THIS CERTIFICATION is issued in conformity with the requirement=s: 'of

2H, Section .0500 to Fairfield Harbour, Inc. pursuant :to an:application
filed on the 22nd day of October, 1984 to construct a.marina expansion

The Application provides adequate assurance that the 'discharge of fill
and rip-rap into the waters of Northwest Creek in conjunction with thel
proposed marina expansion in Craven County will not result in a
violation of applicable Water Quality Standards and discharge
guidelines. Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306.,-107 of PL 92-500
and PL 95-217 if conducted in accordance with the application and-
conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).

2. That a lock-head policy shall be
posted and enforced.
3. That marine pump-out facilities
be provided for boats with heads.
Violations of any condition herein set forth shall result in revocation
of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

9., Narrative description
Fairfield Harbour Subdivision is located at the-end of SR 1600 between
Northwest Creek-and Upper Broad Creek on the Neuse River in Craven
County. The location of the current project proposal is centered
around the existing marina which is at the end of Harborside Blvd. on
NW Creek. In brief, the project involves expanding the highground ma-
rina basin and developing a new commercial center and condominium type
area.
The new highground basin will open onto the SE corner of the existing
marina. It will be semi-circular in shape and will require the excava-
tion of approximately one acre of highground property. The project
depth of -6' NWL is compatible with the existing water depths in the
marina that opens on to NW Creek. Approximately 17,700 cu.yds. of ex-
cavated material will be relocated as fill and landscape immediately
adjacent to the new basin. As proposed the entire shoreline will be
bulkheaded with a combination of some 1,100 lin.ft. of concrete, wood,
and riprap. One section of the bulkhead (about 2801) will be installed
some 40' waterward of the NWL. This will involve filling in about 300
11,000 sq.ft. of open water area. This will also displace about
sq.ft. of intermittent marsh fringe vegetation characterized by black
needlerush, salt marsh grass, and bulrush.
A notation is made that this portion of the existing marina was ori-
ginally excavated from the applicant's highground property. In con-
junction with this filling operation,the overall elevation of the
property will be raised from a +5' elevation to a final grade of ap-
proximately +12'.elevation.
Elsewhere along the shoreline the bulkhead and riprap will displace
an additional 1600 sq.ft. of wetlands which include cattails and salt
reeed grass. This will occur primarily along the southern.face of the
proposed bulkhead alignment.
About 7.5 acres of highground property are involved for development
under this application proposal. This area can be broken down into
two distinct land uses known as the "marina village complex" and park-
ing lot on about 4.2 acres and the "marina condo" complex on about
3.2 acres. Plans for the marina/condos show that 25 units will be
constructed creating a.unit density of 8.7. A majority of the condo-
minium construction activities will take place within 75' of the shore-
line. The proposed marina basin will service the slip and docking
needs of only those residents located in the adjacent condominium
complex. 'In order to accommodate upland drainage and stormwater
management, an 8.5 acre landlocked lake will be excavated This re
.servoir will retain high volumes of rain water that are directed to
it through prescribed drainage patterns from throughout the develop-
ment.' The lake elevation and its retention capability is designed
to allow some overflow and discharge into the existing marina basin
on'NW Creek.
10. Anticipated impacts
The general shape-or design configuration of the proposed basin sug-
gests that flushing within the basin and existing marina will not be
a problem. This is to say that the overall extent of the basin into
high ground is not excessively long, and that the basin opens wide
on to the existing waterway.
The applicant plans to excavate the one acre basin in the dry and
conduct all bulkheading construction activities prior toopening the
bain to the existing waterway. The project plans also show the use
of sedimentation and erosion control devices throughout the construc-
tion phase of development. It is also noted that the development will
be serviced by a .new wastewater treatment plant that will discharge
into the Neuse River. CAMA Permit No. 266-84 was issued to NE Craven
Utility Company and authorizes the construction of the discharge pipe
into the Neuse River.
The proposed project is then considered a modification to the overall
development plans for the Antiqua Section of Fairfield Harbour as au-
thorized by State Permit No. 95-82. The applicant's engineering con-
sultants have indicated to this office that the originally permitted,
lengthy canal system as authorized will not be undertaken by Fairfield,
and Fairfield's current proposal represents a significant reduction
in the amount of open water alterations to be made. The new Master
LUP as provided on Sheet 2 of 14 illustrates the overall scope of
development for the Antiqua Section.
CAMA Review
The applicant is working closely with Craven ? County in an effort to
amend the county's LUP and ultimately the classification map. Spe-
cifically, the project area in and around the existing marina on NW
Creek and the subdivision area known as Antiqua are presently classi-
fied as "rural." This classification does not.allow for high density.
development or population growth. In addition, the rural clo ssifi-
cation does not allow for the operation of a community sewer system.
Therefore, in order to accommodate the proposed development, the
land classification scheme must be changed t.o either "transition"
or "developed." The OCM supports-Craven County's conservation desig-
nation for the coastal salt marshes and the wooded swamp wetlands
that border a large marjority of the Antiques shoreline.

