Dear Mr. Baker:
The North Carolina Department of Transportation is proposing to remove accumulated sediments from
beneath and immediately up and downstream of bridge 178 over Burningtown Creek. Additionally, Class B
shot rock will be installed on an eroding streambank on the northeast quadrant of the bridge. A significant
sand and cobble bar approximately 75 feet long x 25 feet wide extends from upstream of the bridge to
downstream of the bridge along the east side of the main channel. The bar is well vegetated below the bridge
and reaches to approximately 5 feet in height above the stream at the highest point. The depositional bar is
between the main channel of the creek and a secondary channel (7-8'wide) that runs along the east side of the
bridge. A smaller depositional bar approximately 60 feet long x 10 feet across at its widest point has formed
along the west side of the creek and a secondary channel (4-5'wide) has formed between the west bank of the
creek and this depositional bar.
NCDOT proposes to excavate the bar materials along both banks and use these materials to create floodplain
benches. The sand, gravel and cobble bench will serve as a streambank during normal flows to maintain the
stream at a width-depth ratio similar to the existing channel up and downstream of the bridge. Large shot
rock will be placed at the toe of the eroded bank to protect the wing wall of the bridge and adjacent private
property.
I am including a USGS topographic map, a marked county map. PCN, a drawing showing the proposed work
and photographs of the site.
The North Carolina Natural Heritage Database was checked for records of federally threatened and
endangered species. There are no records of listed species in the immediate vicinity of the project. There are
records for the small whorled pogonia (Isotria medeoioider) within one mile of the project. The small
whorled pogonia typically inhabits open, dry deciduous woods with acid soil. Conifers. such as hemlock and
white pine, are key components of small whorled pogonia habitat. The areas to be affected are highly
disturbed in-channel sand, gravel and cobble bars and highly disturbed riparian areas in the immediate
vicinity of the bridge and the road intersection. Habitat for the small whorled pogonia is lacking. For these
reasons, we believe there will be "no effect" on the small whorled pogonia. Burningtown Creek provides

habitat fbr the spotfimchub (Erimonax monachus), a federally threatened species. There are records shown
in;the'database that are approximately 6.5 miles downstream of the project. The material to be removed is
unconsolidated sand, gravel and cobble and is natural substrate material that originated in upstream areas.
Potential for adverse. sedimentation effect from these materials is significantly less than from soils having a
significant clay,co'mponent. The use of sandbags to divert the water away from the work area and the
sequencing of the project to minimize impacts will reduce the potential for adverse effects on downstream
habitat. For these reasons, we believe the project "may affect but is not likely to adversely affect" the
spotfin chub.
The proposed work is limited to stabilization of an eroding streambank, removal and/or reshaping of a depositional
channel bar, All these areas are highly disturbed by the road, bridge and natural scouring of the creek. Therefore, we
believe there will be no adverse effects on historic or cultural resources.
The best management practices will be used to minimize and control sedimentation and erosion on this
project. The construction'foreman will review all sedimentation control measures during installation to % ensure sedimentation is being effectively controlled. If the planned devices are not functioning as intended,
they will be replaced immediately with better devices.
Impacts to Waters of the United States
Bumingtown Creek (DWQ Class B Tr) is shown on the USGS topographic map as a perennial stream. The
main channel at the bridge is approximately 30 feet in width. The stream has a well-defined channel
composed primarily of cobble, gravel and sand. The stream is of sufficient size at the project location to
provide habitat for fish, including trout. Burningtown Creek flows approximately 7.8 miles to the Little
Tennessee River. The Little Tennessee River meets the definition of a Traditional Navigable Water. For
these reasons, we believe that Burningtown Creek is a Relatively Permanent Water and is under the
jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to
impact waters of the United States in the Little Tennessee River,Basin. Specifically, NCDOT is requesting to
remove and/or redistribute depositional materials and stabilize an eroding streambank on Burningtown Creek.

you concerning the 404 Nationwide Permit request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water Act from the
North Carolina Department of Environment and Natural Resources (DENR), Division of Water Quality
(DWQ). In addition, I am asking Mr. McHenry and Mr. Ed Ingle, Roadside Environmental Field Operations

The area of the project is within Burningtown Creek. The land use is rural residential with a mixture of woodlots and open
areas.

The purpose of the project is to repair an eroding bank, reshape two depositional bars under the bridge and up and
downstream of the bridge to create a floodplain bench to bring the normal flow channel width back to a width similar to
sections up and downstream of the bridge....
3e. Describe the overall project in detail, including the type of equipment to be used:
The work will require installing concrete barriers and sandbags to divert water out of two side channels. One channel
(east side) will be filled with the depositional materials and the depositional bar reshaped to form a floodplain bench on
the east side of the stream. Class II shot rock will be used to stabilize the eroding streambank. A narrow linear
depositional bar on the west side of the bridge will be reshaped and the stream width restored to a similar width as up and
downstream of the bridge. A small excavator such as a bobcat will be used to remove materials from under the bridge
and reshape the bars. Dump trucks, track hoe, sandbags and various hand tools also will be used for the repair.
