Dear Mr. Styron:
Reference your application for a Department of the Army
permit to excavate a channel, canal, and basin and to construct a
boat ramp off Cedar Island Bay, north of Roe, in Carteret County,
North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

This permit,issued on �,- Z-/, Q 5 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine,imprisonment or civil action;or may cause the permit to be null and void.
(1 ) In order to protect juvenile shrimp and fin fish populations, no excavation
will be permitted between the dates of April 15 through October 30 of any
year without the prior approval of the N. C. Division of Coastal Management.
(2) All spoil material will be placed directly on to high ground or into trucks,
and at no time will any spoil be placed below the mean high water line
or on any regularly or irregularly flooded marshland.
(3) Excavation will not exceed a depth of 6 feet, mean low water (MLW).
(4) The resulting spoil material should be placed on highground around basin
and provided with ground cover sufficient to restrain erosion within 30
working days after completion of project.
NOTE: Any discharge into the basin of waste or rinse water from the fish house
may require a permit from the Division of Environmental Management.
The permittee should contact that agency's Wilmington office at 919/256-4161 .
NOTE: A Section 401 Water Quality Certification is not required for this project.
This permit action may be appealed by the permittee Signed by the authority of the Secretary of DNRCD and
or other qualified persons within twenty (20) days of the the Chairman of the Coastal Resources Commission.

Dear Mr. Parker:
Reference the application of Mr. Eugene Styron for a
Department of the Army permit to excavate a channel, canal and
basin, and to construct a boat ramp off Cedar Island Bay, north of
Roe, in Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile shrimp and fin fish
populations, no excavation will be permitted between the
dates of April 1 through September 30 of any year without the
prior approval of the North Carolina Division of Coastal
Management.
b. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded marshlands.
c. No excavated or fill materials will be placed at any time
On any marshes or waters of the State.
d. Excavation will not exceed a depth of 6 feet, mean low
water (MLW).

The applicant proposes to construct an 80 foot by 80 foot boat basin,

8. Project summary Applicant proposes to construct an access charnel and boat
basin at property adjacent to Cedar Island Bay and Hwy. 12 at Cedar_ is-
land, Carteret County
9. Narrative description
The applicant ' s property is a seven-acre tract located adjacent
to Cedar Island Bay and Hwy. 12 in Cedar Island, Carteret County.
The property is basically undeveloped and wooded with pines dominat-
ing, interspersed with other species such as live oak. Elevations
range from 2-4' and the soils are sandy.
The shoreline is characterized by a 5-50 ' wide fringe of coastal
wetlands composed primarily of black needlerush and smooth cord-
grass. This fringe is backed by a sandy beach area prior to be-
coming woodsland. The wetlands are interrupted by a dock and boat
basin presently used by the applicant for family fishing operations. .,
A 6 ' deep channel leads-_into_th.e----site--from-C-e-dar Island Bay.
The applicant is proposing an access charnel and .highground boat ba-
sin just west of the present landing. The access channel will con-
nect into the. existing deep water of the existing channel and ter-
minate in an 80 ' by 80 ' boat basin in highground. Spoil from the
excavation will be spread on the high ground around the basin. A
fish house and boat ramp are also planned.
10. Anticipated impacts
In conducting the excavation of the access channel, about 900 sq.ft.
of mixed, high marsh composed of black needlerush, salt grass and
salt meadow grass, will be excavated. Another 4, 500 sq.ft. of inter-
tidal salt water habitat will be removed by constructing this chan-
nel. The highground boat basin will invove 7, 300 sq.ft. being ex-
cavated and another 22, 000 sq.ft. being covered by spoil material .
Approximately 3, 667 cu.yds. of spoil material will be produced by
the operation.
This portion of Cedar Island Bay is designated by the DMF as a pri-
mary nursery area. Adjacent waters support juvenile shrimp, various
finfish, clams, oysters, and blue crabs. .

Dear Mr. Styron:
On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received December 10, 1984, for
a Department of the Army permit to excavate a channel, canal and
basin and construct a boat ramp off Cedar Island Bay, north of
Roe, in CA'rteret County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Office of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general
permit process for any. reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Dear Colonel Hanson:
This is in response to the subject public notice proposing
the construction of an access channel and a 80 ft. by 80 ft.
upland boat basin adjacent to Cedar Island Bay, in Cedar
Island, in Carteret County, North Carolina.
The project site is located immediately west of an existing
dock and boat basin presently utilized by the applicant for
fishing operations. A six-foot deep channel leads into the
site from Cedar Island Bay.
The proposed access channel will connect into the deep water
of the existing channel and terminate in the proposed upland
basin.
As a result of this activity, approximately 900 sq.ft. of
salt marsh dominated by salt grass (Distichlis spicata) ,
black needleruch (Juncus roemarianus) and salt hay (Spartina
patens ) will be eliminated. In addition, about 4,500 sq.ft.
of intertidal saltwater bottom habitat will also be lost.
Based on our review of the public notice and discussions with
Corps of Engineer personnel, it is evident that the purpose
of the project is to allow the applicant to move his fishing
activities from the existing boat basin to the proposed one.
However, the actual need for this project has not been demon-
strated.

Consequently, because of the impacts to aquatic resources and
the lack of justification for the project , we recommend that
the subject permit application be denied.

8. Project summary Applicant proposes to construct an access channel and boat _
basin at property adjacent to Cedar Island Bay and Hwy. 12 at Cedar Is-
land, Carteret County
9. Narrative description
The applicant ' s property is a seven--acre tract located adjacent
to Cedar Island Bay and Hwy. 12 in Cedar Island, Carteret County.
The property is basically undeveloped and wooded with pines dominat-
ing, interspersed with other species such as live oak. Elevations
range from 2-4 ' and the soils are sandy.
The shoreline is characterized by a 5-50 ' wide fringe of coastal
wetlands composed primarily of black needlerush and smooth cord-
grass. This fringe is backed. by a sandy beach area prior to be-
coming woodsland. The wetlands are interrupted by a dock and boat
basin presently used by the ,applicant for family fishing operations..
A 6 ' deep channel leads into the site from Cedar Island Bay.
The applicant is proposing an access channel and highground boat ba-
sin just west of the present landing. The access channel will con-
nect into the existing deep water of the existing channel and ter-
minate in an 80 ' by 80 ' boat basin in highground. Spoil from the
excavation will be spread on the high ground around the basin. A
fish house and boat ramp are also planned.
10. Anticipated impacts
In conducting the excavation of the access channel, about 900 sq.ft.
of mixed, high marsh composed' of black needlerush, salt grass and
salt meadow grass, will be excavated. Another 4, 500 sq.ft. of inter-
tidal salt water habitat will be removed by constructing this chan-
nel. The highground boat basin will invove 7, 300 sq.ft. being ex-
cavated and another 22, 000 sq.ft. being covered by spoil material .
Approximately 3, 667 cu.yds. of spoil material will be produced by
the operation.
This portion of Cedar Island Bay is designated by the DMF as a pri-
mary nursery area. Adjacent waters support juvenile shrimp, various
finfish, clams, oysters, and blue crabs.