Introduction
Fairfield Harbour is located in Craven County, North Carolina, approximately
eight (8) miles east of New Bern, at the confluence of Northwest Creek with the
Neuse River. Fairfield Harbour is developing into one of the more desirable resort
communities located in this area. It is the developer's intent to develop a Master
Land Use Plan that is harmonoius with the natural habitation of the area and that
creates a positive influence on the environmental-ecological systems in existence;
however, also with the accomplishment of economical feasibility and success.
The growth rate of the Fairfield Harbour community is accelerating each year with
the construction of single family homes, condominiums, resort facilities, and expansion
into new development areas. Presently under construction is a second 18 hole golf
course located on the east side of S.R. 1600. There are approximately 2334 single
family lots of which 250 are built on and 170 existing multi-family type units. In
addition, there are country club and restaurant facilities as well as marina facilities.
Permit Review
This project is being submitted for permit review and approval to the U.S. Army Corps
of Engineers for administration of the federal review and to the North Carolina Department
of Natural Resources and Community Development - Office of Coastal_ Mann-ement
for adminstrationof the state review. The district office for the Corps is located
in Wilmington, NC and the regional office for the Office of Coastal Management
is located in Morehead City, NC. Permit applications are submitted to those offices.
Description of Project
This project will consist of the expansion of the present marina and boat basin at
the Fairfield Harbour marina complex. Both commercial and condominium type facilities
are planned to be constructed around the improved marina. Approximately one (1)
acre of land will be excavated (17,700 cubic yards of material) to create the basin.
Also, approximately .3 acre of the existing marina is planned to he filled_?urpny,
3600+ cubic yards of fill material. Bank treatment Oll consist of a combination

of wood bulkheading with rip rap placed on the outward slope in front
of the bulkhead. Immediately in front and around the perimeter of the
bulkhead is planned a system of wood pier and boat docks.
Stormwater Management
Stormwater run-off direct drainage to the stream system contributes
to the degradation of water quality. Recognizing this, drainage will be
diverted away from the stream system into grassed swales and pipe systems
leading into one of the existing lakes within the project area which will
act as a retention basin. The lakes will have over flow structures which
will discharge into the boat basin.
Erosion Control
An erosion and sedimentation control plan will be submitted to the Land
Quality Section, NRCD for approval prior to construction. Accepted
erosion control methods will be mployed and all precautions as necessary

Wastewater Treatment Facilities
Northeast Craven Utility Company presently owns and oeprates the wastewater
-treatment facilities serving Fairfield Harbour. NPDES permits are for
.1 mgd to Upper Broad Creek and 1 mgd to the Neuse River. Existing
plant capacity is :Imgd with new .3 mgd facilities under construction with
start-up in early spring of 1985.
Potable Water Supply
Northeast Craven Utility Company presently owns and operates the water supply
system serving Fairfield Harbour. Cater is supplied by 2 wells with storage capacity
of .5mg,. Future wells are planned as needed.

by excavating an addtl. 40,000 sq.ft. of highground basin adj. to NW Creek. Other high-
ground dev. near the basin includes a new clubhouse and conmercial area with parking
lot and a condominium comple*.

9, Narrative description
Fairfield Barbour Subdivision is located at the end of SR 1600 between
Northwest Creek and Upper Broad Creek on the Neuse River in Craven
County. The location of the current project proposal is centered
around the existing marina which is at the end of Harborside Blvd. on
NW Creek. In brief, the project involves expanding the highground ma-
rina basin and developing a new commercial center and condominium type
area.
The new highground basin will open onto the SE corner of the existing
marina. It will be semi-circular in shape and will require the excava-
tion of approximately one acre of highground property. The project
depth of -6' NWL is compatible with the existing water depths in the
marina that opens on to NW Creek. Approximately 17,700 cu.yds. of ex-
cavated material will be relocated as fill and landscape immediately
adjacent to the new basin. As proposed the entire shoreline will be
bulkheaded with a combination of some 1,100 lin.ft. of concrete, wood,
and riprap. One section of the bulkhead (about 2801) will be installed
some 40' waterward of the NWL. This will involve filling in about
11,000 sq.ft. of open water area. This will also displace about 300
sq.ft. of intermittent marsh fringe vegetation characterized by black
needlerush, salt marsh grass, and bulrush.
A notation is made that this portion of the existing marina was ori-
ginally excavated from the applicant's highground property. In con-
junction with this filling operation,the overall elevation of the
property will be raised from a +5' elevation to a final grade of ap-
proximately +12! elevation.
Elsewhere along the shoreline the bulkhead and riprap will displace
an additional 1600 sq.ft. of wetlands which include cattails and salt
reeed crass. This will occur primarily along the southern.face of the
proposed bulkhead alignment.
About 7.5 acres of highground property are involved for development
under this application proposal. This area can be broken down into
two distinct land uses known as the "marina village complex" and park-
ing lot on about 4.2 acres and the "marina condo" complex on about
3.2 acres. Plans for the marina/condos show that 25 units will be
constructed creating a unit density of 8.7. A majority of the condo-
minium construction activities will take place within 75' of the shore-
line. The proposed marina basin.will service the slip and docking
needs of only those residents located in the adjacent condominium,
complex. In order to accommodate upland drainage and stormwater
management, an 8.5 acre landlocked lake will be excavated This re-
servoir will retain high volumes of rain water that are directed to
it through prescribed drainage patterns from throughout the develop-
ment. The lake elevation and its retention capability is designed
to allow some overflow and discharge into the existing marina basin
on • NW Creek.

