Dear Mr. Burnett:
This is in response to your letter requesting a modification to CAMA
Permit. 80-85 that was issued to the Town of Kure Beach in dune of this
year. On behalf of the Town, you have requested that the subject outfall
line from the wastewater lagoon be allowed to be installed at a more shallow
depth to reduce spoil handling.
In response to your request, this letter is your authority to refine
the outfall and diffuser project for the Town of Kure Beach as described
in plat "Effluent Outfa!1 Plan and Profile Diffuser Structure" - sheet
14 of 20 - dated revised 9/13/85 (not attached). This letter must be
attached to the original of the permit and made readily available on site
when Division personnel inspect the project for compliance. You are reminded
that Federal approval is also necessary for this change. According to
our information, Corps of Engineers action is pending.
Should there be any question on this matter, do not hesitate to contact
this office or Bob Stroud in our Wilmington office.

Dear Mayor Wrenn:
Reference your application for a Department of the Army
permit to construct a wastewater treatment facility effluent
outfall in the Cape Fear River at Kure Beach in New Hanover
County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC.'080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

authorizing development in New Hanover County at Cape Fear River (at existing waste-
water lagoon) as requested in the permittee's application dated -1/3/85 including
attached plats, sheet 1/-3 of 3 dated 1/2/85
This permit, issued on 6/3/ ? 7 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(l) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without the
prior approval of the Division of Coastal Management.
(2) All excavated material, resulting from trench construction, will be placed
and retained on high ground.
(3) Bedding and backfill material will be suitable, free from any toxic pollutants
so as not to adversely effect the ability of the area to function as a nursery
area.
(4) Preconstruction elevation contours, in the river and in the wetlands, will
be restored after the wastewater line has been installed
(5) Due .to the 6' depth required for the siting of the diffuser, in addition
to or instead of the reflectors, battery operated lights must be used to
mark the structure as a hazard to navigation. Any placards or signs also
used must be in accordance with the State Uniform Waterway Marker System
as administered by the Wildlife Resources Commission.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
AD work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North ( ?rolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

(6) Any re-routing of the drainage Swale shall terminate landward of any marsh
to provide a water quality buffer and wildlife habitat.
NOTE: Section 401 Certification #1807 has been issued for this project by the
Division of Environmental Management.
NOTE: NPDES Permit #NC 00 25763 was issued for this project by the Division of
Environmental Management on January 4, 1984.
NOTE_ An Easement from the Council of State through the Dept. of Administration,
State Property Office is required for installation of the pipeline into
public trust waters.
NOTE: A Sedimentation and Erosion Control Plan has been submitted to the Division
of Land Resources for this project.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section
401 Public Laws 92-500 and 95-217 of the United States and subject to the North
Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section
.0500 to the Town of Kure Beach pursuant to an application filed on the 21st day
of January, 1985 to extend the effluent outfall from the Kure Beach Wastewater
Treatment Plant.
The application provides adequate assurance that the discharge of dredged
material into the waters of Cape Fear River in conjunction with the proposed
outfall extension in New Hanover County will not result in a violation of ap-
plicable Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with
the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases such that the turbidity in the stream is

and backfill. A NPDES permit has been issued to the Town for the discharge
of effluent to the Cape Fear River, classified SC.
After review of the proposed project, the following comments are offered:
1. The project will require 401 certification.
2. The proposed project is not expected to violate water quality
standards for waters classified SC.
3. It is recommended that a 401 certification be issued containing

8. Project summary applicant proposes to reactivate the existing Kure Beach Wastewater
Treatment lagoon. A new chlorine contact chamber and outfall line will be
constructed. The existing berm will be shifted at the southwest corner of the
lagoon and will cover an existing drain which will be rerouted.

