternative. A slightly lesser fill distance as toe protection may suffice.