Anticipated impacts
The general shapb-or design configuration of the proposed basin sug-
gests that flushing within the basin and existing marina will not be
a problem. This is to say that the overall extent of the basin into
high ground is not excessively long, and that the basin opens wide
on to the existing waterway.
The applicant plans to excavate the one acre basin in the dry and
conduct all bulkheading construction activities prior toopening the
Bain to the existing waterway. The project plans also show the use
of sedimentation and erosion control devices throughout the construc-
tion phase of development. It is also noted that the development will
be serviced by anew wastewater treatment plant that will discharge
into the Neuse River. CAMA Permit No. 266-84 was issued to NE.Craven
Utility Company and authorizes the construction of the discharge pipe
into the Neuse River.
The proposed project is then considered a modification to the overall
development plans for the Antiqua Section of Fairfield Harbour as au-
thorized by State Permit No. 95-82. The applicant's engineering con-
sultants have indicated to this office that the originally permitted,
lengthy canal system as authorized will not be undertaken by Fairfield,
and Fairfield's current proposal represents a significant reduction
in the amount of open water alterations to be made. The new Master
LUP as provided on Sheet 2 of 14 illustrates the overall scope of
development for the Antiqua Section.
CAMP' Review
The applicant is working closely with Craven County in an effort to
amend the county's LUP and ultimately the classification map. Spe-
cifically, the project area in and around the existing marina on NW
Creek and the subdivision area known as Antiqua are presently classi-
fied as "rural." This classification does not allow for high density.
development or population growth. In addition, the rural cla,ssifi.-
cation does not allow for the operation of a community sewer system.
Therefore, in order to accommodate the proposed development, the
land classification scheme must be changed to either "transition"
or "developed." The OCM supports-Craven County's conservation desig-
nation for the coastal salt marshes and the wooded swamp wetlands
that border a large marjority of the Antiqua shoreline.

Introduction
Fairfield Harbour is located in Craven County, North Carolina, approximately
eight (8) miles east of New Bern, at the confluence of Northwest Creek with the
Neuse River. Fairfield Harbour is developing into one of the more desirable resort
communities located in this area. It is the developer's intent to develop a Master
Land Use Plan that is harmonoius with the natural habitation of the area and that
creates a positive influence on the environmental-ecological systems in exist'ance;
however, also with the accomplishment of economical feasibility and success.
The growth rate of the Fairfield Harbour community is accelerating each year with
the construction of single family homes, condominiums, resort facilities, and expansion
into new development areas. Presently under construction is-,a-second 18 hole golf
course located on the east side of S.R. 1600. There are approximately 2334 single
family lots of which 250 are built on and 170 existing multi-family type ;.snits. In
addition, there are country club and restaurant facilities as well as marina fa.cilities.
Permit Review
This project is being submitted for permit review and approval to the U.S. Army Corps
of Engineers for administration of the federal review and to the North Carolina Department
of Natural Resources and Community Development - Office of Coastal Mana-ement
for adminstrationof the state review. The district office for the Corps is located
in Wilmington, NC and the regional office for the Office of Coastal Management
is located in Morehead City, NC. Permit applications are submitted to those offices.
Description of Project
This project will consist of the expansion of the present marina and boat basin at
the Fairfield Harbour marina complex. Both commercial and condominium type facilities
are planned to be constructed around the improved marina. Approximately one (1)
acre of land will be excavated (17,700 cubic yards of material) to create the basin.
Also, approximately .3 acre of t existinf; marina is planneA ro be filled requirrnr,
3600+ cubic yards of fill material. Bank treatment will consist of a combination