9. PROJECT DESCRIPTION:
The project is located at the site of the presently abandoned wastewater treat-
ment lagoon serving the Town of Kure Beach. After the construction of the
existing berm the borrow area on the southern edge has become established as a
wet drain. Red maple and other associated species have become established in
the drain. This feature is approximately 8'-15' wide. There is a boarder of
smooth cordgrass (Spartina alterniflora) along the west shoreline of the
property. The boarder is approximately 30'-40' in width at the project site.
The applicants propose to reactivate the lagoon. As part of this activity the
existing berm will be extended at the southwest corner. This extension will
involve filling the existing wet drain. The drain will be rerouted to the
south of its existing location for approximately 400'. In conjunction with
the berm extension a chlorine contact chamber will be constructed and a new 12"
outfall line will be installed. The existing 12" line will be removed. The
new line will be installed by using trench excavation. The applicants propose
that the excavated material will be windrowed along side the trench. The
trench will be approximately 600' in total length. Of that amount approximately
400' will be in the river bottom, 30'-40' will cross the wetland and the
remainder will be in the highground. The dimensions are approximately 4'-5'
wide and 3'-6' deep. Approximately 655 cubic yards of material will be
excavated and approximately that same amount will be used for backfill. The
line will extend to the -6' MLW depth. It will terminate in a riser with
diffuser. This diffuser will extend approximately 3' above the mean highwater
(MHW) contour. It will be protected by four 8" x 8" treated pilings equipped
with reflectors and warning signs. The junction of the 12" line and the
riser/diffuser will be protected by crushed stone (Sheet 2 of 3). Twelve
2" x 6" slots spaced around the riser will provide for the diffusion of the
effluent.
10. ANTICIPATED IMPACTS:
The proposal to windrow the excavated material below the mean high water contour
is viewed as having a potential to significantly increase the adverse impacts
of the project. Recent proposals have been required to either structually
contain the material below the MHW contour or to remove it to highground. If
excessively organic material is excavated then clean sand must be substituted
as backf ill. This area of the river serves as a critical nursery area during
times of certian flow conditions in the river. Although not indicated clearly
in the plans the excavation for the proposed drain rerouting should terminate
landward of all wetlands in order to maintain a functioning system.

Dear Colonel Hanson:
This is in response to the subject public notice proposing to
reactivate the existing Kure Beach wastewater treatment lagoon
adjacent to the Cape Fear River, in the town of Kure Beach,
New Hanover County, North Carolina.
As part of the reactivation proposal, an existing berm will
be extended at the southwest corner eliminating approximately
2,560 square feet of a forested wetlands drain dominated by
red maple (Acer rubrum). This wetland area will be rerouted
to the south of its existing location for about 400 feet.
The proposed activity will also involve the installation of a
new outfall line that will be installed utilizing a trench
excavation. The applicant proposes that the excavated material
be distributed along the side of the trench. The trench will
be approximately 600 feet in total length with 400 feet occuring
in the river bottom, 40 feet passing through a cordgrass
(Spartina alterniflora) marsh, and the remainder in uplands.
Approximately 655 cubic yards of river bottom will be excavated
and utilized as backfill material.
As a result of the proposed activity, about 140 square feet
of cordgrass marsh will be eliminated. In addition, about
1,600 square feet of river bottom will be excavated and 2,000
square feet subsequently filled. It should be noted that
this portion of the river system functions as a critical
nursery area during certain flow conditions.

It is our belief that the applicant is not utilizing the
least environmentally damaging construction techniques to
minimize degration to valuable aquatic resources. In addition,
there is no mitigation for the destruction of about 140 square
feet of cordgrass marsh.
Consequently, we recommend that the permit be denied unless
the applicant agrees to the following conditions:
1) The 140 square feet of cordgrass marsh eliminated by the
proposal shall be mitigated for by the creation of 280
square feet (2:1 ratio) of cordgrass marsh. An upland
area at the project site contiguous with the existing
cordgrass marsh shall be scraped down to an elevation that
will allow daily tidal flushing. The area shall be planted
with cordgrass at three-foot centers and guaranteed
successful at an 80% survival ratio for a two year period.
The plantings should be accomplished during the winter
months of the year.
2) If the applicant proposes to do the work during the months
of April 1 through October 1, he shall coordinate his
activity with the state of North Carolina Division of
Marine Fisheries to minimize damages to the nursery habitat
resources.
3) The proposal to distribute excavated river bottom below
the mean high water contour along side of the outfall pipe
trench has the potential of increasing the negative impacts
of the project. Consequently, we request that all excavated
material be removed to an upland location, and clean sand
be utilized as backfill.
4) The proposed excavation for the rerouting of the red maple
wetland drain shall terminate landward of all wetland
areas to insure the integrity of the system.

