Dear Ronnie:
Enclosed is a NWP 12 application for your review. This application is submitted on behalf of the
Scotts Hill Water and Sewer District for the installation of approximately 110,000 LF of a 12-inch water
line adjacent to Highway 17 and Scotts Hill Loop Road in Pender County, NC. Although the District will
directionally bore under a stream and most wetlands to minimize impacts, no all wetlands could be avoided
due to cost considerations. Approximately 0.0107 acres of 404 wetlands and 0.017 acres of isolated
wetlands will be temporarily impacted during the open cut installation of the water line. Although these
wetlands will be returned to natural grade once the line is installed, they will be permanently converted to an
herbaceous, mowed corridor.

The applicant will install a 12" PVC water line within a 20' construction corridor located along approximately 110,000 LF of

NC DOT right-of-way. The stream and some wetlands will be directionally bored and other areas will be open cut at a 3
depth. The open cut areas will be returned to natural grade once the line is installed. The 20' wide corridor will be
permanently maintained. The water line will tie into the Rocky Point and Topsail Water and Sewer District System.

This permit application is submitted for temporary impacts to wetlands within a NC DOT right of way. The applicant will
avoid impacts to a UT of Futch Creek, its adjacent wetlands, and several other wetland areas by directionally drilling
under these areas (- 1450 LF). Unfortunately, the other wetland areas could not be directionally bored because of costs.
A 20' wide corridor will be permanently maintained, which will only affect 0.0107 acre of 404 wetlands.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Construction will include a series of silt fences around jurisdictional areas to control sediment erosion. The applicant will
avoid impacts to all streams and most wetlands by directionally drilling under them.

Basis For Determination: This site exhibits wetland criteria as described by the 1987 Corps Wetland Delineation Manual
and is adiacent to Topsail Sound and an unnamed tributary of Futch Creek. Futch Creek and Topsail Sound are
navigable waters of the U.S. The subject water bodies exhibits ordinary high water marks as indicated by the presence
of bed and banks, the absence of vegetation in the stream channel, and the change in the character of soil. This
determination is based on information provided by Land Management Group and a site visit conducted on January 21,
2008 by Ronnie Smith of the USACE.
Remarks: There are also isolated wetlands located along Scotts Hill Loop Road. Isolated wetlands are not subject to the
permit requirements of Section 404 of the Clean Water Act. However, isolated wetlands are subject to regulation by the
state of North Carolina. Prior to starting work, you should contact Ms. Joanne Steenhuis with the North Carolina