of wood bulkheading with rip rap placed on the outward slope in front
of the bulkhead. Immediately in front and around the perimeter of the
bulkhead is planned a system of wood pier and boat docks.
Stormwater Management
Stormwater run-off direct drainage to the stream system contributes
to the degradation of water quality. Recognizing this, drainage will be
diverted away from the stream system into grassed swales and pipe systems
leading into one of the existing lakes within the project area which will
act as a retention basin. The lakes will have over flow structures which
will discharge into the boat basin.
Erosion Control
An erosion and sedimentation control plan will be submitted to the Land
Quality Section, NRCD for approval prior to construction. Accepted
erosion control methods will be mployed and all precautions as necessary
will be taken to prevent sediments from entering the stream.
Wastewater Treatment Facilities
Northeast Craven Utility Company presently owns and oeprates the wastewater
--treatment facilities serving Fairfield Harbour. NPDES permits are for
.l mgd to Upper Broad Creek and 1 mgd to the Neuse River. Existing
plant capacity is lmgd with new .3 mgd facilities under construction with
start-up in early spring of 1985.
Potable Water Supply
Northeast Craven Utility Company presently owns and operates the water supply
system serving Fairfield Harbour. Water is supplied by 2 wells with storage capacity
of .5mg. Future wells are planned as needed.-

Reference the application of Fairfield Harbor, Incorporated,
represented by Thomas Engineering Consultants, P. A., for a
Department of the Army permit to expand marina facilities on
Northeast Creek at Fairfield Harbor, near New Bern, in Craven
County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. Work will be accomplished in strict accordance with
revised plans dated January 1985.
b. Emergent wetland vegetation and shallow water habitat
lost through accomplishment of the work will be mitigated to the
satisfaction of the U. S. Fish and Wildlife Service by one or a
combination of the following three methods:
1. Physical modification of replacement habitat to
convert it to the same type lost.
habitat.
2. Restoration or rehabilitation of previously altered
3. Increased management of similar replacement habitat
so that the inkind value of the lost habitat is replaced.

c. Construction activities will take place in isolation from
the Neuse River or will be restricted to the period of October 1
through March 31 of any year to protect fishery resources.
d. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded marshlands.
e. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
f. The temporary placement or double handling or excavated
materials within waters or wetlands is not authorized.

with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be.sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

authorizing development in Craven County at Northwest Creek (at Fairfield Harbor
as requested in the permittee's application dated 10/22/84 including
attached plats, sheets 1-14 of 14 dated 1/85 and 5A dated received 1/30/85.
This permit, issued on 5 ?' is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Construction
(1) The excavation of the new boat basin will be accomplished under dry-bed
conditions. An earthen plug will be left between the area to be excavated
and the existing creek, and a 24-hour period after completion of excavation
will elapse prior to the plug removal to prevent unnecessary siltation
into the adjacent water body.
(2) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the prescribed bulkhead alignment and fill
areas indicated on the attached work plats.
(3) All excavated materials will be confined above the normal water level and
landward of all regularly and irregularly flooded marsh, or behind adequate
dikes or other retaining structures to prevent spillover of solids into
any marsh or surrounding waters.
(4) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).

or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

' ADDITIONAL CONDITIONS
(6) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge (increase such that the turbidity in the Stream is 25 NTUs or
less are not considered significant).
Mitigation
Vegetated wetlands, which were either excavated or filled and totaled approxi-
mately 2200 sq. ft. will be replaced on a 1 to 1 ratio at a nonwetland
site in keeping with the satisfaction of the DCM in consultation with the
N. C. Wildlife Resources Commission and the U. S. Fish and Wildlife Service.
Marina Operation
a) A locked-head policy shall be posted and enforced at the marina.
b) Prior to occupancy of the new slips by any boats, a marine pumpout
facilities shall be provided for boats with heads and will serve the
entire marina.
NOTE: Since more than one contiguous acre will be affected by activities
of this project, an erosion/sedimentation control plan must be filed
with the Division of Land Resources, Land Quality Section, N. C. Dept.
of Natural Resources and Community Development, P. 0. Box 1507, Washington,
N. C.
NOTE: The permittee should contact the Vector Control Branch, Environmental
Health Section, Division of Health Services, P. 0. Box 2091, Raleigh,
N. C. 27602, 919/733-6407, for information concerning appropriate mosquito
control measures.
NOTE: Plans and specifications for any additions or improvements to the water
system serving this development must be approved by the Division of
Health Services prior to construction. The applicant should contact
the Engineering Planning Branch, Environmental Health Section, Division
of Health Services, P. 0. Box 2091, Raleigh, NC 27602, 919/733-2460
for information concerning submission of water system plans.
NOTE: Future development on the "Parcels" designated on sheet 2 of 14 will