000-0291-(enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 21, 1985, for
a Department of the Army permit to install a wastewater treatment
facility effluent outfall in the Cape Fear River at Kure Beach,
New Hanover County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to
the State.
If your application must be withdrawn from this general

Enclosed is the application of the Town of Kure Beach,
represented by Mayor Lee Wrenn, for a Department of the Army
permit and a State Water Quality Certification to construct a
wastewater treatment facility effluent outfall in the Cape Fear
River at Kure Beach in New Hanover County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined,that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by April 8, 1985, the District Engineer
will deem that waiver has occurred.

It is requested that a CAMA/Corps dredge and fill permit
be issued for the replacement of an existing wastewater treat-
ment facility effluent outfall in the'Ca.pe Fear River at Kure
Beach, N. C. in accordance with the attached application and
supporting sketches. The proposed project is required to
replace the badly deteriorated existing line in concert with
a reactivation of the existing 0.1 MGD Kure Beach municipal
wastewater treatment facility.
The Town of Kure Beach has received an NPDES permit from
the N. C. Division of Environmental Management (Permit No.
N00025763) to rehabilitate the existing wastewater treatment
works and to discharge the treated effluent into the Cape
Fear River which is classified "SC-Swampwater". Effluent
disposal will be by buried pipeline which will extend
approximately 600 feet offshore into the Cape Fear, as shown
on the attached plan. A diffuser at the end of the discharge
line will insure proper dilution and dispersion of the treated
effluent into the estuarine area.
The pipeline will be a 12-inch ductile iron out.fall pipe
buried from three to six feet deep below the existing floor
of the Cape Fear River in the location shown on the attached
sketch. The method of burial will be by barge-mounted
clamshell-bucket which will excavate the trench and place the
spoil immediately adjacent to the trench without removing the
bucket from the water, in an effort to reduce turbidity effects
during construction. Once the pipeline is in place the
excavated material will be used as backfill for the trench
and will be returned to the trench using a bar drag. This
method of pipeline burial has been used before quite successfully,
and seems to be the least en**ironmentally disruptive method
for effecting this work. When the pipeline leaves high ground
to enter the estuary, a relatively narrow band of marsh-type
grass, approximately 10 to 15 feet wide will have to be crossed.
It is proposed to excavate the marsh vegetation and temporarily
place it on high ground until the pipeline is laid, after
which the marsh vegetation will be picked up and placed back
in its original position prior to excavation. Again, experience
has shown that the recovery of the disturbed marsh grasses
will be very rapid. The discharge diffuser will be protected
by four pilings approximately six feet apart on each side of
the diffuser, and a warning sign regarding the structure will
be prominently displayed on one of these pilings (see Sheet 2
of sketches).
A total of approximately 655 cubic yards of material will
have to be temporarily displaced for burial of the pipeline;
however, no spoil disposal area will be required as the materials
will be used to backfill the trench as mentioned above. Lunar
tides in the construction area are negligible and generally
range less than one foot. The property for location of the
wastewater treatment facility and the effluent discharge pipe-
line is entirely within the Sunny Point Marine Terminal buffer
zone as indicated on the sketch and in the application.
Design of the wastewater treatment facility and the discharge
line has been completed. Therefore, it is respectfully requested
that approval of this permit application be expedited as much as
