Then I learned about the private mitigation banking requirement from the newly adopted statute and have kept you informed since then as the City worked through setting up an agreement with a private bank for stream impact mitigation. We have just received our letter of reservation from this private bank that will allow you to complete your review of the PCN application. Attached you will find a copy of my previous additional information response that includes the NCEEP approval letter for the riparian buffer impacts, and a copy of the private mitigation bank letter of reservation for the potential stream impacts. We are still awaiting word from the COE as to whether they will require stream impact mitigation for our project because there should be no loss of stream use. However, as we discussed by telephone last week, the City wants to submit this project for stimulus funding. All permits are due by June 1 to qualify and we are hoping the attached information will be sufficient to quickly grant an authorization. In turn, I can get land quality to finish their erosion and sedimentation control approval. These are the last permits/authorizations needed to perform the work. Thanks for your help and advice during this process. If you could send me a quick reply and let me know if I should follow up with the five hard copies of the information, I would appreciate it. Also, do you coordinate with the COE about this from here on out or do I need to do something in addition to copying Jamie Shern on this message? Regards, Marie K. We have obtained an updated letter. Five copies are enclosed. 2. You have proposed to conduct this project under a USCACE Nationwide Permit No. 12 However, our corresponding General Certification No. 3699 states the following: This General Certification does not authorize any permanent changes in pre- construction elevation contours in waters or wetlands or stream dimension, pattern or profile. Based on your response to Section VII of your PCN application, it appears you will need to contact the USACE to inquire as to whether they can permit this project under an additional or alternative Nationwide Permit. Per our telephone discussion on December 3, there are no permanent changes in pre- construction elevation contours in waters or wetlands or stream dimension, pattern or profile. The Forest Creek Mitigation Bank does have 210 stream mitigation units available on its Official Credit Ledger, and is under reservation status for this project.
